    As stronger sentiment concerning gun control mounts on the American streets, Glenn Beck invited renown historian and Wallbuilders founder David Barton on his Tuesday evening program to provide viewers with a comprehensive overview of the Second Amendment as a foundation for liberty and freedom.Beck was compelled to provide this in-depth look after 19 potential executive actions were identified to move the Obama administration forward with new gun control measures.

    Those measures include but are not limited to: requiring mental health screenings of both the buyer and seller; banning military-style “assault” weapons and high-capacity magazines; issuing a statute prohibiting gun trafficking; and an “end” to the “hobbling of federal agencies.”
    “This is not about preventing mass-murders it is about eliminating your right to bear arms,” Beck slammed. “This administration will never waste a good emergency.” “Americans need to know where the Second Amendment even comes from…The history of our ‘why and how,’ and how it has shaped our foundation of freedom.”A glance back in time

    Barton, whose knowledge-base in American history is by many considered second to none, said that the Second Amendment is truly about a “certain set of principles.” He added that people should not separate the Second Amendment from other amendments, particularly the first five, as they are all aligned and part of one larger concept of protection of one’s self, religion and property. In other words ”unalienable rights.”
    The Founding Fathers, according to Barton, believed that God gave these rights to mankind and that no government could take them away.

    “That is why our government is different,” he explained, “other world governments trampled peoples rights… the idea was to prevent the government from ever trampling our rights.” He added that unlike any country in Europe, Americans insisted the government could not touch what God had given them.The Founders also used the philosophy term “laws of nature and nature is God,” which Barton informed is contained in Blackstone’s commentary on the law. The idea is that certain things come to one from nature, such as the deep-seated biological mechanism of self-defense. The historian also noted that James Wilson, a signer of both the Constitution and Declaration of Independence noted that the law of nature is to defend oneself, and that — through the castle doctrine — a private citizen failing to defend his home or family — even with deadly force — would be considered negligence.As the interview continued, Barton went on to explain how different the times were at America’s founding, and that citizens could even penalized for not carrying a gun. The topic then veered to the lawless days of the Wild West, its religious revival and the role of Texas Rangers in enforcing the law. In addition, Barton addressed the founding of the NRA. While some like to demonize pro-Second Amendment group and even call it prejudiced, it turns out the powerful group was in fact started by two Union generals in 1871 as a means to driving out the Ku Klux Klan and ensuring that blacks, who although then-free were not allowed means with which to defend themselves — could in fact legally own a gun.Barton also noted that even after the Whiskey and Shays rebellions, and even the assassinations of Lincoln Garfield and McKinley, calls for gun bans never came into play. In fact, the times even bolstered the Second Amendment.It was not until the aftermath of Malcolm X, John F. Kennedy, Robert Kennedy and Martin Luther King’s assassination that Lyndon B. Johnson sought stricter gun control. Ironically, President Reagan — although having survived an assassination attempt — was very much an adherent to the Second Amendment himself.When asked how American citizens should react if government were to seek to claim their arms, Barton said that there is a host of lawyers working bro-bono to step in and help protect citizens’ gun rights.

    NRA: If Anyone Is 'Ginning Up Fear' About Guns, It's President Obama


    National Rifle Association president David Keene reacted harshly Tuesday to President Obama's assertion that gun control opponents have a "pretty effective way of ginning up fear" in garnering support for its cause.

    In fact, in an interview with WMAL's Mornings On The Mall program, Keene turned the question of 'fear' back on Mr. Obama.

    "The reason gun sales are up is because people do fear that the President is going to take away their right to purchase legitimate firearms in the future, so if anyone's 'ginning up fear' - if anybody's exaggerating the 'danger' posed by legitimate firearms owners - it's the President of the United States and his Vice President, not us," said Keene.

    Keene told WMAL that, despite assertions to the contrary, the White House has offered little more than lip service to the NRA in looking for common ground, and that an Association representative was not given a chance to contribute at the gun summit chaired by Vice President Joe Biden last week.

    House Bill Would Ban All Internet Ammunition Sales

    In their latest rush to further emasculate the Second Amendment, many on the Left are taking aim at the Internet.

    Of course, illegal online sales of weapons and ammunition should be stopped--though the practice isn’t nearly as prevalent as the left would have you believe.
    But progressives are also looking to ban legal online sales through a bevy of new gun control resolutions, including H.R. 142, which "would ban Internet or mail order ammunition purchases."
    Meanwhile, the state of New York just passed a ban on Internet “assault weapon” sales.
    Progressives act as though the move to end all online weapons transactions is just that simple--wave a gavel, pass a law, and it’s done. Just like with guns themselves--declare a gun-free school zone, and all schools will be gun-free.
    But they are not always such regulatory optimists.
    Remember SOPA-PIPA? The Stop Online Piracy Act and the Protect Intellectual Property Act--the bills that ham-handedly sought to rein in rampant online property theft-for-profit. Stolen music and movies being sold on the Web is a costs the creators of these works billions of dollars each year, and these vastly overreaching bills were an attempt to address it.
    I was opposed to the bills - they went far too far. But I remain an ardent supporter of the premise behind them--the protection of private property.
    Progressives also opposed SOPA and PIPA; their reasoning, based on the claim that such laws were irrelevant as they would ultimately fail to stop online piracy--when juxtaposed with their confident intent to block online weapons sales--induces whiplash.But they’re at least against the thieves themselves, right? Not quite, unless it's a competitor who is allegedly stealing from them.
    The left asserts we can’t do anything to stop illegal online theft, but that we can unilaterally and completely stop legal online weapons sales.
    In this case, it’s not a technological question--it’s an ideological one. They bizarrely defend the actions of internet pirates, but not those adhering to the protections of the Second Amendment.
    So they will claim impotence on the former, while doing whatever it takes to impinge the latter--including assuming vast new authority over the Internet.

    Experts: NY Gun Law Could Deter Mentally Ill from Seeking Treatment

    Mental health experts say that New York's new gun control law may prevent the effective treatment of potentially dangerous individuals and even discourage them from seeking assistance.

    The new legislation features a requirement that therapists, doctors, nurses, and social workers inform government authorities if the provider believes a patient is likely to harm himself or others. A report of this kind could lead to rescinding the patient’s gun permit and the confiscation of any guns owned by the patient.
    Dr. Steven Dubovsky, chairman of the psychiatry department at the University of Buffalo, called the new requirement meaningless. “It’s pure political posturing,” and a deceptive attempt to reassure the public, he said.
    Dubovsky said that the new law seems to turn mental health professionals into law enforcement officers, and that it cannot be taken seriously because therapists will not be held liable if they do not report a patient they believe is harmful. Consequently, Dubovsky thinks most therapists will ignore the law and continue to manage potentially harmful patients as they do now.
    He added that “no patient is going to tell you anything if they think you’re going to report them.”
    Dr. Paul Appelbaum, Director of Law, Ethics, and Psychiatry at Columbia University, said that the new measure could cause patients to refrain from revealing thoughts of hostility or harm, or even from seeking treatment altogether.
    “The people who argue most need to be in treatment and most need to feel free to talk about these disturbing impulses, may be the ones we make least likely to do so,” Appelbaum said. “They will either simply not come, or not report the thoughts that they have.”
    Appelbaum added, “If people with suicidal or homicidal impulses avoid treatment for fear of being reported in this way, they may be more likely to act on those impulses.”
    Under the Tarasoff ruling of the 1970’s, mental health professionals have a duty to warn potential victims of a patient. According to Appelbaum, this can be accomplished in several ways: 1) the patient can be committed to an institution, voluntarily or not; 2) the patient’s medication can be changed to reduce the risk of danger; 3) the intended victim of the patient can be warned.
    Appelbaum added that the patient’s family can be asked to lock up any guns in the home, or monitor the patient to determine if he or she is behaving in such a way that could make violence more likely, like drinking or refusing to take medication. In such cases, the family can contact the patient’s mental health professional.
    Appelbaum explained that the current way of managing potentially harmful patients is flexible and does not, in all cases, breach confidentiality. He said that the new law, however, requires that the patient be reported to mental health authorities.
    “It undercuts the clinical approach to treating these impulses, and instead turns it into a public safety issue,” Appelbaum stated.
    Appelbaum also observed that in many shooting massacres in the past, the gunman had not been under treatment, and would not have been deterred under the new law.

    Linn County Oregon Sheriff Tim Mueller cut right to the chase in an open letter to Vice President Biden on January 14: "Any federal regulation enacted by Congress or executive order...offending the constitutional rights of my citizens will not be enforced by me or my deputies."

    Elsewhere in the letter, Mueller touched on the key problem American citizens are now facing, as gun-grabbers use the crimes of a few to justify taking away the liberties of many:
    We are Americans. We must not allow, nor will we tolerate, the actions of criminals, no matter how heinous the crimes, to prompt politicians to enact laws that will infringe upon the
    liberties of responsible citizens who have broken no laws.
    Muller closed his letter thus: "In summary, it is the position of this Sheriff that I refuse to participate, or stand idly by, while my citizens are turned into criminals due to the unconstitutional actions of misguided politicians."
    Ladies and Gentlemen, we've found another patriot. And his name is Sheriff Tim Mueller.

    Here Are the 23 ‘Executive Actions’ Obama Will Be Taking on Guns

    Below is a list of the 23 “executive actions” that the president will be taking in the wake of the Sandy Hook massacre. Via the Wall Street Journal.
    “There’s very little in this part that will be too big or controversial,” claims Business Insider. “It’s very small bore regulatory stuff.”
    We’ll let you decide:
    1. Issue a Presidential Memorandum to require federal agencies to make relevant data available to the federal background check system.
    2. Address unnecessary legal barriers, particularly relating to the Health Insurance Portability and Accountability Act, that may prevent states from making information available to the background check system.
    3. Improve incentives for states to share information with the background check system.
    4. Direct the Attorney General to review categories of individuals prohibited from having a gun to make sure dangerous people are not slipping through the cracks.
    5. Propose rulemaking to give law enforcement the ability to run a full background check on an individual before returning a seized gun.
    6. Publish a letter from ATF to federally licensed gun dealers providing guidance on how to run background checks for private sellers.
    7. Launch a national safe and responsible gun ownership campaign.
    8. Review safety standards for gun locks and gun safes (Consumer Product Safety Commission).
    9. Issue a Presidential Memorandum to require federal law enforcement to trace guns recovered in criminal investigations.
    10. Release a DOJ report analyzing information on lost and stolen guns and make it widely available to law enforcement.

    11. Nominate an ATF director.
    12. Provide law enforcement, first responders, and school officials with proper training for active shooter situations.
    13. Maximize enforcement efforts to prevent gun violence and prosecute gun crime.
    14. Issue a Presidential Memorandum directing the Centers for Disease Control to research the causes and prevention of gun violence.
    15. Direct the Attorney General to issue a report on the availability and most effective use of new gun safety technologies and challenge the private sector to develop innovative technologies.
    16. Clarify that the Affordable Care Act does not prohibit doctors asking their patients about guns in their homes.
    17. Release a letter to health-care providers clarifying that no federal law prohibits them from reporting threats of violence to law-enforcement authorities.
    18. Provide incentives for schools to hire school resource officers.
    19. Develop model emergency-response plans for schools, houses of worship and institutions of higher education.
    20. Release a letter to state health officials clarifying the scope of mental-health services that Medicaid plans must cover.
    21. Finalize regulations clarifying essential health benefits and parity requirements within ACA exchanges.
    22. Commit to finalizing mental-health-parity regulations.
    23. Launch a national dialogue led by Secretaries Sebelius and Duncan on mental health.
