Graham warns of Republican impeachment push over Gitmo

Sen. Lindsey Graham (R-S.C.) warned Wednesday that Republican lawmakers would call for President Obama’s impeachment if he released more prisoners from Guantanamo Bay without congressional approval.

Republicans worry Obama may try to shut down the prison camp unilaterally after congressional opposition has repeatedly stymied efforts to pass legislation to close it.
“It’s going to be impossible for them to flow prisoners out of Gitmo now without a huge backlash,” Graham said. “There will be people on our side calling for his impeachment if he did that.”Graham served as a House prosecutor during former President Clinton’s 1998 impeachment trial.
Congress tried to build in a safeguard against Obama making unilateral decisions on releasing terrorist detainees by including language in the National Defense Authorization Act requiring the administration to alert Congress of such moves at least 30 days in advance.
Obama did not follow that law when he swapped five senior Taliban commanders for Army Sgt. Bowe Bergdahl.
Sen. Carl Levin (Mich.), the Democratic chairman of the Armed Services panel, said Obama had a plausible legal argument for ignoring the law.
“The White House did not comply with the requirement of the 30-day provision. However, the White House said it had power under Article II of the Constitution to do what it did,” Levin said. “I’m not a court that’s going to decide whether or not under Article II the commander in chief has the power to move this quickly even though Congress said you’ve got to give 30 days notice.”
Levin said Congress was notified that Obama might not follow the NDAA’s requirement in a signing statement attached to the law.
“The executive branch must have the flexibility, among other things, to act swiftly in conducting negotiations with foreign countries regarding the circumstances of detainee transfers,” Obama asserted in his Dec. 26 statement.
Senate Majority Leader Harry Reid (D-Nev.) on Tuesday applauded Obama’s decision to release five Taliban leaders because it would hasten the closure of the Guantanamo Bay prison camp.
“My own personal opinion, Guantanamo has been there far too long, and I think that we should get them out of there as quickly as we can,” he said.
Reid noted that Democrats have tried to pass legislation to close the prison camp and transfer the detainees to the United States to face criminal trials but have been “held up from doing so by Republicans.”
“So I'm glad to get of these five people, send them back to Qatar, and I think the arrangements made there are, as far as I understand, what's been explained to me, adequate,” he said the Taliban militants released over the weekend.
The former detainees must spend at least a year in Qatar, which helped mediate the exchange, under the terms of the deal.
Graham, a member of the Armed Services Committee who face a contested primary next week, said he has added language to the pending defense authorization bill that would require an up-or-down vote in Congress to approve the closure of Guantanamo.
The bill also includes a provision barring the administration from transferring detainees to Yemen, he noted.

Florida Republican Senator Marco Rubio savaged President Obama for his failure to notify Congress about the release of five Taliban prisoners from Guantanamo Bay as the law requires, claiming the president “believes somehow he’s become a monarch or an emperor.”
Rubio spoke Tuesday with Fox News’ host Gretchen Carlson about the White House’s refusal to tell Congress before they traded five high-level Taliban prisoners for Army Sgt. Bowe Bergdahl, captured by the Taliban after his likely desertion in 2009.
“The president has violated the law here,” the Florida senator asserted. “The law is very clear. He must give congressional notification 30 days before any prisoner in Guantanamo is released. He failed to do that.”
“Apparently the only person he told was [Senate Majority Leader] Harry Reid,” Rubio continued. “He didn’t even tell the chairwoman of the intelligence committee, a Democrat, Diane Feinstein.”
“This is a pattern of behavior by this White House,” the lawmaker later declared. “He believes somehow that he’s become a monarch or an emperor, that can basically ignore the law and do whatever he wants. And there’s a real, growing frustration — even among Democrats — at this sort of behavior.”

EXCLUSIVE: Allen West on Obama’s Terrorist Swap: It’s Time for Articles of IMPEACHMENT!

On Tuesday, as the nation remained captivated by the details of the Obama Administration’s release of five terrorists for one Army deserter, TPNN’s Tim Constantine sat down to speak with a man who knows about such things, former Congressman and Army Lieutenant Colonel Allen West.

Col. West pulled no punches, blasting Obama’s failed leadership and lamenting that this is the kind of president we get when people vote for “silly bumper sticker slogans.”

“Those of us in the know and in the inner circles have known since 2009, 2010 that Bowe Bergdahl was a deserter,” Col. West claimed. “He’s not a prisoner of war and we know the circumstances; we knew there were nondisclosure agreements that members of his platoon were forced to sign and, as always, the truth is starting to come out now. This whole episode was not about a swap, it was about an out-and-out release of five senior members of the Taliban structure.”

Col. West blasted the Obama Administration for trying to quietly shift focus from the VA scandal and, in doing so, created a new scandal by releasing five terrorists described as the “Terrorist Dream Team” in exchange for a soldier who had deserted his fellow soldiers. Noting that these terrorists were not “low-level” guys, but terrorists with links to Al Qaeda and Osama Bin Laden, Col. West stated,

“How many Americans may have lost their lives or were wounded or who were sacrificed in trying to secure these five individuals?”

President Obama has claimed that his signing statement on the National Defense Authorization Act means that the provisions outlined therein don’t apply to him. West pointed out,

“Signing statements have been used previously- Reagan did it, H.W. Bush did it, Clinton did it even more than George W. Bush did it- but we cannot have a president who does something like this, that has an incredible ramification and effect upon our national security… We negotiated with a terrorist organization.

Think about this, Tim: the Taliban told us, United States of America, who they wanted. And we acquiesced to the demands of a terrorist organization. And so that’s why today I have come out and said that, without a doubt, this is an impeachable offense, this represents aiding and abetting the enemy, this is a high crime and misdemeanor and United States House of Representatives should drive articles of impeachment on this president for this incident.”

West also noted that the Taliban does not represent a country, but are, instead, a terrorist faction. On the battlefield, West pointed out, those who are not part of a regular military force for a country are not afforded the same status as soldiers of an opposing army, but are rounded up and often executed.

Though National Security Adviser Susan Rice has claimed that Sgt. Bergdahl served with “honor and distinction,” the truth remains that the Obama Administration knew as early as 2010 that Bergdahl was a deserter and possibly an abettor of the Taliban.

“The truth is coming out and it’s going to be a very shameful episode for the United States Army. They’re going to have to charge him with desertion and that’s a very serious crime in a combat zone during the time of war.

This is not AWOL; AWOL is back at a Garrison, back at your home station… They’re going to have to bring up those charges against Bergdahl because the evidence is there. I don’t care what Susan Rice says, who did not comport herself very well once again… For the national security adviser to not know the backstory on Sgt. Bergdahl, there is no way we can trust Susan Rice to advise us on national security.”

“She is a delusional liar, that is all you can say,” West continued.

West outlined the need for a thorough Congressional investigation and reiterated that the House ought to draw up articles of impeachment against the president.

“I think the articles of impeachment are there because the president broke the law. I don’t care about this Article II signing statement; you can’t just pick and choose and say what’s constitutional and what’s not constitutional.

How many scandals are going to engulf the Obama administration before we start to realize that this is a failed administration? This affects our national security; there is a high potential that in the near future Americans are going to die because we gave up these five senior members.”

The Obama Administration has shrugged-off the release of the GITMO terrorists by claiming that U.S. forces could always recapture them, a notion that appeared to set-off Col. West.


“You see, that’s easy for some punk-boy-pajama person sitting up there in Washington, D.C.; but somebody’s son is going to have to go and do it all over again and it should not have happened but, once again- this is the result, this is the consequence of voting for ‘hope and change’ and ‘change we can believe in’ and all the other silly bumper sticker slogans that were out there!”

5 High Crimes And Misdemeanors For Which Obama Deserves To Be Impeached

Barack Obama's tenure in the White House has been one of the low points in the history of our republic. It may seem melodramatic to compare the damage Barack Obama is doing to 9/11, Pearl Harbor, and the White House being burned during the war of 1812, but in a sense he's worse than any of those calamities because he's a purely self-inflicted wound. It's not a sneak attack from the Japanese laying us low this time; it's the man our nation willingly chose to lead us not once, but twice.
It's bad enough that Barack Obama is not qualified or competent to handle a job like the presidency, as his performance has proven again and again. Not only has he ridden the economy so deep into the ground that the percentage of Americans not working is at a 36 year high, he's piled on so much debt in such a short period that the destruction of our economy via bankruptcy and/or runaway inflation may be inevitable at this point.
Worse yet, Barack Obama has taken the position that he can rewrite any law he chooses, any way he chooses, for any reason he chooses. In other words, although Obama is not a dictator, he IS CLAIMING THE RIGHT TO EXERCISE DICTATORIAL POWERS for himself. This is extraordinarily dangerous to our republic. As Congressman Trey Gowdy has pointed out, if Obama claims he has the power to change Obamacare or illegal immigration law at his whim, why couldn't he do the same with election law? In other words, Obama has no more right to give illegal aliens work permits or delay congressionally mandated parts of Obamacare than he does to ban handguns by decree or reduce the number of electoral votes in Republican leaning states. That's why it's so incredibly dangerous to allow Obama to be "above the law." It's because the abuses committed tomorrow by Obama or even future Presidents are likely to build upon the ones that we're allowing to go unchallenged today.
The best way to check Barack Obama's power would be to impeach him. Despite the fact that Obama is much more deserving of impeachment than Clinton (perjury) or Andrew Johnson (who violated the Tenure of Office Act), it's unlikely that Obama will be impeached. Unfortunately, even if Republicans take back the Senate in 2014, there won't be enough votes in the upper chamber to get rid of Barack Obama. That's tragic, because for the good of country, Barack Obama deserves to be driven from office in disgrace.

1) For Illegally Changing Obamacare: It doesn't matter if the Affordable Care Act is called "Obamacare;" Barack Obama doesn't have the authority to unilaterally change the law. Changes to the law have to be made by Congress and then signed into law by the President. Barack Obama has broken the law repeatedly by making at least 23 unilateral changes to the law. Saying, "The Republicans won't work with us," or more disturbingly, "It's politically convenient," is not an excuse for overriding the Constitution of the United States.

2) Engaging In An Illegal War In Libya: While the President is the Commander-in-Chief, the Constitution gives Congress the ability to declare war. In the modern era, that has just meant an authorization of force from Congress, which Obama did not pursue. Additionally, we've tended to give Presidents the benefit of the doubt when American lives are at stake. However, in Libya, Obama didn't seek the permission of Congress and we had no national security interest in Libya. In other words, Obama's real justification for bombing that country and overthrowing its government was that HE FELT LIKE IT. Using the exact same precedent, the next President could bomb Mexico or Cuba without Congressional authorization. Incidentally, bombing either of those nations would probably make more sense than bombing Libya, although that's not saying much since our intervention there has been a complete disaster.

3) Lying To Sell Obamacare To The American People: When Barack Obama told the public if they liked their plan, they could keep their plan, he was lying. When he told Americans if they liked their doctor, they could keep their doctor, he knew it wasn't so. When he told Americans Obamacare would cut costs by $2,500 for the average family, he was deliberately misleading the public. For a President of the United States to PERSONALLY spend months telling deliberate falsehoods to the American people in order to convince them to support something as massive as a government takeover of the health care system is beyond the pale. If the wilful lies Barack Obama told to sell Obamacare don't merit impeachment, then there are no lies that a President could tell to the American people big enough to merit impeachment.

4) Violating Immigration Law And Illegally Implementing The DREAM ACT: Simply put, Barack Obama has ceased to enforce most immigration law. As Senator Jeff Sessions has noted, “at least 99.92% of illegal immigrants and visa overstays without known crimes on their records did not face removal.” In other words, we've already stopped deporting anyone other than SOME hardcore criminals and gang members. Additionally, when the DREAM ACT didn't make it through Congress, Obama simply implemented it ANYWAY. Not only is he explicitly telling illegal aliens they can stay in the United States, he's illegally giving them work permits that he has zero right to offer. Even if Congress is too split on the issue to unify and put a stop to what Obama's doing, that doesn't change the fact that it’s flatly illegal. If this is allowed to stand, tell me ANY LAW on the books that the President is obligated to enforce?

5) Releasing 5 Taliban Terrorists In Exchange For Deserter Bowe Bergdahl: Barack Obama was legally required to alert Congress 30 days before he released terrorists from Gitmo. Not only did he fail to do so, but more seriously he released five high level terrorists who he knew were likely to help kill Americans in the future. One of the terrorists has ALREADY SAID he intends to go back to Afghanistan to fight America. Barack Obama spent a lot of time bragging about getting Bin Laden, but he just released five Bin Ladens back into the world and a lot of Americans who didn't desert their country are likely to die because of it.

Obama Apologizes to Congress, Judge Napolitano Says Impeach, Even Feinstein is Upset

The AP has reported that the White House has apologized for not giving key lawmakers advance notice of the controversial Bowe Bergdahl prisoner swap:

Sens. Dianne Feinstein of California and Saxby Chambliss of Georgia, the top Democrat and Republican respectively on the Senate Select committee on Intelligence, said White House officials called them Monday to say the lack of notification had been an oversight. Feinstein said she received a call from Deputy National Security Adviser Tony Blinken.
The White House damage control comes as Republican lawmakers accused the White House of putting U.S. service men and women at risk by releasing the five top Taliban members being held in Guantanamo in exchange for Bergdahl.

An oversight?
How is that possible, when Obama himself signed the 30 day advance notice into law last year?

The administration is required to give Congress 30 days advance notice of any plans to release a prisoner from the Guantanamo Bay detention camp in Cuba, per section 1033 of the 2014 National Defense Authorization Act — signed into law by Obama in 2013.

Oh, that’s right – King Obama can do whatever he damn well pleases. Remember, back in February he told French President Francois Hollande so on their Monticello visit:

“That’s the good thing as a President, I can do whatever I want.”

Heck, even Feinstein is upset over this one.

Feinstein also said leaders of the House and Senate Intelligence panels were almost unanimously against a prisoner trade when it came up in 2011.
She said the chairmen and ranking Republicans of the “connected committees” spent a lot of time in 2011 reviewing the possibility of a prisoner swap and came out firmly opposed to releasing senior militants from the prison camp at Guantanamo Bay.
“There were very strong views and they were virtually unanimous against the trade,” she said.

Feinstein echoed the sentiments of many Americans when she expressed concern about Bergdahl:

“I certainly want to know more about whether this man was a deserter.”

When asked if the White House might have avoided notifying Congress about the impending swap for fear of opposition, Feinstein said that was a possible reason:

“Yeah, it could be. But the White House is pretty unilateral about what they want to do when they want to do it. I think the notification to us is important and I think it would have been a much better thing to do because you do try to work together.”

More damning evidence that the “oversight” was anything but comes from House Speaker John Boehner. In a statement, he said that serious questions about the possibility of a prisoner exchange were raised in talks with Congress in 2011 and 2012. CNN reports:

“Unfortunately, the questions and concerns we had were never satisfactorily answered and they remain today,” he said.
Boehner said the administration “provided assurances” in late 2011, early 2012 and again in 2013 that talks with Congress over an exchange would resume if the possibility became credible again.
“There was every expectation that the administration would re-engage with Congress, as it did before, and the only reason it did not is because the administration knew it faced serious and sober bipartisan concern and opposition,” he argued.

It is disturbing that Obama has decided to break a law that he signed and claim that it was an oversight – and that he expects anyone to believe or accept any of it.
You can bet that citizens who break a law will be held accountable – apologies will NOT be accepted. In fact, under the very law that Obama broke – the NDAA – American citizens can be indefinitely detained without being charged with or tried for a crime.
Will anything happen to Obama for this act of treason?
Probably not, but some experts say calling for his impeachment is justified:



In case you missed it, Judge Napolitano pointed out that Obama may also be guilty of helping terrorists, because the five Guantanamo prisoners released may return to terror:

“That’s why I say the president may well have committed a federal crime,” said Napolitano, “by giving material assistance to a terrorist organization. He knows — ought to have known — that that’s what these guys will do.”
“The president should be impeached for this,” he said. “In my view, it’s a very, very valid argument that people are going to start talking about.”

And this administration continues its rogue, lawless reign over America. It is bad enough that Obama has stomped all over the Constitution. Now he’s released prisoners who are likely a threat to this country.
How much more damage will be done before the King’s president’s term is over?
I shudder to think of it.

Calls for impeachment hearings against Barack Obama have been common throughout his presidency, which has been plagued by numerous scandals and allegations of increasingly brazen cover-ups.
The latest controversy surrounding the release of Army Sgt. Bowe Bergdahl has given those proponents even more ammunition to use against Obama. It has also brought new voices in favor of impeachment to the debate.
Among those are former U.S. Army Lt. Col. Allen West, who explained Tuesday why he feels the circumstances surrounding Bergdahl’s release from Taliban custody likely warrant impeachment. He listed a number of factors that helped him reach this opinion.
First, he explained that Obama unilaterally declared unconstitutional a measure he himself signed into law requiring he give 30 days’ notice to Congress before releasing Guantanamo Bay prisoners.
“Once again Obama used selective discretion as to what law he feels he must adhere to – in this case it has severe ramifications for our national security,” West wrote.
The White House negotiated with the Taliban, he continued, which is a “non-state, non-uniform terrorist organization.”
Furthermore, when choosing which five terrorists he would allow to be exchanged for Bergdahl, West noted he picked a quintet of the most dangerous terrorists in the facility.
“There are some 141 detainees at GITMO,” he wrote. “The five released were senior Taliban officials, basically members of Mullah Omar’s inner circle. If we wanted to release detainees in exchange for Bergahl, there were many others to choose from. Why these?”
The recidivism rate among released terrorists has doubled, he wrote; and even administration sources up to and including Obama admit these five released prisoners pose a real threat to American safety.
In exchange for setting such dangerous individuals free, West concluded that America received in return a “deserter, who by his own self-proclamation harbors anti-American sentiments.”
While Obama claims that “no American should be left behind,” West points out the apparent hypocrisy of that statement, wondering if he has “forgotten about Benghazi and Marine SGT Tahmooressi.”
West concludes by declaring Obama’s “unilateral negotiations with terrorists and the ensuing release of their key leadership without consult – mandated by law – with the U.S. Congress represents high crimes and misdemeanors, an impeachable offense.”
He went on to call on congressional leaders “to draft articles of impeachment as no one is above the law in America.”

It’s no secret of my hate for Obama. I’m certainly not politically correct but I do try not to use the word hate loosely. My destain for Obama has nothing to do with skin color. It’s his arrogance, lawlessness and what he has done to fundamentally change our country. However, it goes deeper than policy. Obama’s disrespect for the office he holds and his distaste for United States Military is appalling. President Reagan made Americans feel good, believed in peace through strength, and had so much respect for the Oval office he wouldn’t remove his suit jacket. Could you imagine President Reagan funding and negotiating with our enemy?
There’s no doubt the President Barack Hussein Obama’s a Muslim. He despises everything to do with Christianity and traditional America. When Obama said “America is no longer a Christian Nation.” he was simply stating his goal to infiltrate America with Islam. Obama has done everything possible to destroy American freedom and liberty.
Obama’s scandals are so rampant that they are hard to name in a single breath. The most destructive of all his scandals is the most recent trade he made with America’s enemy. The trade of five Taliban terrorist for an American Muslim sympathizer. Traitor Army Sergeant Bowe Bergdahl deserted his platoon at war time. Under the Uniform Code of Military justice article 85 a deserter who desserts his post at the time of war is punishable by death. Obama’s goal was to distract the American people from V.A. scandal and many others lurking in the background. Congress just recently selected a bipartisan committee to investigate the deaths of four Americans that died in Benghazi. Obama gave $500 million dollars to Al Qaeda terrorist for weapons that were used to kill our four dead Americans in Benghazi. The Benghazi Committee claims the US government allowed arms to flow to al-Qaeda-linked militants who opposed Muammar Gaddafi. Their rise to power, the group says, led to the Benghazi attack in 2012
the group claims the strongman Gaddafi offered to abdicate his presidency, but the US refused to broker his peaceful exit. Benghazi was a failed kidnapping plot by Obama so he could look Presidential just in time for 2012 election. US Ambassador Chris Stevens was to be captured and traded for ‘blind sheikh’ Omar Abdel-Rahman, who hatched the 1993 WTC bombing plot. A soldier who dessert’s his platoon in the time of war is treason punishable by death.
President Obama vowed to use the pen to enforce his agenda by passing Congress and the American people. Obama objected and override constitutional and moral laws on the verdicts of balancing the budget, czars, Obamacare, drilling for oil, the protection of marriage , gays in the military, immigration, state law, the banking industry, the 2nd amendment , separation of powers and ect. President Obama sees himself as above the law. In the name of his subtle and deceiving concerns and personal causes. Obama has rapidly transformed our republic into tyrannical lawless state.
Obama’s actions are incomprehensible. Many times I contemplated whether Obama was incompetent, purposely trying to destroy America or both. The exchange of the Five Taliban terrorist for an American traitor displays Obama’s vast hate for America. Many American lives were lost from those Taliban terrorists. Obama’s activities are a slap to our Military men and women to ever wear a uniform. Obama has surrounded himself with the most rabidly, radical, socialist academicians today. He has fought for abortion procedures and opposed rulings that protected women and children that even Planned Parenthood did not seek to support. He is openly hostile to business and aggressively hostile to Israel. The scandals keep piling high but yet the Emperor has yet to be held accountable. Although he claims to getting to the “bottom of it” on IRS, DOJ, NSA, Benghazi, V.A. and so on. He is the most dishonest political figure I have ever witnessed. Even by the low standards of his presidential predecessors, his narcissistic, arrogance is unequaled. Using Obama as the bar, Nero would have to be elevated to sainthood. The Emperor has yet to be held accountable for any of his actions.
It’s revolting how the media and liberal democrats continue to cover up Obama’s lies and destruction. Does the democrat party believe a black American is capable of being a great leader rather than a Chicago thug?If we could impeach a President for lying under oath certainly we can prosecute a President Hussein for funding and negotiating with our enemy. The case for impeachment of Barack Hussein Obama -- June 3, 2014



(by Col. Allen West) -- [...] Now before all the detractors go apoplectic here, let me tell you about Article 2 signing statements, their intent, purpose, history, and usage, and the implications for the president’s impeachment.

President Obama used an Article 2 signing statement to deem unconstitutional a measure HE had signed into law contained in the National Defense Authorization Act (NDAA). The law stated that he must advise Congress within 30 days about any plans to transfer detainees from GITMO. Obama basically stated that this was “unconstitutional” and that his unilateral action fell within his purview. Once again Obama used selective discretion as to what law he feels he must adhere to — in this case it has severe ramifications for our national security.
Why would the United States acquiesce to the demands of a non-state, non-uniform terrorist organization — the Taliban? The Taliban is our enemy and it is not a nation-state with whom we should enter into negotiations. There are some 141 detainees at GITMO. The five released were senior Taliban officials, basically members of Mullah Omar’s inner circle. If we wanted to release detainees in exchange for Bergdahl, there were many others to choose from. Why these?
The rate of recidivism for GITMO released detainees has gone from 1 in 6 to 1 in 3 — and why would we think a one-year travel ban out of Qatar will be respected, or even make a difference with today’s modern communications technology? Even Obama has now stated they may just return to terrorist activity.
Obama’s breaking of the law in this case presents serious national security concerns — for all Americans. This is aiding and abetting the enemy, which goes along with the collusion of this administration with Muslim Brotherhood-affiliated organizations and supplying weapons and arms to Islamists.
Obama just released the leadership of a terrorist organization, and what did we get in return? A deserter, who by his own self-proclamation harbors anti-American sentiments — which it seems that Susan Rice, our esteemed National Security Advisor, didn’t even realize his heinous actions — or maybe as usual she just lied about it again. Bergdahl served the United States with honor and distinction? Let’s not send Susan Rice out ever again.
To hear Obama state that “no American should be left behind” — has he forgotten about Benghazi and Marine SGT Tahmooressi? How about leaving behind American veterans to die?
Ladies and gentlemen, I submit that Barack Hussein Obama’s unilateral negotiations with terrorists and the ensuing release of their key leadership without consult — mandated by law — with the U.S. Congress represents high crimes and misdemeanors, an impeachable offense.
So I call upon the leadership of the U.S. House of Representatives; Speaker John Boehner, Majority Leader Eric Cantor, Minority Leader Nancy Pelosi to draft articles of impeachment as no one is above the law in America. The failure to do so speaks volumes.
