    Friends neighbors and patriots a suggestion !

    You all are very dedicated and we love you to death. You have an abundance of energy. That's good. However, not to be critical, much of that energy is wasted on your fellow patriots. I receive 30- 40 E-mails per day. It doesn't do any good to bombard me with patriotic articles and suggestions, I am already the most motivated SOB on the planet when it comes to remediating the problem we all know about.

    There is a pervasive propensity here to cut and paste articles posted on American Border Patrol. That's good. I concur. However, it doesn't advance out agenda to those that count. It only "churns" the agenda among us who are already motivated to code RED.

    I am suggesting that you go to the old, tried and true snail mail, hard copy mail. Physical letters mailed to the White House, Senators, Congressmen, Mayors, Sheriffs, Police Chiefs.

    Jeff Sessions, Tom Tancredo, Steve King, Peter King, Charles Grassley, Dana Roerbacher, Hunter etc.

    Write to the mayors, police chiefs, county executives, sheriffs of; New Ipswich, NH; Danbury, Ct: Mamaroneck, NY; Suffolk County NY.     Dear Councilman Von Harten:

    It has come to our attention that the Puerto Rican Legal Defense and Education Fund is threatening you with litigation unless you submit to their demands to drop your ordinances passed for the protection of your communities from being overrun with illegal alien insurgent colonizers. Citizens Civil Defense is a private entity that is autonomous but associated with over 56 other contiguous, patriot groups in more than 34 states. Our numbers, including lobby activists are over 400,000. We support law enforcement, advocate the enforcement of Federal Immigration Laws and promote respect for and compliance with the Constitution of The United States of America. I retired from a major Fortune 500 manufacturing company as a Marketing Manager. I lived in Latin America for many years and traveled 31 countries there. I speak, read and write Spanish.

    Eighty five to ninety three percent of Americans agree with the actions taken to dislodge the illegal aliens. The threatened attack on your community is abhorrent. The ACLU’s/ PRLDEF spokesman’s statements are repugnant. We have come to learn that the criminal lobby *( ACLU ) is motivated by the: the Civil Rights Attorney's Fees Awards Act of 1976 (42 U.S.C.A. § 198 that permits payment of attorneys fees if the defendant loses the case; and by Hispanic Jihadist’s, Marxists; liberals and socialists. The Hispanic advocacy groups are exceptionally racist. And the stimulants are also the mentality of One World Order. They have no respect at all for the sovereignty of the United States or our laws. And the illegal aliens are becoming increasingly bold and brazen. These are lawless invaders that are frequently caught engaged in a variety of misdemeanors and felonies. Furthermore we have come to learn that the drug cartels are spreading and permeating the USA along with the dozens of “gangs” and using illegal aliens and day laborers as salesmen of narcotics.

    The ACLU and its associated immigrant attorneys MALDEF, PRLDEF and several others are attacking Cities, Towns and Villages across America: Danbury, Connecticut; Mamaroneck, New York; Freehold Borough, New Jersey; Riverside, New Jersey; Bridgeport, Pennsylvania; Hazleton, Pennsylvania; Taneytown, Maryland; Palm Coast, Florida; Farmers Branch, Texas; Escondido, California; Costa Mesa, California; Valley Park, Missouri; Covington, Kentucky. Typically the plaintiff’s attorneys play the race card. However, there is a





    deplorable deficit within the Immigration, Control and Enforcement branch who have time and again shown their reluctance, and refusal, to deal with the illegal aliens.

    Contrary to the disinformation that Hispanic advocacy groups, protesters and demonstrators spread, aliens who enter our country illegally at other than designated entry points are committing serious crimes. If they live here and work here they are committing even more egregious crimes. Cesar Perales, president and general counsel of the Puerto Rican Legal Defense and Education Fund, distorted the body of the whole truth when he said they have had success in other places. I happen to be very familiar with events in Mamaroneck, New York and Hazleton, Pennsylvania, having visited both and become involved.

    • Mamaroneck, NY. The Village Council erred significantly by nor having bullet proof ordinances when they closed Columbus Park

    • They erred again by not sending some law enforcement for the Federal 287 G training.

    • They erred a third time by saying in court that they did not know if the day laborers were illegal aliens.

    • Federal District Court Judge Colleen McMahon cautioned that witnesses would be required to reveal their identities. Two thirds of the PRLDEF case was immediately dropped. However, she then incredibly allowed witnesses to testify as “John Does”. Those witnesses were illegal aliens and contractors who were violating Federal Immigration Laws. I personally established the illegality of the 30 illegal aliens who were in Columbus Park.

    • Judge McMahon wrote in her decision that Mamaroneck had discriminated and harassed. The decision is found here. http://www.prldef.org/. It may be beneficial to you as a study reference about what not to do. So far she hasn’t set a date for the parties to determine attorneys fees and Mamaroneck hasn’t made public their intentions to capitulate or appeal, so far as I know. Mr. Perales is a little bit premature in crowing about any imagined victories. Judge McMahon’s ridiculous decision has resulted in actions to unseat her. Judicial Watch has also expressed interest. The Village, wasn’t discriminating nor harassing. They were merely trying to enforce the law.

    • The Judiciary has been taken over by liberals. This is graphically detailed by Federal Circuit Court Judge Robert H Dierker, Jr., 22th District, St. Louis, Mo., *( In his new Book The Tyranny of Tolerance ). He illustrates how these liberals have tossed the Constitution out the window and replaced it with their own “progressive” personal agendas. I highly recommend the book. His explanations fit Judge Colleen McMahon perfectly.

    Sec. 1459. Reporting requirements for individuals
    (a) Individuals arriving other than by conveyance
    Except as otherwise authorized by the Secretary, individuals
    arriving in the United States other than by vessel, vehicle, or
    aircraft shall -
    (1) enter the United States only at a border crossing point
    designated by the Secretary; and
    (2) immediately -
    (A) report the arrival, and
    (B) present themselves, and all articles accompanying them
    for inspection;
    to the customs officer at the customs facility designated for
    that crossing point.

    (f) Civil penalty
    Any individual who violates any provision of subsection (e) of
    this section is liable for a civil penalty of $5,000 for the first
    violation, and $10,000 for each subsequent violation.


    (g) Criminal penalty

    (f) of this section, any individual who intentionally violates any
    provision of subsection (e) of this section is, upon conviction,

    "Any person who . . . encourages or induces an alien to . . . reside . . . knowing or in reckless disregard of the fact that such . . . residence is . . . in violation of law, shall be punished as provided . . . for each alien in respect to whom such a
    violation occurs . . . fined under title 18 . . . imprisoned not more than 5 years, or both."
    Section 274 felonies under the federal Immigration and Nationality Act, INA 274A(a)(1)(A):
    A person (including a group of persons, business, organization, or local
    government) commits a federal felony when she or he:
    * assists an alien s/he should reasonably know is illegally in the U.S. or who lacks employment authorization, by transporting, sheltering, or assisting him or her to obtain employment, or
    • encourages that alien to remain in the U.S. by referring him or her to an employer or by acting as employer or agent for an employer in any way, or
    knowingly assists illegal aliens due to personal convictions.
    Penalties upon conviction include criminal fines, imprisonment, and forfeiture of vehicles and real property used to commit the crime. Anyone employing or contracting with an illegal alien without verifying his or her work authorization status is guilty of a misdemeanor. Aliens and employers violating immigration laws are subject to arrest, detention, and seizure of their vehicles or property. In addition, individuals or entities who engage in racketeering enterprises that commit (or conspire to commit) immigration-related felonies are subject to private civil suits for treble damages and injunctive relief.

    Recruitment and Employment of Illegal Aliens

    It is unlawful to hire an alien, to recruit an alien, or to refer an alien for a fee, knowing the alien is unauthorized to work in the United States. It is equally unlawful to continue to employ an alien knowing that the alien is unauthorized to work. Employers may give preference in recruitment and hiring to a U.S. citizen over an alien with work authorization only where the U.S. citizen is equally or better qualified. It is unlawful to hire an individual for employment in the United States without complying with employment eligibility verification requirements. Requirements include examination of identity documents and completion of Form I-9 for every employee hired. Employers must retain all I-9s, and, with three days' advance notice, the forms must be made available for inspection.




    Employment includes any service or labor performed for any type of remuneration within the United States, with the exception of sporadic domestic service by an individual in a private home. Day laborers or other casual workers engaged in any compensated activity (with the above exception) are employees for purposes of immigration law. An employer includes an agent or anyone acting directly or indirectly in the interest of the employer. For purposes of verification of authorization to work, employer also means an independent contractor, or a contractor other than the person using the alien labor. The use of temporary or short-term contracts cannot be used to circumvent the employment authorization verification requirements. If employment is to be for less than the usual three days allowed for completing the I-9 Form requirement, the form must be completed immediately at the time of hire.
    An employer has constructive knowledge that an employee is an illegal unauthorized worker if a reasonable person would infer it from the facts. Constructive knowledge constituting a violation of federal law has been found where (1) the I-9 employment eligibility form has not been properly completed, including supporting documentation, (2) the employer has learned from other individuals, media reports, or any source of information available to the employer
    that the alien is unauthorized to work, or (3) the employer acts with reckless disregard for the legal consequences of permitting a third party to provide or introduce an illegal alien into the employer's work force. Knowledge cannot be inferred solely on the basis of an individual's accent or foreign appearance.
    Actual specific knowledge is not required. For example, a newspaper article stating that ballrooms depend on an illegal alien work force of dance hostesses
    was held by the courts to be a reasonable ground for suspicion that unlawful conduct had occurred.
    IT IS ILLEGAL FOR NONPROFIT OR RELIGIOUS ORGANIZATIONS to knowingly assist an employer to violate employment sanctions, REGARDLESS OF CLAIMS THAT THEIR CONVICTIONS REQUIRE THEM TO ASSIST ALIENS. Harboring or aiding illegal aliens is not protected by the First Amendment. It is a felony to establish a commercial enterprise for the purpose of evading any provision of federal immigration law. Violators may be fined or imprisoned for up to five years.

    Encouraging and Harboring Illegal Aliens

    It is a violation of law for any person to conceal, harbor, or shield from detection in any place, including any building or means of transportation, any alien who is in the United States in violation of law. HARBORING MEANS ANY CONDUCT THAT TENDS TO SUBSTANTIALLY FACILITATE AN ALIEN TO REMAIN IN THE U.S. ILLEGALLY. The sheltering need not be clandestine, and harboring covers aliens arrested outdoors, as well as in a building. This provision includes harboring an alien who entered the U.S. legally but has since lost his legal status.

    An employer can be convicted of the felony of harboring illegal aliens who are his




    employees if he takes actions in reckless disregard of their illegal status such as ordering them to obtain false documents, altering records, obstructing INS inspections, or taking other actions that facilitate the alien's illegal employment. Any person who within any 12-month period hires ten or more individuals with actual knowledge that they are illegal aliens or unauthorized workers is guilty of felony harboring. It is also a felony to encourage or induce an alien to come to or reside in the U.S. knowing or recklessly disregarding the fact that the alien's entry or residence is in violation of the law. This crime applies to any person, rather than just employers of illegal aliens. Courts have ruled that "encouraging" includes counseling illegal aliens to continue working in the U.S. or assisting them to complete applications with false statements or obvious errors. The fact that the alien is a refugee fleeing persecution is not a defense to this felony, since U.S. law and the UN Protocol on Refugees both require that a refugee must report to immigration authorities without delay upon entry to the U.S.
    The penalty for felony harboring is a fine and imprisonment for up to five years. The penalty for felony alien smuggling is a fine and up to ten years' imprisonment. Where the crime causes serious bodily injury or places the life of any person in jeopardy, the penalty is a fine and up to twenty years'
    imprisonment. If the criminal smuggling or harboring results in the death of any person, the penalty can include life imprisonment. Convictions for aiding, abetting, or conspiracy to commit alien smuggling or harboring, carry the same penalties. Courts can impose consecutive prison sentences for each alien smuggled or harbored. A court may order a convicted smuggler to pay restitution if the alien smuggled qualifies as a victim under the Victim and Witness
    Protection Act. Conspiracy to commit crimes of sheltering, harboring, or employing illegal aliens is a separate federal offense punishable by a fine of up to $10,000 or five years' imprisonment.

    Enforcement

    A person or entity having knowledge of a violation or potential violation of employer sanctions provisions may submit a signed written complaint to the INS office with jurisdiction over the business or residence of the potential violator, whether an employer, employee, or agent. The complaint must include the names and addresses of both the complainant and the violator, and detailed factual allegations, including date, time, and place of the potential violation, and the specific conduct alleged to be a violation of employer sanctions. By regulation, the INS will only investigate third-party complaints that have a reasonable probability of validity. Designated INS officers and employees, and all other officers whose duty it is to enforce criminal laws, may make an arrest for violation of smuggling or harboring illegal aliens.

    State and local law enforcement officials have the general power to investigate and arrest violators of federal immigration statutes without prior INS knowledge or approval, as long as they are authorized to do so by state law. There is no extant federal limitation on this authority. The 1996 immigration control legislation





    passed by Congress was intended to encourage states and local agencies to participate in the process of enforcing federal immigration laws. Immigration officers and local law enforcement officers may detain an individual for a brief warrant-less interrogation where circumstances create a reasonable suspicion that the individual is illegally present in the U.S. Specific facts constituting a
    reasonable suspicion include evasive, nervous, or erratic behavior; dress or speech indicating foreign citizenship; and presence in an area known to contain a concentration of illegal aliens. Hispanic appearance alone is not sufficient. Immigration officers and police must have a valid warrant or valid employer's consent to enter workplaces or residences. Any vehicle used to transport or harbor illegal aliens, or used as a substantial part of an activity that encourages illegal aliens to come to or reside in the U.S. may be seized by an immigration officer and is subject to forfeiture. The forfeiture power covers any conveyances used within the U.S.

    RICO -- Citizen Recourse

    Private persons and entities may initiate civil suits to obtain injunctions and treble damages against enterprises that conspire to or actually violate federal alien smuggling, harboring, or document fraud statutes, under the Racketeer-
    Influenced and Corrupt Organizations (RICO). The pattern of racketeering activity is defined as commission of two or more of the listed crimes. A RICO enterprise can be any individual legal entity, or a group of individuals who are not
    a legal entity but are associated in fact, AND CAN INCLUDE NONPROFIT ASSOCIATIONS.

    Tax Crimes

    Employers who aid or abet the preparation of false tax returns by failing to pay income or Social Security taxes for illegal alien employees, or who knowingly make payments using false names or Social Security numbers, are subject to IRS criminal and civil sanctions. U.S. nationals who have suffered intentional discrimination because of citizenship or national origin by an employer with more than three employees may file a complaint within 180 days of the discriminatory act with the Special Counsel for Immigration-Related Unfair Employment Practices, U.S. Department of Justice. In addition to the federal statutes summarized, state laws and local ordinances controlling fair labor practices, workers compensation, zoning, safe housing and rental property, nuisance, licensing, street vending, and solicitations by contractors may also apply to activities that involve illegal aliens.

    • Selective Service Registration: Defense Authorization Act established Title 5, U.S. Code, Section 3328





    The law says that all men living in the United States who are ages 18 through 25 must register, except those who are in valid non-immigrant status (e.g., students, visitors, and people who have been permitted to come to the US for limited periods of time, etc.). The Selective Service interprets this to mean that undocumented men must register. Failing to register is a federal crime, with a penalty of up to five years in prison or a $250,000 fine or both.

    The Federal Government has a G-287 training program that will qualify your police to enforce immigration laws.

    In closing I want to add that anyone who sneaks across our border surreptitiously is already predisposed to prevaricate, counterfeit documents and steal identities. There are cases on record wherein the real identities of illegal aliens were very difficult to ascertain. The question to be asked is “when will ICE start deportation proceedings”. We citizens find this inaction incident absolutely disgraceful and unpardonable. We cannot afford to wait.



    • Addendum:
    Hazleton, Pa. Judge Munley, Federal District Court, Scranton, has ruled that illegal aliens can testify as “John Doe’s” against Hazleton. He also issued a 120 day injunction which means simply that attorneys on both sides hold in abeyance. The trial has been scheduled for March 2007. Mayor Barletta intends to appeal if necessary and will pursue to the Supreme Court. A letter was issued to Judge Munley objecting strongly to allowing illegal aliens to testify. And an official complaint has been made to the Federal Bureau of Investigation accusing the Judge of cross misconduct. Illegal aliens cannot legally appear in court, even as casual observers, and they are to be apprehended by ICE. ICE has, in fact, apprehended them in courts previously and removed them.

    In addition to the federal statutes summarized, state laws and local ordinances controlling fair labor practices, workers compensation, zoning, safe housing and rental property, nuisance, licensing, street vending, and solicitations by contractors may also apply to activities that involve illegal aliens.
    This looks pretty plain to me!!

    Wetitbe, I have had the same thoughts today. We all sent a few emails to President Bush.....as if that would matter to him.

    I think we all go through times where we have read so much until we look at another article and we already know what it's going to tell us.....more bad news. And haven't we said it all?

    What else is there that we can do? I guess keep writing, keep contributing, keep talking, and keep reading and keep voting.

    We are doing all of the above.

    There are what - 12-50 million illegal aliens in the USA and how many citizens (300,000,000) and 85-90% of us say no amnesty.

    What do they have over us?

    The fact that George Bush knows that we will not break the law. Quite to the contrary the illegal aliens managed to put over a million of themselves in our streets. Their message? "Mr. Bush, we are here walking peacefully and if we do not get what we want it will not be a peaceful protest." That was the unspoken, and subtle but obvious message.

    Quite obviously, we do not have that option and our desire is not to have it, but it is our very peaceful and law-abiding nature which is allowing President Bush to do this to us.

    How sad!! Law-abiding and peaceful finishes last in America. At least with our current president.

    Please listen to us, President Bush. We're just about begging now.

    And before anyone gets the idea that doing anything illegal is an option keep in mind that it isn't. It's not a part of our agenda, shall we say. Even to suggest it or talk about it without clearly stating that it is not your intention to suggest it will get you banned from ALIPAC and in trouble with our government. So, please know that I am not trying to do that nor should anyone else.

    I am just making the point that our law-abiding beliefs are making it easier for our side to be ignored by certain decision makers.

    But we can get past that. We can always hold a peaceful protest as some have suggested most likely in Washington, D.C. at sometime in the future.

    And as we also know, however this turns out we will have to accept what the deciders decide to do. That is the bottom line. And it's the line that we cannot cross over.

    Okay, back to the drawing board.

    As I advocate - I support law enforcement, promote compliance with immigration law, and advocate respect for our Constitution. Having said that I am not so sure that the day is not rapidly approaching when we will begin violating the law to enforce it !! The end may be justified by the means.

    What does that mean ?

    A person would need to have studied quite a bit of the history of the early United States, pre and post independence and pre and post civil war. What we stood for, what we fought for and what we achieved as well as how we achieved it. NONE of it was achieved by peaceful means.

    * When we see our law enforcement completely emasculated and helpless we wonder !

    * When we see our borders crossed daily we wonder !

    * When we see swarms of aliens loitering on our streets we wonder !

    * When we see our women and children molested and raped we wonder !

    * When we see the mayors of Cities providing sanctualy to criminal aliens we wonder !

    * When we see our churches providing food, shelter and sanctuary to alien criminals we wonder !

    * When we see a liberal judiciary grant "John and Jane Doe" illegal aliens access to our courts to testify against the Mayors and police chiefs we wonder !

    Actions AGAINST the state/country would be sedition/treason/anarchy. However, actions against invaders/criminals/colonizers/soldiers of demographic warfare, who threated the peace tranquility and well being of the citizens, that would be patriotism, partisan underground.

    And what could, or should, that action, those actions, be ? Who would engage ? How far would they go ? Perhaps civil disobedience would be a good place to start. Why not? The aliens and those that aid and abet them, hire them, rent to them, feed them, shelter them do it with total impunity regularly while law enforcement looks on with a benign posture. The laws are being violated millions of times on a daily basis with no punishment. Crossing the border at other than a designated entry point is a customs violation with civil penalty of $5,000 for the first offense and another $5,000 criminal offense. It doubles for the second offense. Yet aliens are released commonly without imposing those fines on them ! Why ?

    We are forced to support financially the malfeasance of aliens who receive emergency medical care but do not pay the bills. We are forced to pay school taxes to educate illegal ailens.

    Our forefathers wouldn't accept the onerous taxes that King Charles imposed. They tossed tea into Boston Harbor. Abraham Lincoln would not accept the attack on Fort Sumter nor the attack on Harpers Ferry arsenal, nor secession of the Confederacy.

    We are rapidly coming to a fork in the road. Which turn will we make ?

    Hi WETTIBE, I'm sorry I left a "B" out of your name back there.

    It will be a sad day in America if the non-citizens and the law-breakers override the citizens and those who stand for obeying the law.

    I agree with you about our history that people have achieved their goals at times via breaking the law. I'm not sure if such things could really be done or would work as well today as easily as in those days.

    If illegal immigrants get amnesty of any kind then I will be proven wrong.

    Especially right now, we are at war, the government has it's hands full, other than an occasional person such as Cindy Sheehan who engages in civil disobedience to bring attention to her cause I don't think civil disobedience in larger numbers than a very few would be tolerated.

    Our side has been law-abiding all the way, and just as you say about yourself and which is quite obvious.....that you are law abiding all the way.....almost everyone on our side of this battle is that way. I believe that our goals of having our laws enforced and of not showing to the world that entering our country illegally will be tolerated will prevail and win in the long run. I truly do.

    There is a lot at stake if our country shows the world otherwise. We are a country of law and order and if we send a message that we are not, it very well could lead to further problems down the road, where newcomers to our country from around the world think that uprisings such as in France could be possible.

    As we stand now, what people did in France for example, would never be tolerated here in the U.S. I really do not think people could get away with something such as that here. Even though we are such a tolerant country as far as freedom and having choices, I don't think our government is very tolerant when it comes to things such as protests, etc. Oh sure, we can have a peaceful protest, but they'll be watching closely. Yet even so, we probably have more freedom than any other country in the world. I think the reason is because we are so law-abiding over here and American citizens know and understand where the line is and where not to cross over it. I guess that comes from enforcing our laws.
