    Know Your Rights When Taking Action! These are Some Basic Rights and Security

    1.Precautions for April 10th Everyone (documented or undocumented) has the right to advocate peacefully for change.

    2.Everyone (documented or undocumented) has the right to maintain
    silent and not answer questions that a government agent may ask
    you.

    3. If a government agent or the police ask you something, including
    your name, immigration status, or where you were born, you do not
    need to answer. If they are questioning you, you should ask Am
    I free to go?

    4. If you have immigration papers showing legal status, U.S. law
    requires you to carry them and show them upon the request of a
    government agent. If you do not have these papers and are asked
    for them, you should ask, Am I free to go?

    5. Do not say anything to a reporter that you don t want anyone to
    know, such as your last name or immigration status.

    6. There is no guarantee that immigration authorities won t come,
    or that the police won t approach you, but if everyone remains
    peaceful, nothing should happen.

    7. If there are counter-protesters, do not get into fights with
    them so that you will avoid getting arrested.

    STUDENTS -- KNOW YOUR RIIGHTS ON APRIIL 10TH
    The Mexican American Legal Defense and Educational Fund (MALDEF) urges both students and school administrators to make informed decisions regarding their participation in the marches and other events scheduled for April 10, 2006.

    MALDEF is aware that students plan to participate in peaceful marches on April 10 throughout the United States to support fair and just immigration reform. MALDEF believes it is vital that all parties understand their respective rights and responsibilities.

    Students:
    o You have a constitutional right to free speech but remember that you are still subject to school rules.

    o You must remember to avoid disrupting class. Check your student handbook (most are available online) to get a better idea of your school�s standards and expectations.

    o Cool and calm behavior that does not disrupt the education of those choosing to remain in their classrooms is the best way to make your point and avoid punishment based on disruptive behavior.

    o If you are faced with any kind of suspension, expulsion, or referral to an alternative center, you have the right to a hearing. In that hearing, administrators must tell you what you are charged with, and give you the opportunity to tell your side of the story. Your parents/guardians and lawyer can attend this meeting.

    o Tell your parents/guardians about your plans. Talk to them about how they can participate on April 10, including taking you out of class to participate in the day�s
    events.

    o If you are punished more than students who may have broken the same rules, but under different circumstances (e.g., �Senior Skip Day�), this may be a violation of your right to free speech.

    o Be aware of the risks involved. Sometimes events can take unexpected turns, and you
    may be stopped and questioned by law enforcement even if you join a peaceful march.

    Key Points � The Movement is Changing Politics

    � Our voices are being heard in Washington, DC � we have changed the immigration debate in Washington � we are just beginning � and we will win. We are on the right side of history.

    � Last week, Democratic and Republican Senators tried hard to come up with a deal on immigration. But just a couple of months ago � Senators were tripping over themselves trying to see who could be the most �tough on immigration.�

    � But Congress saw 500,000 of us march in Los Angeles, they saw 500,000 march in Chicago, they saw 30,000 march in Tennessee. Congress saw democracy in action. Congress got nervous. Congress changed their tune. My friends, they aint seen nothing yet.

    � Leaders in the Senate tried everything they could to finish their work on immigration before they left home for a two week vacation. They tried to finish their work on immigration before April 10 � before today. They wanted us to quiet down. They did not want us to march today.

    �But last week, hard-right Republican Senators flexed their muscle in Washington and killed immigration reform. Hard-right Republican Senators demanded that immigrants be rounded up, arrested and deported. Hard-right Republican Senators demanded that young immigrants be deported back to countries they never knew.

    �My friends, those hard-right Republican Senators are on the wrong side of history. My friends, we are on the right side. Congress aint seen nothing yet. Congress needs to go back to the drawing board and Congress needs to include us in the debate.
    Here is what we want:
    A pathway to earned citizenship for all immigrants living in America today.
    Our families to be reunited after being separated by a broken immigration system.
    Workplace protections, civil rights and human rights for everyone.
    Our young people to have a shot at college and the American dream.

    �My friends, today must be a beginning � not an end. The immigration debate in America has changed because of us. We need to keep pushing until America�s broken immigration system is fixed.

    �My friends, WE are what democracy looks like. My friends, WE are
    America!

    BEWARE!!! HIDDEN DEPORTATION PROVISIONS IN
    ALL SENATE AND HOUSE BILLS, including HAGEL-MARTINEZ!

    Dozens of hidden detention and deportation traps in the Senate and House bills could sabotage�legalization� programs and take away our fundamental rights to liberty and due process.

    We believe:
    􀂙 Our basic rights should not be part of any compromise immigration bill.
    􀂙 No bill that contains these provisions can truthfully be a �pro-immigrant� legalization bill.

    We demand that Congress strip these outrageous provisions from any bill that moves forward.

    WHAT DO THESE HIDDEN DEPORTATION PROVISIONS DO?

    Could make thousands ineligible for �legalization� programs

    Example: The mother of a U.S. citizen child needs a job to support her family. She uses her sister�s social security card to fill out her I-9 form. If she later applies to adjust her status � through her citizen husband or through a new program � she will likely be asked about her past employment. Revealing this
    information means she risks rejection of her application and deportation.

    Create dozens of ways to make noncitizens deportable, even if you have a green card Under these new laws, more conduct turns into criminal conduct, making people vulnerable to deportation.

    Example: a green card holding supervisor at a construction company drives his crew, some of whom are undocumented, to their jobs. He could be prosecuted criminally � and then face mandatory deportation as an aggravated felon, and his citizen family and coworkers would not be allowed to speak on his behalf.

    Deport people faster without a hearing before a court, even if they have lived here for years

    The bill has created many new systems for people to be deported without a hearing. One way deports any noncitizen who cannot prove that they have been here for more than 14 days and have been caught100 miles within the border.

    Enact more �mandatory� detention

    More people will be detained than ever before. For example, people (except for Cubans, Mexicans, and some asylum seekers) entering �illegally� will be detained. DHS has sole power to decide whether to release you or not, with no way to challenge their decision.
    Allow U.S. military bases to be used for detention space The Senate bill allows 10,000 people to be detained in military bases, like Guantanamo. Right now, over 20,000 people are detained at any given time in jails and prisons across the country, far from their families and lawyers.

    Turns police into immigration agents

    It gives local governments �inherent authority� to enforce immigration laws, encourages agreements between DHS and local police in every state, and allows immigration information to be entered into
    NCIC, the federal criminal database. This would be a public safety disaster. Immigrants would be afraid to turn to social service agencies, local police and even emergency services. Local cops could arrest
    people based on immigration information from a database known for mistakes and that they cannot interpret.

    Overturn Supreme Court decisions by legalizing indefinite detention
    People who have final orders of removal who can�t get deported (example: embassy won�t give traveling papers) won�t be able to get out, meaning that they could stay in jail for years. Currently, 1,500 people
    are being indefinitely detained. Thousands more will be affected.

    Construct a massive border fence

    This bill expands the current $30 billion border enforcement strategy which has failed to deter illegal entry and has directly resulted in the deaths of nearly 4,000 migrants over the last 10 years.

    WHAT�S THE BOTTOM LINE?
    The new provisions make it easy to take green cards away from people that already have them and strip them from people that just got them.
    These provisions whittle away against the AMERICAN ideal that every person should have their day in court. How? They strip the courts of their authority and transfer vast amounts of power to the Department of Homeland Security, the police and other federal agencies. The Senate and House bills will make lives worse for families by permanently separating children from parents, partners from each other. How? Laws are already very harsh. The effects on children who are left behind or for parents who suddenly become �single parents� are devastating. These bills will make a bad situation worse. The Senate bill lines the pockets of the prison industry. The private prison industry has made huge profits detaining noncitizens. A good chunk of the estimated $206 to $230 billion to detain and deport noncitizens will go straight to local prisons, private prisons, and county prisons who detain noncitizens.

    WHAT SHOULD YOU DO?

    CALL CONGRESS � Say �All these immigration bills are NOT acceptable. I DO NOT support an immigration bill that expands detention beds, increases mandatory detention, expands the definition of
    aggravated felony, turns police into immigration agents, changes the law around the power of the courts to review immigration cases, expands expedited removal, and overturns Supreme Court case law on
    indefinite detention. I do support amendments correcting results from current harsh immigration laws.

    And I agree, they should be rounded up and deported! As for the young illegal immigrants who don't know their countries, I have no sympathy for them. Their parents should not have broken our laws to bring them here. Those young illegal immigrants need to take that one up with their law breaking parents
