Two Texas Border Patrol agents await possible life sentencing,
having been charged with shooting a Mexican citizen who
attempted to smuggle drugs into America. Prosecutors gave the
smuggler full immunity to testify against the agents and a jury
convicted the officers on multiple charges including assault
with a deadly weapon. Incredibly, the prosecutor says the
Border Patrol pursuit policy prohibits the pursuit of someone
who is fleeing. We’ll bring you this unbelievable story
tonight.

In a chilling development that casts strong doubt on the U.S.
government's ability to manage any guest worker program, the
U.S. Citizenship and Immigration Service responded to a Freedom
of Information Act request for H1-b data by saying…we can't
find it. They can't find the information on who they granted
visas to, or what companies they granted them to. How big a
problem is this? What does this mean for the possibility of a
well-run guest-worker program?

The 9/11 Commission was so frustrated with repeated
misstatements by the Defense Department and Federal Aviation
Agency about their response to the 2001 terror attacks that it
considered an investigation into possible deception, the
panel's chairmen say in a new book. Republican Thomas Kean and
Democrat Lee Hamilton also say in “Without Precedent” that
their panel was too soft in questioning former New York Mayor
Rudolph Giuliani, and that the 20-month investigation may have
suffered for it. We’ll bring you that report tonight.

Vali Nasr, Middle East expert and author of "The Shia Revival:
How Conflicts within Islam Will Shape the Future," joins Lou
tonight to discuss the lasting impact of the conflict between
Hezbollah and Israel.
