CA: College Stops Student From Handing out Pocket Constitutions (video)



Free speech only allowed in 'designated areas'

A community college in Modesto is coming under fire after campus security shut down a student’s efforts at handing out copies on the U.S. Constitution.
Fox News reports that 25-year-old Modesto Junior College student Robert Van Tuinen was honoring Constitution Day, celebrated on September 17, when a campus security officer told him he was in violation of school policies.
The entire incident was caught on camera and placed on YouTube.
Van Tuinen was told by the officer that in order to pass out the Constitutions he would need to do so in a designated space, and have prior permission from the University.
The student tries to explain that he is attempting to start a Young Americans for Liberty chapter on campus.
The officer then escorts Van Tuinen into an administrative building where he meets with a woman who shows him a book of the school rules surrounding free speech on campus. She informs him that there is a designated area outside of the student center, but it’s already being used by two other students.

Van Tuinen is told he will have to wait several days or possibly weeks before the space is available.

Modesto Junior College in California told a student that he could not pass out copies of the United States Constitution outside the student center on September 17, 2013—Constitution Day. Captured on video, college police and administrators demanded that Robert Van Tuinen stop passing out Constitution pamphlets and told him that he would only be allowed to pass them out in the college's tiny free speech zone, and only after scheduling it several days or weeks ahead of time.

The video ends with the woman instructing Van Tuinen to call Brenda Thames, vice president of student services, who can better explain the school’s policy.
A spokeswoman for the college told Fox News that students and the general public are allowed to pass out materials in areas on campus that are generally available to the public, as long as they do not disrupt the orderly operations of the college.
Modesto Junior College Marketing and Public Relations officer Linda Hoile said, “In the case of the YouTube video, it does not appear that the student was disrupting the orderly operations of the college and therefore we are looking into the incident.”
