    More evidence of guestworker visa fraud

    We've complained elsewhere that dirty tricks are played by people who want to place foreign workers here and displace Americans to do it.
    Bodyshops have a reputation for puffing up resumes to outshine any
    likely American candidate. Here's an example:

    My friend is working in Michigan. He graduated from college just not too long ago and was offered a job at a consultant company. He took
    the training which the company claims to be $8,000 worth and signed a
    paper saying he will pay that training fee but the company will
    reimburse it after he works for 1 year for the company. Then comes
    the tricky part. When he was recruited, he was told that they will
    place him after the training. But after his training is complete, the
    company asks him to make up a resume saying he has 6 years of
    experience and start taking client calls and lie to them. He doesn't
    feel right about that and starts looking for other jobs. Now he got
    an offer from a company in CA who is willing to sponsor his H1
    process. He wants to get out of the contract and not paying the
    $8,000. Is there anyway he can get out because the company asks him
    to make fake resume? Can he sue the company for that?

    I also suspect that they recruit Americans in IT who have been thrown out of work for information purposes. When a bodyshop recruits an American citizen they will string him along and then drop him once they have questioned the American about his resume. I am pretty sure that they "cut and past" portions of the American's resume into a resume being submitted by a foreigner in hopes that the company that laid off the American will hire the foreigner because he has the "same experience" for less money. There seems to be fraud going on all up and down the chain of command.

    I will say this, at least the "friend" seems to have some morals not wanting to commit fraud. I know, he also does not want to pay the 8 grand lol. That being said, I wish we could find out what company they are talking about.

    It's still up there as of 9:46am PT. Apparently, we work harder than they do.

    In fact, there was another short paragraph that was below the one Betsy included in the OP - here 'tis:

    I would really hope someone can help with this, he is not an US citizen and is on OPT right now. He tells me that what the company says about the placing is different than what he heard during his recruitment. I am thinking about calling a lawyer for him but don't want get things too complicated. Any suggestions will be appreciated, thanks all.

    It almost sounds like he was working before being sponsored under H1-b status...(?) We know he is not a citizen, unlikely to have a green card (resident alien), so what is his status exactly? Legal to work???

    cayla: Yeah, I see your point. I think the unasked question, though, is - if he stood to gain 8k by going along with the headhunting firm's immoral or unethical behavior, would he be looking for the lawyer as intensively as he might be now...(?)
    I think we know that answer even before the question is asked...

    There are companies like this all over, bringing foreign workers in by the planeload. Sometimes they are little shell companies who file for H-1Bs but with no real jobs for them. Sometimes they're the big players like TCS, Wipro, etc., who have sometimes played games with overtime or tax refunds. Some foreigners use these companies as stepping stones to get here, then either go legit with another company (now that H-1Bs are portable) or disappear and overstay. And, sometimes the resumes are inflated before they ever arrive. There are many different verses to this song, but they all mean leaving American talent out in the cold.

    If people from a specific country are found to be dealing with H-1B's in a Illegal manor or a country has a large set number of Visa overstays that country should be BANNED from the H-1B program and the US companies involved should also be banned from hiring H-1B's. IMO

    They seem to be able to do as they please at present with a wink & nod from our government !! Some deterent needs to be put into place !
