    A Novel Strategy to Control Illegal Immigrantion?

    Asset Forfeiture.

    While many in civil service and the public sector agree that illegal immigration is weakening society, the problem seems almost insurmountable. Overwhelmed by numbers, how might our country protect itself from increasing momentum of illegal entry into the United States?

    It seems that most Mexican nationals come to the United States, either legally or illegally, for financial gain. And living in Denver, Colorado one can see their success at achieving this very goal. Cars, trucks, cell phones, even homes are assets acquired by illegal Mexican nationals. Reducing their chance for successfully acquiring illegal wealth is one strategy I have yet to see suggested.

    Seize all assets of anyone found to be in the United States illegally. All assets: cash, cars, appliances, TV’s, even homes. In 1984, Congress rewrote civil forfeiture laws to allow for seizing assets that represent proceeds of illegal federal crimes.

    At least two federal programs already exist for asset forfeiture, one administered by the department of justice, the second by the treasury department.

    “The Department of Justice Asset Forfeiture Program encompasses the seizure and forfeiture of assets that represent the proceeds of, or were used to facilitate federal crimes.� This is taken from the Department of Justice Asset Forfeiture Program website:

    An even more valuable program is that of the Asset Forfeiture and Treasury Forfeiture program run by the U.S. treasury department. This program specifically lists eligible federal agencies of: U.S. Immigration and Customs Enforcement (U.S. ICE), Department of Homeland Security; and U.S. Customs and Border Protection (U.S. CBP).     If local law enforcement agencies began seizing assets of illegal aliens, from whatever country of origin, they could auction off the assets to fund further enforcement. As those who are in the country illegally travel back across the borders, U.S. border agents can seize their assets at the border preventing these illegally obtained proceeds from leaving the country. If asset forfeiture is guaranteed when caught in the country illegally, it seems reasonable the financial motivation driving so many people across the border will vanish. These programs already exist, please encourage and inform your local politicians of their existance. Call or email your radio station talk shows and encourage public debate of these laws.

    I love the idea of seizing assets of anyone in the country illegally. The auction could actually cover jail/deportation costs and maybe put anything left over into state coffers instead of taking out for a change.

    Coloradoan, you should see down here in Fla. Step # 1 Buy a new car or especially mini-vans. Step #2 Shop until the cows come home. I think they only leave the stores and malls for a bite to eat and a nap.

    No wonder GWB likes them. This is all insane. Well of course, they don't have a HUGE chunk of their paycheck going to health insurance. They don't seem to need car insurance. They go to the hospital for a common cold and then leave the bill behind for someone with health insurance to be overcharged and to make up for it. It's really neat to be an illegal.
    I'm beginning to consider becoming one myself.

    We may have to. Maybe it's become "survival of the fittest" under GWB.
    It sure is beginning to look that way.

    Great idea!! I support it 100%. Fits in nicely with some thoughts others have had concerning "confiscation" using the RICO law of organized networks sponsoring and promoting illegal immigration.

    Love your post LegalUSCitizen. I could only add and "no taxes". Wouldn't we all be able to pay some more bills or buy new stuff if we didn't pay taxes.

    It really is neat being an illegal in America, no wonder they're pouring in.

    Very sensible post!

    This is known as the RICO act if anyone cares to read moreparticulars. I have seen it in action against a cop turned drug dealer who owned a summer house/trailer behind a store I used to own in NC once.

    I don't know what happens to the creditors who loan money against these "things" and I don't know if I even care if they get stiffed. It would serve them right for selling stuff to people who are here illegally.

    And, having said that, I have to add this: Recently the car commericals here are adding a line at the end: "Subject to residency status restrictions." Gee, are they wising up?

    Let's face it, if a person is here illegally making enough money to buy up all this "stuff" they are most likely doing something illegal, other than living here, to obtain it. That in itself ought to be a tipoff to the cops. But in my area they don't follow up on those type of leads, as I've found out.

    I have seen reference to the RICO Act in reference to illegal immigrants prior to this on other boards and perhaps even in the past on this board. It is, indeed, a great idea.

    Welcome Colorado! I like your ideas. I wonder if US Attorney General Alberto Gonzales would agree. Probably not. Immigration is such a personal issue for him since he is probably an ANCHOR BABY HIMSELF.
