WASHINGTON, D.C. – On Wednesday, Nov. 19, U.S. Supreme Court Justice Clarence Thomas distributed Leo C. Denofrio’s renewed application for a stay of the election for conference on Dec. 5.
If four of the nine justices favor review, a hearing will be scheduled.
His first application was denied by Justice David Souter on Nov. 6. However, rules of the court allow for the renewed submission to a justice of choice.
Beginning in October, Denofrio made his way up through the ranks of the courts until his constitutional question as to the meaning of “natural born citizenâ€

This might end up being favorable to those wanting to return the 14th Amendment to it's original intent and nullifying the American citizen status of children born to illegal aliens.

Congress has the authority to pass laws that define who is or is not a natural born citizen. That is because there is no definition of natural born citizen in the Constitution. It was left up to the Congress. Congress has passed laws that declare anyone who is born outside of the U S to be a natural born citizen if both parents are U S citizens. This law suit seeks to have the Supreme Court create a whole new class of citizens, they would be Citizens but not natural born citizens or naturalized citizens. The Supreme Court could do that since there's no way to prevent it if it handed down a ruling like that. But are they going to do that? No. Besides it won't effect Obama because it wasn't in effect when the election was held. Ex post facto laws or court decision are not Constitutional.
