    Obama again delays E-Verify requirement

    Yet another example of why we cannot agree to any form of amnesty. The Obama administration obviously has no intention of ending illegal immigration and protecting American workers.

    The Obama administration is again delaying implementation of a rule that would require government contractors to verify the immigration status of their employees.

    Contractors won’t have to use the Homeland Security Department’s E-Verify system until June 30, according to a Federal Register notice published Friday.

    The additional time is needed to complete an administration review of the rule, which is also the subject of a federal lawsuit, the notice said.

    This is the third delay in the implementation of the requirement, originally scheduled to take effect Jan. 15. First, the U.S. District Court for Maryland delayed the implementation until Feb. 20. Then in January, the Obama administration announced the rule would not take effect until May 21 pending its internal review.

    Plaintiffs in the court case, which includes the U.S. Chamber of Commerce, argue the rule violates the law by requiring government contractors to use a system that is voluntary for other employers. In creating E-Verify, Congress said the White House couldn’t mandate its use.

    Plaintiffs also claim the rule is too vague and will force contractors to verify all employees to avoid potential suspension and debarment, which would be a financial hardship. The companies also could be vulnerable to lawsuits by employees who believe they’ve been discriminated against because of the screening.

    I guess this will give illegal aliens plenty of time to get over the border and snatch up all of these stimulus jobs Obama promised.

    Populist, it's a delaying tactic. This guy is so oblivious to the plight of the poorest Americans and so focused on the prospective votes of legal illegals that he'll keep delaying the one thing which can immediately open up jobs for Americans.

    Obama Discusses Amnesty in Mexico, Delays E-Verify Rule in United States

    Last week, President Obama boarded Air Force One and flew to Mexico to discuss several policy issues with Mexican President Felipe Calderon. During a Calderon-Obama press conference, President Obama addressed the issue of immigration. According to The Christian Science Monitor, Obama restated his pledge to pass an amnesty bill this year. (The Christian Science Monitor, April 16, 2009). In addressing the drug cartel violence, the President said his administration was accelerating efforts to implement the Bush-era Merida Initiative to "provide Mexico with the military aircraft and inspection equipment they need when they need it." (Chicago Sun-Times, Obama-Calderon Press Transcript- April 16, 2009). President Obama's statements at the press conference indicated that his Administration's border security efforts were aimed at preventing the shipment of guns to Mexico rather than securing the border to prevent illegal immigration.

    While Obama was in Mexico discussing amnesty, his administration announced its decision to delay a rule that would require most federal contractors to use E-Verify to help ensure that their employees are legally authorized to work in the United States. (HR.BLR.com, April 17, 2009). This was not the first time the implementation of this rule has been delayed. Originally, this rule was set to take effect on January 15, 2009. However, the Bush Administration caved to a coalition of special interest groups who sued to prevent the rule from taking effect, and delayed the rule's implementation until February 20, 2009. (See FAIR's Legislative Update, January 12, 2009). On January 29, Homeland Security Secretary Janet Napolitano announced that the Obama Administration would delay the rule's implementation further - until May 21, 2009 - to give itself "an adequate opportunity to review the rule." (The Washington Post, January 30, 2009).

    The most recent delay postpones the final rule's implementation another six weeks, to June 30, 2009. In announcing this latest move, the Department of Homeland Security stated the delay is needed to give DHS "adequate opportunity to review the rule" - the identical justification the Obama Administration provided for delaying the rule in January. House Judiciary Ranking Member Lamar Smith (R-TX) criticized the announcement: "Delaying implementation of this rule again insults citizen and legal immigrant workers. The purpose of the rule is to ensure that individuals working for or contracting with the federal government employ legal U.S. workers, not illegal foreign workers."     E-Verify federal contractor rule delayed again, now on hold until June 30, 2009

    The implementation of a rule amending the Federal Acquisition Regulation (FAR) to require that certain federal contractors and subcontractors use the federal government's E-Verify program has been suspended until June 30, 2009, according to a notice of delay published in the Federal Register on April 17, 2009. The notice of delay can be found at: http://edocket.access.gpo.gov/
    2009/pdf/E9-8849.pdf. On or after June 30, however, contracting officers must include the new E-Verify clause in affected contracts. In addition, contracting officers should modify, on a bilateral basis, existing contracts to include the clause on or after that date.

    This is not the first time the rule has been suspended. The rule, was scheduled to take effect January 15, but the Department of Homeland Security (DHS) delayed implementation until February 20 (and changed its effective date to January 19) after the US Chamber of Commerce, among other business groups, filed suit challenging the legality of the rule (Chamber of Commerce v Chertoff, DMd, No 8:08-cv-03444-AW), i.e., while the lawsuit is pending. Then implementation was delayed until May 21 "in order to permit the [Obama] [A]dministration an adequate opportunity to review the rule," according to a notice published in the January 30 Federal Register. On January 20, President Barack Obama's Chief of Staff, Rahm Emanuel, issued a memorandum stating that executive departments and agencies should "[c]onsider extendin g for 60 days the effective date of regulations that have been published in the Federal Register but not yet taken effect." The Chamber of Commerce requested that the federal government postpone the rule in compliance with the memorandum. The Department of Justice filed papers notifying the district court of these developments and of its intention to stay the proceeding during the Obama Administration's review of the rule, according to the Chamber. The Obama Administration has not yet issued a position on the rule.

    E-Verify, administered by the Department of Homeland Security's (DHS) Citizenship and Immigration Services (USCIS) bureau in partnership with the Social Security Administration, is a voluntary, web-based program that allows employers to verify that their employees are authorized to work in the United States.

    E-Verify is voluntary for private employers. Over 100,000 employers participate in the program.
