Migrant Arrested for Pushing Two Men Onto Upper East Side Subway Tracks in New York City
An undocumented migrant was arrested on Tuesday, March 10, in New York, for allegedly pushing two individuals onto subway tracks. One of the reported victims was an 83-year-old Air Force veteran.
The accused, 34-year-old Bairon Hernandez, is a migrant from Honduras who entered the U.S. in 2008, according to Department of Homeland Security (DHS) documents. He was deported four times prior to the assault, with the latest deportation being in 2020. However, he managed to return to U.S. each time.
The two individuals shoved onto the tracks by Hernandez were Richard Williams and John Rodriguez. The incident occurred at Lexington-63rd Street station on the Upper East Side of Manhattan.
DHS documents also reveal that the Honduran native is a repeat offender who has at least 15 criminal charges against his name. His previous charges include domestic violence, aggravated assault, possession of a weapon, drug possession, assault and obstruction of police.

Williams, who is an Air Force veteran, was found unresponsive and is currently fighting for his life following the attack. Rodriguez suffered minor injuries and is in a stable condition. Williams’ daughter, Debbie, told The New York Post that she wants Hernandez to face serious consequences for his actions.

“Now I’m pissed, now I’m upset. How did he get back here? I want him to go to the Venezuela prison, the worst place he could go to. I want him to suffer for the rest of his life. Prison justice would be appropriate,” Debbie said.
DHS has urged local New York authorities not to release Hernandez from their custody because of his problematic immigration status. DHS Deputy Assistant Secretary Lauren Bis said, “We are praying for the victims and their families.”

Bis issued an official statement on Thursday, March 12, calling Hernandez a “serial criminal.” She said, “Bairon Posada-Hernandez is a serial criminal and a four-time deported illegal alien from Honduras who should never have been able to walk our streets and harm innocent Americans.”
According to a complaint lodged by Manhattan prosecutors, Hernandez has been charged with first-degree assault and first-degree attempted assault. However, he pleaded not guilty and denied involvement in the incident.
The incident follows New York Mayor Zohran Mamdani‘s signing of an executive order that reduces Immigration and Customs Enforcement (ICE) activities in the city. Mamdani said in a statement, “We will make it clear once again ICE will not be able to enter New York City property without a judicial warrant.”
Governor Kathy Hochul presented new anti-ICE proposals earlier this year. One proposal dismisses the existing agreements between local and federal law enforcement authorities.
The Trump administration strongly condemned the decisions of both Mamdani and Hochul and raised questions over alleged sheltering of undocumented immigrants from federal agents.

One of the victims, a 30-year-old man, reportedly is in stable condition while the other, an 83-year-old Air Force veteran, remains in critical condition.
“Bairon Posada-Herandez is a serial criminal, and four-time deported illegal alien from Honduras who should never have been able to walk our streets and harm innocent Americans,” said Deputy Assistant Secretary Lauren Bis. “We are praying for the victims and their families. DHS is calling upon New York sanctuary politicians to commit to this ICE detainer and not release this heinous criminal back into New York communities.”

Posada-Hernandez was arrested for attempted murder on March 10, 2026. That same day, ICE placed a detainer on the Honduran national.
Posada-Hernandez first entered the country on January 2, 2008, and has been deported four different times, most recently in 2020. He entered illegally a fifth time at an unknown date and location.
The suspect has a lengthy criminal history, including 15 prior charges such as simple assault, domestic violence, obstruction of police, possession of a weapon, drug possession, and aggravated assault.
In February, DHS condemned New York City’s Mayor Zohran Mamdani for signing an Executive Order turning New York City into a shield for violent criminal illegal aliens to reoffend and create more innocent victims.
Mamdani’s action came just one week after Governor Kathy Hochul’s legislative proposal to bar local police departments from partnering and cooperating with ICE law enforcement.
In February, there were more than 7,110 aliens in custody across the state of New York with an active detainer. The crimes of these aliens include 148 homicides, 717 assaults, 134 burglaries, 106 robberies, 235 dangerous drugs offenses, 152 weapons offenses, and 260 sexual predatory offenses.

The suspect has been in the United States illegally.
UPPER EAST SIDE, Manhattan (WABC) -- The man charged with pushing two men onto subway tracks on the Upper East Side, leaving one man brain dead, was in the country illegally.
Bairon Hernandez, 34, originally from Honduras, has a prior conviction in New Jersey for entering the country illegally, and a conviction in Texas for re-entering illegally.
Hernandez first entered the country on January 2, 2008, and has been deported four different times, most recently in 2020, according to the Department of Homeland Security, .

Hernandez allegedly pushed the two people onto the subway tracks just minutes apart at a station on the Upper East Side over the weekend.
He was arrested in Brooklyn at a shelter after police say they received a tip.
Hernandez was charged with attempted murder, attempted assault, assault and reckless endangerment. Those charges could be upgraded.
One of his victims, an 83-year-old man, underwent surgery for brain bleed.
Following the surgery, the victim "did not have any brain activity, meaning that he is brain dead."
The incident happened Sunday around 11:30 a.m. at the Lexington Avenue-63rd Street station.
A 30-year-old man was standing on the southbound F/Q platform when he was suddenly pushed from behind and fell onto the tracks.
The same suspect then approached the 83-year-old man from behind and pushed him onto the tracks.
Both victims were taken to the hospital. The 30-year-old was said to be stable.
The 83-year-old victim's family told Eyewitness News that he is an Air Force veteran and that he and his wife have been married for 55 years. He has three daughters and two granddaughters.
On Monday, the younger victim, John Rodriguez, spoke exclusively with Eyewitness News and said he was caught by surprise and pushed out of nowhere.
Rodriguez, of Queens, said he was on his way to work when he says the man shoved him -- completely unprovoked.
"I panicked, I started asking for help, not only for me but for the other man that was pushed," he said.
Rodriguez started recording as a good Samaritan tried to help him. That's when police say the other victim was pushed.
As for Rodriguez, he is recovering from an injured shoulder and neck. He said he has also developed a fever.
He said that as for returning to the subway, it will be touch-and-go.
"I get panic attacks just thinking about getting on the subway," he said.
The NYPD said so far this year, there have been nine subway pushes, which is up compared to three this time last year.

The younger victim helped Williams off the tracks and fellow straphangers got the pair back onto the platform before a train came.
Williams was waiting on the downtown platform for the F and Q trains when police say Hernandez suddenly shoved him and the second man onto the tracks.
He recently celebrated his 55th wedding anniversary and had remained active in his retirement after a career making bulletproof equipment, a family member told the New York Daily News.

It comes after the NYPD revealed transit crime spiked nearly 20% in February as cold weather policies prevented cops from booting rule-breaking passengers from the subway.
More than 190 offenses were reported on the network last month, an 18.5% jump from February 2025, NYPD data show.
“The increase coincided with record cold temperatures and snow in February, when ridership patterns shifted and the department paused ejections from the transit system for violations of the rules during the extreme weather,” the NYPD said in a statement.

A four-time deported illegal immigrant from Honduras with 15 prior criminal charges shoved two victims onto the tracks at a New York City subway station this week, including an 83-year-old Air Force veteran who remains in critical condition, according to reports.
The Department of Homeland Security (DHS) indicated Wednesday evening that Immigration and Customs Enforcement (ICE) lodged a detainer against Honduran national Bairon Posada-Herandez, 34, after he was arrested for allegedly shoving two men – unprovoked – onto the train tracks inside the NYC subway system. The older male, 83-year-old Air Force veteran and grandfather Richard Williams, is reportedly still fighting for his life at a New York City hospital.
Posada-Hernandez first entered the country in 2008, and was subsequently deported four separate times, the last time being in July 2020, before reentering later for a fifth time at an unknown location and date, Fox News Digital has learned.
At the time of the subway incident this week, Posada-Hernandez had a lengthy criminal history as well, including at least 15 prior charges for crimes such as aggravated assault, domestic violence, possession of a weapon, obstruction of police, simple assault and drug possession.

Fox News Digital reached out to the New York City Department of Correction, Manhattan District Attorney Alvin Bragg’s office, and the New York Police Department (NYPD) to inquire about whether there were plans to honor ICE’s detainer against Posada-Hernandez. The Department of Corrections responded, but did not directly answer any of Fox News Digital’s questions, instead pointing Fox News Digital to the publicly available information located on its “Person in Custody Lookup” database.
Questions about Posada-Hernandez’s charges and future court dates were also left unanswered.

According to NYC’s custody database, reviewed by Fox News Digital, Posada-Hernandez was given a $100,000 bail following his arrest on Wednesday for First Degree Assault, a Class B Felony. However, other public reports have indicated that he was charged with attempted murder.

Cell-phone footage from the younger male victim involved in the Wednesday incident surfaced following the subway attack this week, which showed Posada-Hernandez walking calmly away after allegedly pushing him.
A passerby could be seen in the video trying to help the younger victim after he was first pushed. Then, Posada-Hernandez proceeded to spontaneously shove the older Williams onto the tracks as well. The younger victim suffered minor injuries, but Williams is reportedly in critical condition in the hospital.
While it is unclear when Posada-Herandez returned to the United States after his fourth deportation in July 2020, what is known is that, under President Joe Biden, 5% of the entire population of Honduras entered the United States, according to the Department of Homeland Security.

NEW YORK (PIX11) — Family members are speaking out after two men were pushed onto subway tracks in Manhattan in what police say was an unprovoked attack that left one victim critically injured.
Police say 34-year-old Bairon Hernandez was taken into custody Tuesday and charged with attempted murder in connection with the incident at the 63rd Street and Lexington Avenue subway station on Sunday.

Hernandez, a homeless man originally from Honduras, denied when questioned by PIX11’s Anthony DiLorenzo, to pushing the victims onto the tracks.
Video from the scene shows the first victim, identified as John Rodriguez, on the tracks shortly after the incident. Footage appears to show the suspect, wearing a red hooded sweatshirt, pacing on the platform moments after.
Investigators say a second victim, 83-year-old Richard Williams, was also pushed onto the tracks shortly afterward.
“He wasn’t in his right mind to do what he did, and I think it’s great that they arrested him because that way he won’t hurt anyone else,” Claudia Peña said.Rodriguez’s mother said he helped save the elderly man before a train arrived. Claudia Peña said her 31-year-old son didn’t hesitate to help.
“What he did was go to the man and try to lift him up to get him onto the platform so they could help him because the man was in really bad shape,” Peña said.

The 31-year-old returned to the hospital on Tuesday, still shaken by the ordeal, Peña said. “He’s still traumatized by the incident with the other man. He was so worried,” she said.
Williams, an Air Force veteran, remains hospitalized and is on a ventilator, according to his daughter.“He sustained significant head injuries. He’s on a respirator right now. He’s not awake. He’s not responding,” Debbie Williams said. “We’re praying for a miracle.”
Williams said her father, a Roosevelt Island resident, had been running errands in Manhattan when the attack occurred.
“[Hernandez] had to use significant force because my father’s not stupid enough to stand in front of the [yellow] line,” she said, adding that she believes the suspect “should get the death penalty.”
Capital punishment is not legal in New York state court. Police sources say Hernandez has no prior arrest history in New York.
