Referred to: A BILL TO BE ENTITLED 1 AN ACT TO ESTABLISH THE NORTH CAROLINA ILLEGAL IMMIGRATION 2 PREVENTION ACT TO PROVIDE FOR THE COMPREHENSIVE REGULATION OF 3 PERSONS IN THIS STATE WHO ARE NOT LAWFULLY PRESENT IN THE UNITED 4 STATES. 5 The General Assembly of North Carolina enacts: 6 7 PART I. SHORT TITLE 8 9 SECTION 1. This act shall be known and may be cited as the "North Carolina 10 Illegal Immigration Prevention Act." All requirements of this act concerning immigration or the 11 classification of immigration status shall be construed in conformity with federal immigration 12 law. 13 14 PART II. REQUIRE COUNTIES AND CITIES TO USE THE FEDERAL WORK 15 AUTHORIZATION PROGRAM TO VERIFY THE WORK AUTHORIZATION OF 16 NEW EMPLOYEES 17 18 SECTION 2.(a) Article 5 of Chapter 153A of the General Statutes is amended by 19 adding a new section to read: 20 "§ 153A-94.3. County verification of employee work authorization. 21 (a) Each county shall register and participate, or attempt to register and participate, in 22 the federal work authorization program to verify work authorization information of all new 23 employees. 24 (b) As used in this section, the term 'federal work authorization program' means any of 25 the electronic verification of work authorization programs operated by the United States 26 Department of Homeland Security or any equivalent federal work authorization program 27 operated by the United States Department of Homeland Security to verify information of newly 28 hired employees, pursuant to the Immigration Reform and Control Act of 1986 (IRCA), Public 29 Law 99-603. 30 (c) This section shall be enforced without regard to race, religion, gender, ethnicity, or 31 national origin." 32 SECTION 2.(b) Article 7 of Chapter 160A of the General Statutes is amended by 33 adding a new section to read: 34 "§ 160A-164.3. REQUIRE PUBLIC CONTRACTORS TO USE THE FEDERAL WORK 13 AUTHORIZATION PROGRAM 14 15 SECTION 3.(a) Chapter 64 of the General Statutes is amended by adding a new 16 Article to read: 17 "Article 1. 18 "Various Provisions Relating to Aliens." 19 SECTION 3.(b) G.S. 64-1 through G.S. 64-5 are recodified as Article 1 of 20 Chapter 64 of the General Statutes, as created by this section. 21 SECTION 3.(c) Chapter 64 of the General Statutes is amended by adding a new 22 Article to read: 23 "Article 2. 24 "Unauthorized Aliens and Public Contracts. 25 "§ 64-10. Definitions. 26 The following definitions apply in this Article: 27 (1) End product. – Movable personal property described in the solicitation and 28 in final form and ready for the use intended including, without limitation, 29 commodities or equipment. 30 (2) Federal work authorization program. – Any of the electronic verification of 31 work authorization programs operated by the United States Department of 32 Homeland Security or any equivalent federal work authorization program 33 operated by the United States Department of Homeland Security to verify 34 information of newly hired employees, pursuant to the Immigration Reform 35 and Control Act of 1986 (IRCA), Public Law 99-603. 36 (3) Public agency. – This State and any county, municipality, or other political 37 subdivision of this State, of a county, or of a municipality. 38 (4) Unauthorized alien. – An alien who does not have the legal right or 39 authorization under federal law to work in the United States, as described in 40 8 U.S.C. § 1324a(h)(3). 41 "§ 64-11. Contractors with public agencies must use federal work authorization program. 42 (a) A public agency shall not enter into a contract for the physical performance of 43 services within this State unless the contractor agrees to do one of the following: 44 (1) Register and participate in the federal work authorization program to verify 45 the employment authorization of all new employees and require agreement 46 from its subcontractors, and through the subcontractors, the 47 sub-subcontractors, to register and participate in the federal work 48 authorization program to verify the work authorization of all new 49 employees. 50 (2) Employ only workers who satisfy at least one of the following: 51
