    URGENT UPDATE: FOOD TYRANNY BILL VOTE 9AM TODAY!

    Hope no one minds that I started another thread on this because it's been updated for the latest breaking news, and I didn't want it to get lost in the shuffle. Last night's thread was started here: http://www.alipac.us/ftopict-219657-.html

    LATEST INFO:

    This morning the US Senate Calendar says: "9:00 a.m.: Convene and resume consideration of S.510, the FDA Food Safety Modernization Act."

    At about 7 PM Monday night the Senate voted "cloture" (to limit debate) on certain amendments, 69 to 26 with significant GOP support. Don't forget!

    This sets stage for final vote today, Tuesday. Prior cloture vote was 74 in favor, so we are making headway. PUSH BACK CONTINUES! The other side lost 6 votes because of our continual electronic hammering! Just a few more vote changes and we can win!

    Let's Push Back a whole bunch more before the voting resumes this morning!

    Our email system is "maxing out" at about 15,000 emails an hour... PLEASE kept "the pedal to the metal" and continue sending as many emails as you can.

    Last night Sen Coburn said the bill will raise food prices; add 1.5 billion to deficit; add unfunded state mandates. His substitute amendment is 1/5th the size and, he believes, would protect food safety without increasing FDA power & cost.

    After limiting debate on Dr. Coburn's substitute amendment which would at least remove some of the worst provisions of S.510 (such as secret "national security" guidelines) the Senate vote against a "nongermain" amendment to repeal the Health Care Law provision requiring 1099 forms for small transactions was to have been a sop to the Tea Party. Similarly, a watered-down version of the Tester amendment was included in the Managers' bill, but, as we've shown elsewhere, it is offers a false hope of protection in inflationary times.

    The ad hoc coalition against S.510 of health and food freedom advocates (such as Health FreedomUSA and Citizens for Health), garden, farm and ranch groups, both major Tea Party groups, the Oath Keepers, Downsize DC, Campaign for Liberty and others will not be fooled and we will remember!

    We the People will continue to oppose S.510, hoping a few more Senators will want to avoid being retired, but if it passes the Senate, we will oppose it in the House/Senate Conference and will petition the current White House occupant to veto it. If he fails to do so, we will support defunding it in the new Congress!

    WASHINGTON—The Senate passed the FDA Food Safety Modernization Act (S.510) by a 73 to 25 vote today. The $1.4 billion bill is the first major overhaul of food safety law for the U.S. Food and Drug Administration (FDA) in 70 years and gives FDA enhanced responsibility to ensure the nation’s food safety.

    The House of Representatives approved a different version of the food safety bill in 2009; however, the bill’s sponsor Sen. Tom Harkin (D-Iowa) said the House has agreed to adopt the Senate version, bypassing the need for a conference to integrate the two bills. Once approved, the bill will move on to President Barack Obama for his signature.

    The bill gives FDA greater authority to initiate recalls, rather than waiting for food companies to voluntarily recall food products. Food processors and farmers also would be required to develop strategies to prevent contaminations, and would be required to allow FDA access to all records.

    The bill calls for the FDA to inspect at least 600 foreign food facilities within a year of enactment, and double its number of foreign inspections in each subsequent year for five years. The measure would require inspections every three years for U.S. manufacturing and processing plants the FDA views to be at a high risk for contamination, and every five years for all other domestic facilities. According to the Congressional Budget Office (CBO), 50,000 foreign and domestic food facilities would be inspected in 2015 by FDA or federal, state, local or foreign officials acting on FDA’s behalf.

    The legislation also would require most food producers to develop hazard prevention plans and would give the FDA access to those records when requested. Some local food producers with annual sales under $500,000 would be exempt from that rule under the Tester amendment.

    THE US SENTATE JUST VOTED TO END FOOD FREEDOM IN THE UNITED STATES.
    THE ACTION NOW MOVES TO THE HOUSE OF REPRESENTATIVES

    WE HAVE PREPARED A NEW ACTION ITEM TELLING THE HOUSE NOT TO ACCEPT THE SENATE BILL S.510. The NY times just reported the "lame-duck leadership" in the House will attempt quick passage!

    "Despite unusual bipartisan support on Capitol Hill and a strong push from the Obama administration, though, the bill could still die, because there might not be enough time left in the session for the usual haggling between the Senate and House of Representatives, which passed its own version of the bill last year. Top House Democrats have said that they would consider simply passing the Senate version to speed approval."
