    Federal-Aid Highway Program.
    CBO estimates that H.R. 3 provides $209.8 billion in contract authority, a form of mandatory budget authority, for the Federal-Aid Highway program over the 2005-2009 period. H.R. 3 also rescinds $8.5 billion in unobligated balances of contract authority on the last day of fiscal year 2009; however, because the highway program historically carries large balances of unobligated contract authority, CBO expects that all of the rescinded funds will have been provided by earlier authorization laws.
    The $209.8 billion of contract authority provided by H.R. 3 over the 2005-2009 period includes $160.6 billion of contract authority specified in the act, an estimated $40.9 billion of contract authority from the Equity Bonus program authorized in the act, and an estimated $8.3 billion of contract authority from provisions known as Revenue-Aligned Budget Authority (RABA). (Also, as noted earlier, about $36 billion of the total was previously provided for 2005 in several short-term extensions of the surface transportation programs.)

    The Equity Bonus program provides additional contract authority to ensure that the amount of contract authority distributed to each state meets two criteria.
    First, each state's share of the total level of contract authority must be at least a specified percentage of that state's share of tax receipts to the Highway Trust Fund.
    Those percentages are set in the act and increase from 90.5 percent in 2005 to 92 percent in 2009.
    Second, the amount of contract authority distributed to each state must be at least a specified percentage of the average level of contract authority provided to the state under the previous surface transportation authorization law, the Transportation Equity Act for the 21st Century (TEA-21). Those percentages are also set in the act, increasing from 117 percent in 2005 to 121 percent in 2009. CBO's estimate of contract authority from the Equity Bonus program is based on information from the FHWA.

    The Senate Committee on Environment and Public Works met to consider the Safe, Accountable, Flexible, and Efficient Transportation Equity Act of 2005 on March 16, 2005. During consideration of the measure, the following amendment was agreed to by a voice vote: an amendment offered by Senator Clinton to rename a portion of Interstate route 86 near Corning, NY, after former Congressman Amo Houghton. Disgareed to by a voice vote: an amendment offered by Senator Lautenberg regarding contributions to political campaigns. Disagreed to by roll call vote: an amendment offered by Senator Clinton, as amended by a second-degree amendment by Senator Lieberman, to increase the minimum amount a State's funding can grow to 15% if the overall contract authority in the bill is greater than $189,871,080,648 by a vote of 5 ayes, 13 nays.
    Voting against the amendment were Senators Inhofe, Baucus, Bond, Boxer, Chafee, DeMint, Isakson, Jeffords, Murkowski, Thune, Vitter, Voinovich, and Warner.

    REGULATORY IMPACT STATEMENT

    In compliance with section 11(b) of rule XXVI of the Standing Rules of the Senate, the committee makes the following evaluation of the regulatory impact of the reported bill. The regulatory impact of the reported bill is expected to be minimal. This will not have any effect on the personal privacy of individuals. Other than current regulations and those regulations affecting the eligibility and use of funds provided in this bill, the provisions having a regulatory impact of significance are sections 1408, 1513, 1514, 1615, 1618, and 1619. Section 1408 directs the Secretary to promulgate regulations requiring workers near a Federal-aid highway to wear high-visibility clothing, and to require any other worker-safety measures that the Secretary deems necessary to minimize worker injuries and maintain the free flow of vehicular traffic. Section 1513 establishes a pilot program for not more than five States to assume the Secretary's responsibility for environmental review for a project. A State wishing to participate in the pilot must submit a detailed application. This section includes minimum application requirements and a directive to the Secretary to promulgate, within 270 days of enactment, regulations establishing complete application requirements consistent with the section. Section 1514 directs the Secretary of Transportation to promulgate, within 1 year of enactment, regulations necessary to implement the transportation planning provisions in sections 1501-5 and the project delivery provisions in sections 1511-13. These provisions call for enhanced consideration of environmental concerns during the planning process and establish a process for completing the environmental review process faster and more efficiently. Section 1615 directs the Secretary of Transportation promulgate regulations, within 18 months, adjusting the application of the latest travel models. The new regulations must ensure that travel models can account for the effects of the most recent population, economic, employment, travel, transit ridership, congestion, and induced travel demand. Section 1618 directs the Administrator of the EPA to promulgate proposed regulations by March 1, 2005 and final regulations within 1 year, governing the handling of air quality monitoring data influenced by exceptional events. These regulations will allow Governors to petition EPA to exclude air quality data directly due to exceptional events such as forest fires or volcanic eruptions.

    MANDATES ASSESSMENT

    In compliance with the Unfunded Mandates Reform Act of 1995 (Public Law 104-4), the committee finds that S. 1072 would impose no Federal intergovernmental unfunded mandates on State, local, or tribal governments. All of its governmental directives are imposed on Federal agencies. The bill does not directly impose any private sector mandates.

    Notes...since about 2002 the states training programs have been geared to construction worker training...NJ about 100,000 jobs for unemployed,underemployed,women and minorities...somehow it wouldn't suprise me if illegal aliens were also in these programs..I would bet if you check your state page and look you'll find out that it's the same in each state...

    Security and Prosperity Partnership of North America Initial Results In the 90 days since the launch of the Security and Prosperity Partnership on March 23, 2005, a number of collaborative initiatives have been completed to advance the prosperity and security agendas: Prosperity • Electronic Commerce . In June 2005, our three countries signed a Framework of Common Principles for Electronic Commerce that will encourage the development of trans-border online business in North America . The Framework addresses the respective roles of government and the private sector, promoting transparency and security, and facilitating the acceleration of ICT use by eliminating barriers to e-commerce in cross-border transactions. • Liberalization of Rules of Origin . We have completed the implementation of modifications of rules of origin, covering goods such as household appliances, precious metals, and various machinery and equipment parts. Liberalizing rules of origin reduces administrative burdens by making it easier for exporters to qualify for duty-free treatment under NAFTA. These changes will affect US$20 billion of annual trilateral trade. • Consumer Products . Canada and the United States signed a Memorandum of Understanding to enhance and strengthen the exchange of information and cooperative activities on public health and safety protection related to the safety of consumer products, and encourage compatibility of standards-related measures to the greatest extent practicable. Likewise, Mexico and the United States are holding negotiations to reach agreement on a similar Memorandum of Understanding. • Textiles and Apparel Labelling . We have reached an arrangement on the Use of Care Symbols on Textile and Apparel Goods Labels that will facilitate market access of textile and apparel goods by the uniform acceptance of harmonized care symbols in North America. We plan to sign this arrangement in July.
    Temporary Work Entry . The three countries have forwarded a trilateral document setting out each country's domestic procedures to modify NAFTA's temporary entry appendix on professionals to the NAFTA Free Trade Commission for approval.     Security • NTC-NRAC Exchange. The United States and Canada have agreed to exchange officers between their two respective targeting facilities, the National Targeting Center (NTC) in the United States and the National Risk Assessment Centre (NRAC) in Canada.

    Public Safety along the U.S.-Mexico Border. The United States and Mexico recently agreed to, over the course of three weeks, identify and target key procedures and guidelines to establish a standardized Alien Smuggler Prosecutions Program along the Southwest border, built upon previous U.S. – Mexico efforts in the Guide Identification Prosecution Program (GIPP), a collaborative effort between CBP and Mexico's Attorney General Office--Procuraduria General de la Republica (PGR) - to identify and prosecute local guides and alien smugglers who endanger the lives of migrants.

    Preclearance Site. We have identified the site for the second Canada-U.S. land preclearance pilot: at the Thousand Islands Bridge, all Canadian border operations would be re-located from Lansdowne, Ontario to Alexandria Bay, New York

    Bush Administration Erases U.S. Borders With Mexico and Canada

    As I have documented below, the SPP “working groups” organized within the U.S. Department of Transportation are signing trilateral memoranda of understanding and other agreements with Mexico and Canada designed to accomplish the open borders goal incrementally, below the radar of mainstream media attention, thereby avoiding public scrutiny. Congress is largely unaware that SPP exists, let alone knowledgeable about the extensive work being done behind the scenes by the executive branch to advance the agenda articulated by the Council on Foreign Relations (CFR) to establish a North American Union as a new regional super-government by 2010.Evidently using this quasi-press release as legal justification, the U.S. Department of Commerce (DOC) has proceeded to organize extensive “working groups,” drawing freely from the executive branch. These SPP working groups are housed under the auspices of the SPP program in the NAFTA office, as directed by Geri Word, a DOC administrator. The June 2005 SPP “Report to Leaders” makes clear the extensive implementing work already undertaken:Also found in the June 2005 “Report to Leaders” is that the SPP working groups organized in DOC are reporting to three U.S. cabinet secretaries: Secretary of Commerce Carlos Gutierrez, Secretary of Homeland Security Michael Chertoff, and Secretary of State Condoleezza Rice. Comparable cabinet-level working groups are referenced to government websites in Canada and in Mexico.

    More than 20 working groups are identified in the June 2005 “Report to Leaders” and decisions have been made to open U.S. borders and skies to virtually unlimited “migration” and trade from Canada and Mexico.Regarding “open skies,” three working groups are working on aviation issues, groups designated as “Aviation Safety,” “Airspace Capacity,” and “Harmonized Air Navigation Systems.” I am told that a tri-lateral agreement to create a North American Wide Area Augmentation System (WAAS) was signed in 2005,None of the referenced agreements are found on the SPP website. Yet, the working groups on aviation appear to have already accomplished opening U.S. skies to free and unrestricted navigation by Mexican and Canadian aircraft. It could be concluded that aviation authorities in Mexico and Canada have been given the tools to identify the location of all aircraft flying over the United States at any time, including military aircraft. I found no discussion on the SPP website that establishes the SPP aviation working groups were acting within specific authority granted by Congress, or even that the SPP aviation working groups were reporting to Congress.
