Sanctuary City Judge Indited for Helping Illegal Alien Escape Arrest

District Court Judge Shelley M. Richmond Joseph departs federal court, Thursday, April 25, 2019, in Boston after facing obstruction of justice charges for allegedly helping a man in the country illegally evade immigration officials as he left her Newton, Mass., courthouse after a hearing in 2018. The federal government is charging a Massachusetts judge and a courtroom officer with obstruction of Justice after the pair allegedly helped a twice-deported illegal alien escape out the back door while an immigration enforcement officer was kept outside the front door.

“This case is about the rule of law,” said United States Attorney Andrew Lelling in the press statement:We cannot pick and choose the federal laws we follow, or use our personal views to justify violating the law. Everyone in the justice system – not just judges, but law enforcement officers, prosecutors, and defense counsel – should be held to a higher standard. The people of Massachusetts expect that, just like they expect judges to be fair, impartial and to follow the law themselves.

District Court Judge Shelley Richmond Joseph and Trial Court Officer Wesley MacGregor face severe penalties: “charges of conspiracy to obstruct justice and obstruction of a federal proceeding – aiding and abetting provide for sentences of no greater than 20 and five years in prison, respectively; five and three years of supervised release, respectively; and a fine of $250,000,” said a press statement from the Department of Justice. The illegal alien was arrested in March 2018 for narcotics possession. An agent from the Immigration and Customs Enforcement agency was sent to the courthouse to arrest and deport the alien, who “had twice been deported from the United States – in 2003 and 2007, and … a federal order had been issued prohibiting the defendant from entering the U.S. until 2027,” the statement said, adding: Source – Breitbart – Continue…

Massachusetts judge busted for playing 'coyote' to a deportable illegal

Leftists have been treating courts as their personal fiefdoms under the rubric of 'discretion' and 'independence.' This bust in Massachusetts signals that that argument doesn't wash.

    April 26, 2019

    By Monica Showalter

Is sanity finally returning to the justice system?
A most welcome story comes from Newton, Massachusetts, where a state judge has been busted by the U.S. Attorney's Office for interfering with federal lawmen attempting to deport a convicted career criminal illegally present in the U.S. The judge, Shelley Richmond Joseph, and her court officer, Wesley MacGregor, are charged with conspiracy and obstruction for blocking ICE agents from detaining the twice deported illegal alien who'd been convicted of drug-dealing and was wanted elsewhere for drunk driving, from scooping him away at the courthouse.

According to the New York Times:
Prosecutors accused Judge Joseph and Mr. MacGregor of letting their beliefs trump federal immigration law when they allegedly helped the man, who was not named in the indictment, sneak out of Newton District Courthouse in Newton, Mass., in March 2018. The judge ordered the man to go to a basement facility, where he was let out a back door, rather than into the lobby, where she knew that an ICE officer was waiting for him, prosecutors say.
In other words, by protecting the migrant criminal from the long arm of the law, she did the same job the human-smuggling 'coyotes' do. How convenient for the coyotes.
Predictably, the Left is yelling about the indictment, not the criminal getting let out to prey on citizens, hollering that it's a problem of President Trump interfering in the justice process. Enforcing the law these days now amounts to 'interfering' with justice, meaning whatever it is that leftists have going at the courthouses. Left unsaid in news reports is the fact that the judge herself was a politically connected left-winger, according to what Howie Carr found, which enabled her to:
    a) illegally prevent an officer of the law from coming into her courtroom, b) improperly order the clerk to turn off the tape recording of the proceedings, and c) allow the illegal immigrant [sic] (who is also believed to have been charged with OUI in Pennsylvania) to flee the courthouse.
One other thing he could have added to his list is that the judge lied to the federal agents (something that got jail time for some Trump officials in unrelated cases), telling the agents to wait in the lobby where she'd release the criminal. Instead of keeping her word, she had her court officer use his special security key to release the criminal out the back door so they wouldn't know he'd been let out. Talk about sneaky-pete.
The problem with this whole scenario is that leftists seem to think they 'own' the courthouse, and the entire justice process, instead of recognizing themselves as merely servants of the law. In leftyworld, the law serves them, not the other way around. These leftists claim the charges amount to a politicization of justice, but they're just protecting their own.
By this logic, would the lawmen who arrested the illegal have the 'discretion' to not bring the illegal to the courthouse for his court date because they didn't like the judge? Could the lawmen just keep him and deport him on their own as a matter of their own 'independence'? Could the jailers exert their 'independence'? Could the probation or parole officers exert 'discretion,' too? Would juries be entitled to do as they please, or do they have the simple job to determine whether a law is broken or not? Justice is a chain of people and enforcement mechanisms that doesn't end at solely the judge's bench. Either you enforce the law or you don't, and this judge decided to make up her own laws as well as make herself the cop, too, under the phony cover of judicial 'discretion.'
Here's one other element that signals how badly off the rails the whole leftist-judges-at-the-bench issue has run. In a separate piece, Carr interviewed a Joseph ally, Suffolk County district attorney Rachael Rollings, who pretty much explained that there are two sets of laws for the assorted crooks they sentence:
On that same page, Rollins writes that "our office will begin to factor into all charging and sentencing decisions the potential of immigration consequences."
So if someone faces deportation as a result of his other actions, which he was responsible for and conducted without regard for his immigration status, he gets less punishment than an ordinary American for the exact same crime? That isn't justice; that's banana republic.
Justice apparently isn't blind in a leftist place like Massachusetts.
And it's pretty clear that a leftist judge decided that laws were there to be broken. Expect a lot of rubbish from the press about the whole thing being a matter of President Trump's 'hard-line' stance on immigration or 'racism' or other leftist talking points. The issue is whether the law means anything at all and whether the lawmen have a right to enforce the law. The U.S. Attorney who brought the case says it's not about Trump, it's about law. He's right. This bust signals a turn in the tide and one hopes a leftwing judge is about to learn about that the hard way.

About time: Massachusetts judge is INDICTED for blocking ICE agents from detaining a two-time illegal alien deportee

(Natural News) Since POTUS Donald Trump took office and issued his first executive order aimed at curbing illegal immigration, shoring up border security, and keeping our country safe from potential terrorists, the hard American Left has opposed him.

This includes judicial activists on federal and state courts who either ignore existing law or fabricate rulings out of thin air to justify their support for people in our country illegally.
Well, the Justice Department has finally had enough and is taking action against officers of the court who have sworn an oath to uphold the law but instead have chosen to ignore it because of their irrational hatred of the president.
Judge Shelly Richmond Joseph has been indicted by federal prosecutors for blocking Immigration and Customs Enforcement from detaining an illegal alien who has been deported twice from the United States.
Joseph, of Newton, Mass., and court officer Wesley MacGregor have been charged with conspiracy to commit obstruction of justice, actual obstruction of justice, and aiding and abetting obstruction of justice of a proper federal proceeding.
The only thing confusing about this is the length of time it took to indict these two. As The Gateway Pundit reports:
The indictment stems from an April 2018 incident from when the activist judge and her partner-in-crime helped Jose Medina-Perez, slip out of the courthouse covertly through a back door to evade ICE agents.
As The National Sentinel reported in December, Joseph had been under investigation for some time — which may help explain the lapse in time it took to indict her:
A federal grand jury is investigating a state judge in Massachusetts who allegedly violated her oath of office and the law by helping an illegal alien who appeared in her court escape Immigration and Customs Enforcement agents.
Massachusetts Gov. Charlie Baker, who appointed Newton District Judge Shelley Joseph, is calling for her to be suspended from hearing cases temporarily and to be reprimanded if found to have assisted Jose Medina-Perez in eluding ICE agents who were waiting for him outside her courtroom…
Let’s hope this is just the first of many cases to come

“Look, judges are not supposed to be in the business of obstructing justice,” Baker told local media at the time, adding that the allegations were “extremely troubling” and that in the meantime she shouldn’t be hearing cases.
“I don’t regret nominating her, but as I said, I find this story as it’s currently been presented, extremely troubling,” he added. “As far as I can tell, based on the facts as they were presented, she clearly violated the court’s own policies with respect to the way they’re supposed to handle detainers that involve federal immigration enforcement.
“I don’t think she should be hearing court cases in the meantime,” he added.
Apparently, the grand jury found the actions of Joseph and her cohort to be ‘extremely troubling’ as well — and likely illegal.
“This case is about the rule of law. The allegations in today’s indictment involve obstruction by a sitting judge, that is intentional interference with the enforcement of federal law, and that is a crime,” said U.S. Attorney for the District of Massachusetts Andrew Lelling on Thursday.
ICE had filed a detainer request with the court for Medina-Perez, who was arrested in Pennsylvania for drug possession on the latest charge. He’s been deported twice — which, again, proves that POTUS Trump’s wall is needed.
According to federal officials, MacGregor helped Medina-Perez escape by using his court security card to escort the criminal alien out of the courthouse via a back door. ICE agents were waiting in the lobby of the courthouse for Medina-Perez at the time he was allowed to escape.
It really is time for the Justice Department to step in and begin legal proceedings against these renegade state officials who have been aiding and abetting illegal immigrants. Hopefully, this case is the first of many more to come.

Justice Dept. charges state judge with aiding, abetting escape of illegal alien: Aren’t ALL sanctuary jurisdictions guilty of the same thing?

(Natural News) Supporters of POTUS Donald Trump who have been waiting for his administration to begin cracking down on Leftists who are working to thwart his immigration reform and border security efforts just got a huge morale booster this week.

On Friday the Justice Department announced charges against a Massachusetts judge who allegedly aided and abetted a twice-deported illegal alien escape from Immigration and Customs Enforcement agents.
As Breitbart News reported, District Court Judge Shelly Richmond Joseph, along with Trial Court Officer Wesley MacGregor, have been charged by federal prosecutors with “charges of conspiracy to obstruct justice and obstruction of a federal proceeding – aiding and abetting provide for sentences of no greater than 20 and five years in prison, respectively; five and three years of supervised release, respectively; and a fine of $250,000,” according to a press statement from the Department of Justice.
According to the Justice Department, Joseph and MacGregor are accused of helping Jose Medina-Perez avoid waiting ICE agents after he had been arrested in March 2018 for possession of narcotics. One of the agents who went to the Newton, Mass., courthouse to arrest and deport him “announced his presence to Courthouse personnel, including Joseph, upon arrival,” the DoJ said.
“Prior to the afternoon session, the courtroom clerk — at Joseph’s direction — allegedly instructed the ICE Officer to leave the courtroom and wait outside in the lobby, stating that in the event the defendant was released, it would be through the courtroom and into the lobby,” the statement continued.
During the proceeding for Medina-Perez, Joseph ordered the courtroom audio recording ceased — in violation of District Court rules — while she and MacGregor conferred with Medina-Perez’s attorney about the waiting ICE agent. A few minutes later, the recorder was turned back on, Joseph released the defendant:
According to the charging documents, the defense attorney asked to speak with the defendant downstairs and Joseph responded, “That’s fine. Of course.” When reminded by the clerk that an ICE Officer was in the courthouse, Joseph stated, “That’s fine. I’m not gonna allow them to come in here. But he’s been released on this.” Immediately following the proceeding, MacGregor allegedly escorted the defendant, his attorney and an interpreter downstairs to the lockup and used his security access card to open the rear sally-port exit and released the defendant at 3:01 p.m.
It’s time for DoJ to arrest and charge them allIt should be noted that in February 2017, the city of Newton declared itself a “sanctuary city,” adopting a policy that either forbids or discourages local police and authorities from assisting federal immigration authorities in the removal of illegal aliens from the United States.
Obviously, the city and its officials are going ‘above and beyond’ with their sanctuary policy — which makes this arrest and prosecution by the Trump administration extremely important in the president’s quest to get his message across to cities, counties, and states that he will no longer tolerate flagrant violations of immigration law.
“The arrest is a hard-nosed move by [POTUS] against sanctuary cities and states,” Breitbart’s Neil Munro writes. “These anti-enforcement jurisdictions are proliferating as progressives and business interests ally to protect their supply of cheap labor…”
Like it or not, federal law, per the Constitution’s Supremacy Clause, supersedes state and local laws — meaning federal immigration laws supersede any ‘sanctuary’ ordinances. Every single state and local official who either approves or maintains sanctuaries for illegal aliens should meet the same fate as Judge Joseph.

A.G. Barr needs to prosecute the Governor's and Mayor's of sanctuary states and cities!

They are not above the law either. They ARE embezzling our taxpayer dollars, misappropriating those funds, and using those funds to harbor, aid and abet illegal aliens. That is taxation without representation and WE are not working and paying taxes to pay the bills for illegal aliens!

All government employees who award them our benefits including school, drivers licenses and Medicaid need to be fired!

Judge Allowed Illegal Alien to Escape Courtroom, Faces Up to 20 Years in Prison

    3 hours ago Dr E

    Spread the love

Judge Shelley Richmond Joseph of Newton, Massachusetts, was arrested for having allegedly conspired with several others to allow an illegal alien to escape from her courtroom, effectively preventing ICE agents from arresting him.

After hearing the case of criminal illegal alien, Jose Medina-Perez, Joseph sent a court clerk out in the hallway to ask ICE agents to wait outside, which created a diversion. She then ordered another court clerk to turn off her recorder, consulted with the defendant’s attorneys, then had a retired court officer open the back door with his security badge. Medina-Perez was able to leave the court house, evading the ICE agents waiting outside.

Joseph has been suspended with pay and charged with obstruction of justice. U.S. Attorney Andrew Lelling offered Joseph a plea deal whereby she would avoid criminal prosecution if she admitted her improper behavior and managed to stay out of trouble. The plea deal would have helped Joseph avoid prosecution and potential salvage her law career. The plea involved a “deferred prosecution agreement” which would have prevented her indictment and dropped the obstruction of justice charges, as long as she didn’t repeat the offense for one year.
Judge Joseph chose not to take the deal. Her attorneys relayed that Joseph had “pleaded not guilty because she is not guilty.” Legal experts believe she refused the deal because, had she taken it, she would have been forced to make a public confession of a felony, which would have ended her career.
Joseph now awaits a jury trial. If found guilty, she could face up to 20 years in prison and the loss of her career.
