13 states urge court to uphold Ariz. immigration law

JEFFERSON CITY, Mo. - A coalition of 13 states has asked the U.S. Supreme Court to uphold an Arizona law penalizing businesses that knowingly hire illegal immigrants.

The Supreme Court is to hear arguments next month on the 2007 Arizona law, which allows business licenses to be revoked or suspended when employers are found to have knowingly hired illegal immigrants. Similar laws are in place in several states.

Businesses and civil rights groups have challenged the Arizona law by contending it infringes on federal immigration powers - an argument rejected by the 9th U.S. Circuit Court of Appeals in September 2008.

A coalition led by Missouri Attorney General Chris Koster released court documents Thursday arguing that states have long had the authority to license and regulate businesses. The states contend Congress specifically exempted state licensing laws in a 1986 federal law that prevents states from imposing civil or criminal penalties on businesses for illegal hirings.

"Those state laws complement, rather than replace, federal enforcement" of immigration laws, Koster wrote in the document filed Oct. 28 with the Supreme Court. "Indeed, absent this complementary approach between federal and state law, a significant deterrent to employing `unauthorized aliens' would be missing."

Other states joining Missouri's argument are Alabama, Arkansas, Kansas, Louisiana, Michigan, Mississippi, Nebraska, North Dakota, South Carolina, Tennessee, Utah and Virginia. The states are not parties to the lawsuit, but rather filed their legal brief as a suggestion to the court.

Their document cites laws in Missouri, Louisiana, Mississippi, Tennessee, Virginia and West Virginia that it says are similar to the Arizona law.

With the Republican takeover of the legislature on Tuesday - a 31-19 majority in the Senate - in January he will replace Democrat Marc Basnight as president pro tem of the state Senate.

Talking with Sen Berger I think things will change in NC. nomas. He had told me before that with the Democrats in charge they would not allow bills that dealt with the immigration (illegal) problem especially during this last short session

NO kidding and this state has been over run by illegal immigrants. They help them get fake ids here. Also get a copy of the food stamp application and read how it is worded to allow illegals access to food stamps. We are talking millions, not to mention over crowded schools, hospitals etc.

It is insane to hear schools griping about needing more money yet they will not bring up the fact that our schools would be fine if it weren't for being over run with illegal immigrants.

And appalling. Come January however since Republicans have won control of both houses of the NC General Assembly, things may well change and change a lot. We expect to have an AZ immigration law passed in North Carolina. We expect to have our state and local police officers arresting, detaining and arranging the deportation of illegal aliens from our state so Americans can get their jobs back, reflate their wages and have the means to support their families without the aid of public welfare programs.

This should be the goal of every state and something they rapidly achieve and complete by 2012. Our state and federal coffers have no more unemployment funds, or MediCaid funds, or education funds, or health care funds, or incarceration funds. We're broke and it's time to reverse the policies that caused this disaster and get Americans their jobs and wages back so they can get back to work.

Exactly. We'll have Republicans in charge of the NC General Assembly come January, and I believe we're going to see a lot of good changes especially in the area of stopping illegal immigration and getting NC Workers their jobs back.

Illegal aliens are the only ones who complain about SB 1070. Why? Because they do not have legal documents to stay in this country. So as I see it, across the United States we must have laws just like SB 1070. We must tell illegal aliens and potential illega aliens that we do not condone their illegal actions. We do not accept illegal aliens. WE already open our doors to over 3 million legal immigrants each year. We have to reduce that number. So we must not keep illegal aliens here (that is overpopulation). We must tell the politicians in DC that the GOP won on Nov 2, 2010 because Americans reject amnesty for illegal aliens.

We have a democrate governor in NC...................We will not see too much change until she is gone!!
