    COLORADO LAW ENFORCEMENT DISTRUST ACT HB 1258

    The Colorado legislature is pushing through hb 1258 to once again legalize sanctuary cities. Local governments can direct law enforcement and public employees from cooperating with Federal immigration. If you live in Colorado or have friend or relatives there, please contact your State legislators and the gov. to oppose this bill.

    Below is my testimony I will give to the Colorado Senate Judiciary Committe April 1 on behalf of the Colorado Alliance for immigration reform to familiarize you with the issue:


    In 2006 the Colorado Democratic legislature enacted Senate Bill 90 to make sure local governments did not restrain law enforcement and public employees from cooperating with the Federal immigration enforcement. This was necessary to insure that criminal illegal aliens were not put back on the streetto prey on innocent victims in immigrant communities and the metropolitan areas at large.

    After the tragic accident in Aurora,where a drunk illegal alien plowed into a Baskin Robins killing achild, Governor Ritter decided something had to be done about thecatch and release policies local law enforcement was using to deal with criminal illegals. He called a statewide immigration summit todeal with the problem.

    At the summit all felt that local lawenforcement should work with the immigration and customs enforcement to deport criminal illegal aliens. There was even talk of brining287g training ( an intergovernmental immigration cooperation program) to Colorado to train several law enforcement jurisdictions at once. Both Sheriff Robinson and the Aurora Chief of Police, as representatives of there respective Colorado associations, supported this training.

    In 2010 While testifying in theColorado House on an immigration matter, several democratic legislators affirmed their support of cooperation with ICE at thejail level.

    1258 the law enforcement distrustact is an anti-cooperation bill designed to prevent local law enforcement from cooperating with immigration officials, thus makingsanctuary cities once again legal in Colorado. These anti-cooperation policies prohibit detaining previously deported criminals, such as gang members, unless they commit another non-immigration crime. It shouldbe noted that illegal re-entry after being deported is a federalfelony and grounds for arrest all by itself.

    The current cooperation bill (CRSarticle 29 of title 29) does not apply to those arrested for minor traffic infractions or suspicion of domestic violence.

    And, 1258's use of the safety clause isnot necessary and will make future modification difficult.

    The Colorado Alliance for immigrationreform and its members believe that hb 1258 is a danger to the safety and welfare of Colorado Citizens by allowing local governments to allow illegal aliens, criminal and otherwise, to prey on our communities. We urge you to side with integrity and oppose hb1258.
