"If lawmakers are bent on treating accused illegal immigrants more like criminals, then that treatment should also include the rights and protections that other criminals already have, as defined in our Constitution."

Yes they are criminals , and no they should not be treated like homegrown criminals

Due process them right back to their home countries. They've taken advantage of our generosity far too long.

Our Constitution’s 14th Amendment specifies that we all must be guaranteed equal protection of the laws; the 5th Amendment states that no one can be deprived of life, liberty or property without due process. In most courts that includes the right to representation; it does not apply to immigration courts.
This paragraph sums up the crux of the issue. The constitutional right to representation does not apply to immigration courts, since being deported back to your rightful country of origin does not deprive one of life, liberty or property. An illegal invader can certainly hire his own attorney to represent him, but he has no constitutional right to court appointed counsel.

However, the illegal invaders and their advocates are trying to change this. They would like to see every illegal invader have a constitutional right to court appointed counsel, to assist them in avoiding deportation. The article above seems to be suggesting as much.

U.S. District Judge Dolly Gee ruled last month that the federal government must provide representation for two mentally disabled men who were fighting detention orders. So because of the ruling by Dolly Gee, mentally disabled illegal invaders will now have the right to court appointed representation. Interestingly enough, their mental disability seemingly did not hinder their ability to enter this country in violation of our immigration laws. Oh well, what does logic and common sense have to do with a court of law.

In any event, my guess is we’ll be seeing a whole lot more illegal invaders claiming some sort of mental disability in order to receive that court appointed lawyer! Of course we can rest assured that every check will be put into place by this government to ensure only those invaders diagnosed ( who’s paying for that I wonder?) with a recognized mentally disorder ( is depression a mental disorder? Just wondering) by a licensed physician will be the rule rather than the exception.
