Texas Judge Orders Release Of Migrants After They Overran National Guard Troops

On March 21, a large group of migrants primarily consisting of young men from Venezuela aggressively crossed the U.S. border, engaging in violence against Texas National Guard personnel and causing damage to property in El Paso.

Despite challenges with federal immigration authorities, Texas law enforcement successfully apprehended several individuals involved in the disturbance. Yet, instead of facing consequences for their actions,
Magistrate Judge Humberto Acosta decided to release the individuals into the U.S. without bail.

According to reports, the situation began when Texas National Guard soldiers allegedly divided women and children to form smaller processing groups.
This led to hundreds of foreign nationals using this as a reason to riot and overpower the guardsmen.
A source from the National Guard informed the New York Post that a migrant tried to take a soldier’s gun, while others were reportedly armed with knives and other stabbing tools.
“These people were willing to assault military,” said the source. “They were willing to assault law enforcement. They have complete disregard for our laws.”
After the incident, Governor Greg Abbott of Texas announced the deployment of 700 extra Texas National Guard troops and 200 members of the new Texas Tactical Border Force.
The Governor stated that the situation was under control thanks to the efforts of the Texas National Guard and Texas Department of Public Safety. He instructed DPS to arrest all illegal immigrants involved in criminal trespass and property destruction.
Over 70 individuals involved in the riot were arrested, with more than 200 additional suspected rioters identified by Texas authorities. However, federal immigration agencies have not cooperated.
One migrant, 21-year-old Junior Evaristo Benitez from Honduras, was taken into custody at El Paso County jail on charges including assault on a public servant. Benitez allegedly intentionally stomped on a guardsman’s knee with malice, as per court documents.
Magistrate Judge Acosta chastised the El Paso District Attorney’s Office during an online teleconference bond hearing Sunday for suggesting prosecutors were not ready to proceed with detention hearings for each of the alleged rioters,
Acosta did not specify the number of illegal aliens charged with “riot participation” or how many would be released, but he mentioned that “hundreds of arrestees” were entitled to individual detention hearings within 48 hours, as reported on Sunday.
The judge denied Assistant District Attorney Ashley Martinez’s request for a delay in the hearings, according to the Times. Another hearing is scheduled for Monday for other individuals involved in the riot.
In addition to advocating for the release of those involved in the riot, Acosta also approved the release of two other illegal aliens who were detained for cutting border fencing.
The local newspaper highlighted that if there are U.S. Immigration and Customs Enforcement holds preventing their release, the arrestees will remain in custody. ICE had previously stated that they are holding over 200 illegal aliens, as per the New York Post.
The incident was widely pointed out as another illustration of the repercussions of the Biden administration’s border mismanagement and the influx of numerous individuals entering the country.

SAID, “Every American should witness this chilling footage. This is the result of the Biden Administration refusing to secure our border and protect America.”
Sen. Tom Cotton (R-Ark.) sAID, “This assault on our sovereignty is an invasion at the invitation of Joe Biden.”
The Biden White House attempted to displace blame, suggesting congressional Republicans were responsible for the border crisis.
“When the former President told Congressional Republicans to block the bipartisan border security agreement – he said to blame him for it,” a White House spokesman TOLD Fox News. “Well he got his wish, and the result was chaos after Governor Abbott’s Operational Lone Star and razorwire were overrun yesterday. While we cannot comment on individual cases, anyone who does not have a legal basis to remain in the United States is promptly removed.”
