    CAN IT BE? IS GOVERNMENT FINALLY GOING TO ENFORCE THE LAW???

    This just in on Univision Online, I translated best I could.

    Employers all over the U.S. are prepared to fire workers with doubtful Social Security cards, to avoid being involved in a growing federal government campaign to detect undocumented people in work centers.

    They fear massive firings of undocumented.

    THEY WILL PUBLISH NEW STANDARDS(rules?)

    The Department of Homeland Security will soon announce some new standards for employers when the name or Social security number of an employee are detected as false by the Social Security Administration.

    The standard will require employers to fire people whose legal situation cannot be verified or if discrepancies between the Social Security number that appears in the W-2, and the database of the government organizations cannot be resolved in 60 days.

    The employers who do not follow these standards could receive fines of $250 to $10,000 for each undocumented worker and for each incident.

    This is great news if it is actually enforced. I guess I've become so cynical due to our government's track record with enforcement of immigration laws, that I will believe it when I see it.

    Great. That will give the illegal two months to pack up and ship out, and two months for the employer to hire a U.S. citizen to do the job.

    Hope it happens, wish it will happen, but just sort of doubtful that it will. We can keep an eye on it.

    These letters were not shared with other government organizations because of privacy laws.
    ...can someone logically explain to me why when the SS Admin. discovers someone is using a false or fraudelent SS#, that this information can't be shared with the DOJ/Homeland Security department becasue of a concern of privacy??? This is one of the stupidist and most non-relevant arguements I have ever heard.

    Moreover why aren't they prosecuted? This is but another example why immigrants - legal and illegal - have no respect for our laws. They know they are in violation and that the violation is known to authorities. When their criminal acts are ignored, it provides the impetus for them to go to the next level. Indeed, how are they to sort out what is prosecutable? I don't even know.

    The following provisions of law deal directly with Social Security number fraud and misuse:

    Social Security Act: In December 1981, Congress passed a bill to amend the Omnibus Reconciliation Act of 1981 to restore minimum benefits under the Social Security Act. In addition, the Act made it a felony to
    …willfully, knowingly, and with intent to deceive the Commissioner of Social Security as to his true identity (or the true identity of any other person) furnishes or causes to be furnished false information to the Commissioner of Social Security with respect to any information required by the Commissioner of Social Security in connection with the establishment and maintenance of the records provided for in section 405(c)(2) of this title.

    Violators of this provision, Section 208(a)(6) of the Social Security Act, shall be guilty of a felony and upon conviction thereof shall be fined under title 18 or imprisoned for not more than 5 years, or both.

    • Identity Theft and Assumption Deterrence Act: In October 1998, Congress passed the Identity Theft and Assumption Deterrence Act (Public Law 105-31 to address the problem of identity theft. Specifically, the Act made it a Federal crime when anyone
    …knowingly transfers or uses, without lawful authority, a means of identification of another person with the intent to commit, or to aid or abet, any unlawful activity that constitutes a violation of Federal law, or that constitutes a felony under any applicable State or local law.


    Violations of the Act are investigated by Federal investigative agencies such as the U.S. Secret Service, the Federal Bureau of Investigation, and the U.S. Postal Inspection Service and prosecuted by the Department of Justice.

    That means illegals will be able to work at a job for sixty days and then go somewhere else. If they don't know the loopholes their nefarious buddies will let them in on the most relevant ones.

    I know the ICE busts did put some fear in some illegals, who finally decided that the risk was not worth it. These would probably be in the "nervous Nelly" category, though. The audacious ones (most of them, especially the breeders) almost instinctively know what they can get away with. If ICE busts were running in the tens of thousands it might cause enough of a stir. Maybe 100's of thousands would be necessary. This is definitely an intractable problem---like a mad Chihuahua that has grabbed your pant leg.

    I know too well the tricks and schemes of these kind of people. Only imminent fear of imprisonment would drive them away---except for gangmembers who seem to thrive in prison with the hot meals, showers and playgrounds.
