    Advice Needed......

    Hello,

    I am wondering if you can assist me or offer me advice in anyway?

    I am a US citizen, my soon to be Ex-husband is a Canadian Citizen. He voluntarily left the United States to avoid impending deportation in August 2005 after receiving an extreme DUI conviction. He returned to our home in AZ in October 2005, and broke down our bedroom door, which was reported to the Sheriff's office.(charges are pending) During the process of obtaining an Order of Protection against him, I was informed that he had obtained one against me. Which excludes me and my minor daughter from our newly constructed home, or even to retrieve necessary personal belongings.

    I have contacted ICE, and they told me they don't have the manpower to look into this. I let them know that he is working (unauthorized) right around the corner from the Florence Immigration Detention Center. He continues to drink and drive on a suspended drivers license. I'm not sure how he was able to cross over the border. I have never filed any INS paperwork on his behalf.

    I am so confused and distraught over this. How is it possible that a Illegal Non-Citizen can get an Order of Protection against a US Citizen and take ALL of their belongings?

    I have retained an Attorney, and it will go through the Superior Court eventually. But in the meantime, my 11 yr old daughter and I are homeless.

    Any advice will be appreciated, please don't blast me, I did marry him, I loved him and wanted him to be LEGAL, but he chooses NOT to be. While he was deported, I found out he has not filed taxes since 1982 with the US or Canada.

    Unfortunately, we really can't give legal advice. We can only point you to the proper authorities and you have already contacted ICE. There are some other resources you might be able to use in our ALIPAC Action Panel found on the top tool bar of each web page on our site.

    I'm sorry to hear about your situation.

    Your local and state government should have offices and resources to address your situation with you and your daughter's need for shelter and assistance.

    You might want to let the local authorities know about the Deportation order against your husband and the drinking and driving. If he is caught drinking and driving as an illegal alien, ICE may place a hold hiim for deportation.

    Once things like this enter the court systems it is better for us not to comment very much on the matter.

    advice is cheap - so here goes
    contact all you're congressional reps at the federal level especially and ask them to intervene for you concerning ins failure to deport you're husband .have the paperwork ready. in other words, ins at the lower level wont help you- they dont help anyone---

    set up an appt with the police chief and let him know of you're situation.
    contact the media and let them know also.

    Thank-you for your replies...I must confess that I was on the other end of this deal too...I bailed him out (5k) of the Eloy INS detention facility..Oh how he loved me then....I also e-mailed my congressmen on his behalf.

    I am sooo ashamed now.

    The whole deal is amazing to me....Lets say..we had..ummm..20 MILLION ILLEGALS here that took out Orders of Protection against US Citizens, that were allowed to absconde their belongings, We wouldn't be much of a Country now would we???

    The Sheriff's Dept ought to be able to go to the residence with you so that you can take your personal belongings, too. It would be worth calling to ask them so that you and your child can at least have clothes on your backs while the courts sort out the rest.

    yes..Sheriff's dept said I have 15 mins to get in & out...the entire household is mine (excluding his clothes, toiletries,ect)..it won't work..plus that, my Husband can object to anything I take out of the home. Unbelievable..The Sheriff's Dept suggested that I don't take my "one chance" because of the time limit. My daughter was allowed to take out ONE bag of clothing 2 weeks ago.

    The 2 departments (city & Co)I've talked to, say they will get him. I had a site check done today, and there he is...working away...watching Monday Night Football at the local Bar Tonight...
