withhold high-school transcripts from illegal aliens

Can schools withhold transcripts of illegal aliens? Can laws be passed to enact this at the state level?

This morning I was reading an article at the Chicago Suntimes where a students public high-school transcripts were being withheld because the district decided the family did not reside in the area in spite of owning property there. The district is demanding $30,000 out of district tuition. The student cannot attend college without the transcripts and the parents insist they live there. Apparently the district does not have to go to court and can just arbitrarily decide these issues.

My thought is that this could be used as a tool if students were required to prove they are legally in the US to get their transcripts. Obviously Illinois wouldn't pass a law like this, but is it something other states might consider? I live in Illinois but hope to move as soon as feasible.

District claims family lives out of town, sues for $30K in tuition

Suburban high school officials are suing the parents of two students enrolled in classes during the 2009-2010 school year, accusing the family of living in Chicago — outside school boundaries — and ordering them to fork over more than $30,000 in out-of-district tuition.

Oak Park and River Forest High School District 200 filed the suit Tuesday against parents Maurice Carter and Terri Shaw Carter, who say this is the latest chapter in the ongoing battle with the school district. They say their family owns and lives in an Oak Park condominium, the same place they have called home for years — including the school year in question.

But court records and an attorney handling the breach of contract case say an investigation — triggered by an anonymous complaint to the school — showed the family was staying at a residence in Austin, the far West Side neighborhood that borders suburban Oak Park and the school district.

“There were two kids. They were not residents of the district, but they both went to the school,â€

NO UNDOCUMENTED or ILLEGAL student should receive a diploma or credit for attending schools in this country. SCOUS says they can go to school but says nothing about issuing diplomas or credits. Just says states cannot stop them from attending school.

I don't think they could specifically without the highschool transcripts of an illegal alien specifically. I wish they could though but thats a different story. Now as far as this case goes it would effect anyone and not just illegal aliens and it could fly very easily. What school someone can attend for free is based on where you actually live and not just what address you want to use. That school is entitled to reimbursement in full and can legally withhold transcripts until its paid.... well least until a liberal judge rules otherwise.
