    FBI Director James Comey went against the wishes of Attorney General Loretta Lynch when he sent a letter to lawmakers Friday notifying them that the agency was reviewing new emails “pertinent” to the investigation into Hillary Clinton’s private email server.

    A government official who requested anonymity to discuss the matter told The Hill that the Justice Department’s stance was to abstain from taking any actions that could impact the presidential race.

    “The AG’s position is consistent with the department’s position not to take investigative steps that would influence an election so close to an election and to not comment on ongoing investigations. Director Comey decided to operate independently of that guidance by sending that letter to the Hill.”The official said that while Lynch and Comey did not discuss the matter directly, “the position of the department was made clear to the FBI.”

    It has long been the policy to avoid wading into presidential elections.

    “Law enforcement officers and prosecutors may never select the timing of investigative steps or criminal charges for the purpose of affecting any election, or for the purpose of giving an advantage or disadvantage to any candidate or political party,” a 2012 memo from former Attorney General Eric Holder read. “Such a purpose is inconsistent with the Department's mission and with the Principles of Federal Prosecution.”

    In a note to staffers that preceded his letter to Congress, Comey wrote: “Of course, we don’t ordinarily tell Congress about ongoing investigations, but here I feel

    Comey has taken heat from both sides of the aisle for not giving enough information about the new developments in the Clinton case. He said only that FBI was reviewing additional emails found through an unrelated investigation.

    Some Republicans, particularly GOP nominee Donald Trump, jumped on the letter as evidence that the FBI was reopening its investigation and may revisit its decision to not recommend charges against Clinton.

    Democrats blasted Comey for not being forthcoming in his letter, leaving the door open for innuendo about the investigation from Clinton’s detractors.

    Sen. Dianne Feinstein (Calif.), the ranking Democrat on the Senate Intelligence Committee, called Comey’s move “appalling.”

    “Without knowing how many emails are involved, who wrote them, when they were written or their subject matter, it’s impossible to make any informed judgment on this development,” Feinstein said in a statement Friday.

    “However, one thing is clear: Director Comey’s announcement played right into the political campaign of Donald Trump, who is already using the letter for political purposes. And all of this just 11 days before the election.”

    Attorney General Loretta Lynch advised FBI Director James Comey not to send a letter to Congress informing them of the discovery of new emails related to the investigation into Hillary Clinton’s private email server, The New Yorker reported early Saturday.

    A source in the Obama administration told the magazine that Lynch argued for following the Justice Department’s practice of not taking actions that could influence the outcome of an election.Comey reportedly said he felt obliged to notify Congress about the review of the new emails because he had promised to keep lawmakers informed when he testified about the investigation in July.

    “Of course, we don’t ordinarily tell Congress about ongoing investigations, but here I feel an obligation to do so given that I testified repeatedly in recent months that our investigation was completed,” Comey wrote in a memo to FBI employees that was obtained by the Washington Post. “I also think it would be misleading to the American people were we not to supplement the record.

    “At the same time, however, given that we don’t know the significance of this newly discovered collection of emails, I don’t want to create a misleading impression. In trying to strike that balance, in a brief letter and in the middle of an election season there is significant risk of being misunderstood.”

    Ex-DOJ spokesman rips Comey's treatment of Clinton




    A former Justice Department official on Friday tore into FBI director James Comey, saying his letter to Congress about Hillary Clinton’s email server was his “worst abuse yet.”

    Matthew Miller, who previously ran the Justice Department's public affairs office, called Comey's Friday letter an "inappropriate public disclosure.”

    Comey informed lawmakers earlier in the day that his agency had found new emails relating to the investigation into Clinton’s private email server, but provided no further information.

    “Today's disclosure might be worst abuse yet. DOJ goes out of its way to avoid publicly discussing investigations close to election," Miller wrote in a tweetstorm.

    The Clinton campaign has called on the FBI to release full details to the public regarding the investigation. The news that Clinton's case was under new review comes fewer than two weeks from election day.

    "This might be totally benign & not even involve Clinton. But no way for press or voters to know that. Easy for opponent to make hay over," Miller said.

    In July, Comey announced that the FBI had completed its investigation into Clinton's private server, and that it would not be recommending charges be brought against the former Secretary of State.

    The New York Times reported Friday that the emails now under review were discovered during a separate investigation into former Rep. Anthony Weiner (D-N.Y.), who is married to longtime Clinton aide Huma Abedin.

    Miller said Comey ignores protocol only when it relates to Clinton's case, and not that of her opponent, Donald Trump.

    "Which takes us back to the original rule: you don't comment on ongoing investigations. Then multiply that times ten close to an election," said Miller.

    "For whatever reason (& there are many theories), Comey continues to ignore that. But only for Clinton," he said.

    Your candidate has done wrong.

    1. she used a private email server for government business
    2. she jeopardized top secret, classified and confidential information of the United States
    3. she destroyed emails after issuance of a Congressional subpoena
    4. she refused to help our Americans in Benghazi
    5. she abused her office to help Bill get huge speaking and consulting fees
    6. she exploited "charity" to enrich her family and friends
    7. she lied to the FBI
    8. she lied to the US Congress while under oath
    9. she mismanaged if not stole $6 to $8 billion from the US Department of State (added per Beezer!!)

    Are these actions illegal? I would think so, but it doesn't matter whether they're illegal or not. We don't want a President who does these things. We want a President who doesn't even use email. We want Donald J Trump who doesn't use email at all!

    You had your chance to produce all your emails. You had over a year to produce all your emails. All you had to do was produce all your emails. It was so simple. But instead you chose to delete at least 33,000 emails. You obstructed justice when you did that. You may have even obstructed your own. This is a sign of supreme incompetence, a total disrespect for the law, and proof that you're an idiot and a crook!!

    Okay, when Comey didn't recommend prosecution of Hillary the Democrats were enthusiastic in their gleeful comments when commending Comey for doing what they perceived as the right thing. Now that the shoe is on the other foot, they're crying foul. Comey did the right thing by ignoring any suggestions that he keep silent on the discovery of new information that could be damning to Hillary's campaign. Let's assume Comey had remained silent and the new information was key to Hillary's future prosecution. Let's further assume that Hillary won the election. Wow, could you even start to imagine the hell Comey would have went through in such a case? The poor man would have been hung by his baby makers from the Washington Monument.
