BPC Statement on Johnson State-Based Nonimmigrant Visa Bill

Washington, D.C.– Theresa Cardinal Brown, director of immigration policy at the Bipartisan Policy Center, released the following statement today:

“In its recent report, Still Room for Consensus, BPC’s Immigration Task Force stated that in looking at pathways for future immigration and in particular temporary worker programs, a new ‘federalist’ model for the allocation of nonimmigrant work visas ‘could facilitate each state or region to have its own allocation [of visas] according to their own specific needs.’

The efforts of members of Congress to move forward the discussion on immigration, including some potential means of addressing the status of the unauthorized, is welcome.

“Sen. Ron Johnson (R-WI) today introduced the State Sponsored Visa Pilot Program Act, which proposes one such type of model. The bill would establish a nonimmigrant visa program to allow states to sponsor nonimmigrants under state legislature designed and approved programs for employment, investment and residence in the state. The program would allow certain unauthorized immigrants to participate in the program and allow sponsorship for permanent residence.


“The efforts of members of Congress to move forward the discussion on immigration, including some potential means of addressing the status of the unauthorized, is welcome, and we hope lawmakers will reach bipartisan agreement on legislation.”

Ron Johnson introduces bill to create state-run guest worker program

States could run their own guest-worker visa programs under a billintroduced Wednesday by Republican U.S. Sen. Ron Johnson.

The proposal has backing from groups representing the dairy and tech industries, the U.S. Chamber of Commerce, Americans for Tax Reform and the libertarian Cato Institute.

Johnson previewed the legislation during a Cato Institute forum.


The bill, also introduced in the House by Rep. Ken Buck, R-Colorado, would create a non-immigrant visa for non-U.S. citizens to come to a state to "perform services, provide investment, direct an enterprise, or otherwise contribute to the economic development agenda of the State," according to a bill summary provided by Johnson's office.

Visas could be granted for a period of up to three years, and could be renewed at the end of the term.

"We have a shortage of workers in all different areas of the economy. We need to recognize that a one-size-fits-all federal model for visas or guest workers doesn’t work," Johnson said in remarks about the bill this week. "Let the states manage the visas, allocate them to the industries that need the workers, set prevailing wage rates. I think states would do a better job of protecting their state workers — American workers — as well as making sure their industries have the people they need to be able to grow."

To set a up a program, a state would need approval from the U.S. Department of Homeland Security and from its Legislature. States could also enter into agreements to jointly administer a guest worker program.



Workers could move from one job to another, but would be required to remain in the state of sponsorship unless that state had a reciprocity agreement with other states. States would be required to notify the Department of Homeland Security of a worker's address and employment.

In the first year of the program, a state could issue 5,000 guest worker visas. Additional visas would be available from a pool of 250,000, allocated based on the state's population as a percentage of the U.S. population.

Participants in the program would be able to apply for permanent residency without jeopardizing their status as state-based non-immigrants.


Brian Dake, legislative director for the Wisconsin Independent Businesses Agri-Business Coalition, said in a letter to Johnson that the legislation would be a "meaningful reform of our nation's immigration laws and a beneficial one for Wisconsin dairy farmers."

The federal H-2A program offers temporary visas for seasonal agricultural work, Dake said, but doesn't address the need for workers year-round.

Other groups backing the proposal include the Outdoor Amusement Business Association, the National Roofing Contractors Association and FWD.us, an immigration reform grouplaunched by Facebook founder Mark Zuckerberg.

A spokesman for Sen. Tammy Baldwin, Johnson's Democratic counterpart in the Senate, declined comment on the bill.

Yes, Judy. Now we have this along with all the other ways to sneak in an amnesty. Everyone needs to hear the audio at link.

I can't believe the attitude toward Americans and the need and desire to replace them with harder working foreigners. They lament the "brain drain" when foreign citizens leave.

We need a list of the 50 Co-sponsors.

Why don't they quit making it so easy for Americans to not work and get paid to not work. Give Americans pride in working by not undercutting them and replacing their jobs with illegal aliens and other foreigners. Don't send their jobs away with bad trade deals.

They are planning to get cooperation with governors and legislatures.

President Trump needs to do an Executive Order for a Moratorium on All Immigration until:

1. a fail-safe measure, technology and resources are in place to track visa over-stays and all here are removed
2. the 94 million working age Americans presently out of the work force is reduced to 50 million
3. the number of Americans enrolled in Medicaid is reduced to 20 million
4. a fail-safe measure, technology and resources are in place to remove illegal aliens and all here are removed

Two conservative lawmakers know how to solve the immigration crisis — give more power to the states

For the past decade, presidents from both parties have been trying to reform America’s immigration policies, only to be repeatedly tripped up. Congress balked at both George W. Bush’s and Barack Obama’s attempts at immigration reform, and illegal immigration played a key role in the election of Donald Trump.

But what if we’ve been going about immigration reform the wrong way? What if the mistake was that we made it a one-size-fits-all policy created in Washington D.C.? What if instead we put the states in the lead?

That’s what Senator Ron Johnson (R-Wisconsin) and Congressman Ken Buck (R-Colorado) want to do: create a program that would put states in charge of issuing visas to would-be immigrants. The logic is that states are in a better condition to assess local economic conditions than the federal government. For example, a state that has a shortage of workers could issue more guest worker visas, while one with high unemployment could reduce them.


Johnson and Buck’s bill would set some requirements for the would-be immigrants. They would be barred from accessing most welfare programs and states would be responsible for enforcing those bans. Unlike other guest worker programs, the immigrants would be allowed to change jobs in order to guard against employer exploitation.


But beyond those few stipulations, the states would be allowed to set their own policies. They could decide to mandate that guest workers are paid the prevailing wage or not. They could decide to grant guest worker permits to illegal immigrants and confer upon them legal status.

For his part, Senator Ron Johnson understands that border security and immigration reform mean more than building a wall and mass deportations. It’s about streamlining the legal immigration process. “My concept of border security includes a robust guest-worker program,” Johnson told the Wall Street Journal. “It’s going to be a whole lot easier to secure the border when you’re not having to clamp down on people coming here to seek the opportunities that America provides.”

The Constitution grants sole authority over immigration to Congress. But there is nothing in the Constitution that would prevent Congress from creating a guest worker program run by the states.


The biggest hurdle to this problem is political. Republican voters have become anti-immigrant and increasingly see any immigration as a bad thing. They will criticize this bill as a “globalist scheme.” Meanwhile, Democrats are likely to balk at giving state governments more power at the expense of the federal government.

But the Johnson-Buck proposal is nonetheless one Congress should adopt. After years of abortive efforts, here at last is immigration reform that deserves to be passed.

This bill is a disgrace to every American. KILL THE BILL. Throw any and everyone who votes for it, promotes it, lobbies it out of Congress in 2018.

Oh, and since the American Dairy Coalition seems to be the group of traitors behind this treason, stop drinking cow milk and cow-milk based products for awhile. Nothing like a consumer boycott or buying slow down to get their attention.
