    After Libs Help Them Avoid Audit, California DMV Finds 23,000 Bad Voter Registrations

    “Trust us, we’re with the government.” If there were ever a time to be leery of that promise, it’s now … and if there were ever a place, it would almost certainly be in big-government California.

    The west coast state — which has gone Democrat in every presidential election since the Reagan era — seems to be a test-bed for leftist policies, but the results of that liberalism ought to be a cautionary tale.

    Recently, California became the state with the highest poverty rate in the entire country, while deep blue cities like San Francisco are struggling with rampant homelessness and public health crises.

    Now there’s yet another big government failure to add to the list.

    According to The Sacramento Bee, the state has mishandled a staggering 23,000 voter registrations, leaving the system in turmoil with just two months before the midterm elections.

    “The California Department of Motor Vehicles … said the errors occurred within the state’s Motor Voter program — which allows eligible applicants getting a driver license to be automatically registered to vote,” explained the newspaper.

    In simple terms, thousands of people who were assured they were properly registered to vote when they visited the DMV weren’t entered correctly in secretary of state records.

    “The DMV said the errors stem from technicians toggling between multiple screens and registration information being improperly merged,” the report continued.

    That means that a huge number of voters could find out they’re not even on the voter rolls when they head to the polls, if the problem isn’t solved by November.

    In some cases, non-voters or people who aren’t even eligible to vote may have been registered when they weren’t supposed to be.

    “According to the agency, 1,600 residents did not complete a voter registration affidavit and had their information sent to the secretary of state, which maintains the state’s list of registered voters,” reported The Sacramento Bee.

    That’s particularly alarming when you consider that California allows and even encourages illegal aliens to obtain their driver’s licenses at the DMV.

    “More than 1 million immigrants in the country illegally have obtained special California driver’s licenses since the state first began issuing them a little more than three years ago,” reported The Los Angeles Times earlier this year.

    State officials insisted that none of those illegal aliens with driver’s licenses were improperly registered to vote during the widespread error … but then again, these are the same administrators who couldn’t use their computers properly in the first place.

    Also distressing is the fact that officials admitted that some voters had their party affiliation switched in the voter rolls. How potentially thousands of people switch from, say, Republican to Democrat on the database simply from “improperly merged” information is a bit of mystery.

    “We are committed to getting this right and are working closely with the Secretary of State’s office to correct the errors that occurred,” pledged DMV Director Jean Shiomoto, who was appointed by Democrat Governor Jerry Brown.

    But it was Democrats who almost certainly contributed to the problem to begin with.

    “With Democrats’ help in August, the department narrowly dodged a request for an audit into upper-level management,” reported the Bee. That audit would have looked into the competence of top officials who run constantly-criticized and problem-plagued DMV in California.

    “After two hours of debate, the request fell one vote shy. Assembly members approved the request, but three Democratic state senators did not vote, effectively killing the measure,” the newspaper pointed out.

    Judicial Watch Sues California and Los Angeles Over Dirty Voter Registration Rolls

    DECEMBER 13, 2017

    – Judicial Watch announced today that it filed a federal lawsuit against Los Angeles County and the State of California over their failure to clean their voter rolls and to produce election-related records as required by the federal National Voter Registration Act (NVRA) (Judicial Watch, Inc.et al. v. Dean C. Logan, et al. (No. 2:17-cv-0894). The lawsuit was filed in the United States District Court for the Central District of California’s Western Division on behalf of Judicial Watch, Election Integrity Project California, Inc., and Wolfgang Kupka, Rhue Guyant, Jerry Griffin, and Delores M. Mars, who are lawfully registered voters in Los Angeles County.

    Judicial Watch argues that the State of California and a number of its counties, including the county of Los Angeles, have registration rates exceeding 100%:
    Eleven of California’s 58 counties have registration rates exceeding 100% of the age-eligible citizenry.

    Los Angeles County has more voter registrations on its voter rolls than it has citizens who are old enough to register. Specifically, according to data provided to and published by the EAC, Los Angeles County has a registration rate of 112% of its adult citizen population.

    The entire State of California has a registration rate of about 101% of its age-eligible citizenry.

    Judicial Watch points out that this is due in part to the high numbers of inactive registrations that are still carried on California’s voter rolls:

    About 21% of all of California’s voter registrations, or more than one in five, are designated as inactive.

    California has the highest rate of inactive registrations of any state in the country…. Los Angeles County has the highest number of inactive registrations of any single county in the country.

    Although these inactive registrations should be removed after a statutory waiting period consisting of two general federal elections, California officials are simply refusing to do so.

    Judicial Watch explains that, even though a registration is officially designated as “inactive,” it may still be voted on election day and is still on the official voter registration list. The inactive registrations of voters who have moved to a different state “are particularly vulnerable to fraudulent abuse by a third party” because the voter who has moved “is unlikely to monitor the use of or communications concerning an old registration.” Inactive registrations “are also inherently vulnerable to abuse by voters who plan to fraudulently double-vote in two different jurisdictions on the same election day.”

    Judicial Watch sent a written request for public records on November 16, 2017, and another on November 29, 2017, seeking information about “the number of inactive registrations on the voter rolls in Los Angeles County,” but was told each time that there were no responsive records.

    Last summer, Judicial Watch sent a broader request for voter roll records that Los Angeles County and the State of California are required by the NVRA to keep and to make publicly available. Nothing was produced in response to this request. Judicial Watch points out that it is impossible to believe that there were no responsive records:

    Los Angeles County, with over five million active voters and massive list maintenance responsibilities, and the Secretary of State of California [must] have exchanged emails responsive to [Judicial Watch’s] request for “all email or other communications between the Secretary’s Office and all California County voter registration officials concerning . . . [i]nstructions to the counties concerning their general list maintenance practices and obligations” and “[n]otices to the counties concerning any failure to comply with their voter list maintenance obligations.” Such emails should have been produced.

    Section 8(a)(4) of the NVRA requires states to implement a program to remove ineligible registrants; and to turn over relevant records and information. Judicial

    Watch argues:

    Los Angeles County is failing to properly conduct the list maintenance required by the NVRA by failing to properly train employees, failing to require and enter registrants’ birthdates, and failing to timely process reports that registrants have died, have committed disqualifying felonies, are mentally incompetent, or have registered twice.

    Judicial Watch asks that the court enjoin Los Angeles County and the state of California from further violating the NRVA, and compel them to “develop and implement a general program that makes a reasonable effort to remove from Los Angeles County’s rolls the registrations of ineligible registrants.” Judicial
    Watch asks to inspect and copy the requested voter roll records.

    Judicial Watch sent a notice-of-violation letter in August 2017 to threatening to sue California and certain of its counties over their violations of the NVRA.

    California was one of 12 states to receive such letters from Judicial Watch.

    “California may have the dirtiest election rolls in the country,” said Judicial Watch President Tom Fitton. “Federal law requires states to take reasonable steps to clean up their voting rolls. Dirty voting rolls can mean dirty elections. This lawsuit aims to ensure that citizens of California can have more confidence that their elections are fair and honest.”

    Judicial Watch Senior Attorney and Director of its Election Integrity Project Robert Popper recently provided testimony to the Presidential Advisory Commission on Election Integrity concerning the NVRA. Popper was formerly Deputy Chief of the Voting Section of the Civil Rights Division of the Justice Department.

    Judicial Watch sent notice-of-violation letters threatening to sue 11 other states having counties in which the number of registered voters exceeds the number of voting-age citizens, as calculated by the U.S. Census Bureau’s 2011-2015 American Community Survey: Alabama, Florida, Georgia, Illinois, Iowa, Kentucky, Maryland, New Jersey, New York, North Carolina and Tennessee. Judicial Watch informed the states that should they fail to take action to correct violations of Section 8 of the NVRA, it would file suit.

    Judicial Watch previously filed successful lawsuits under the NVRA against Ohio and Indiana that resulted in those states taking several actions to clean up their voting rolls. Judicial Watch is currently suing Kentucky over its failure to remove ineligible voters as required by the NVRA, and is suing the State of Maryland and Montgomery County over their failure to release voting-related records.

    Tens of thousands of Californians have been registered to vote incorrectly by the state Department of Motor Vehicles, including some who were assigned the wrong political party preference, officials said Wednesday.


    Officials insist the errors were limited to 23,000 of the 1.4 million voter registration files sent to elections offices between late April, when California's new automated "motor-voter" system went into effect, and early August.

    Californians who were affected will soon receive notifications in the mail instructing them to check their voter registration status.


    "We are committed to getting this right and are working closely with the Secretary of State's office to correct the errors that occurred," Shiomoto said in a written statement. Tong declined to comment beyond the letter.

    Jean Shiomoto, the state's DMV director, and Amy Tong, director of the California Department of Technology, described the problem as "an administrative processing error" in a letter to Secretary of State Alex Padilla, California's chief elections officer.

    The errors, which were discovered more than a month ago, happened when DMV employees did not clear their computer screens between customer appointments.

    That caused some voter information from the previous appointment, such as language preference or a request to vote by mail, to be "inadvertently merged" into the file of the next customer, Shiomoto and Tong wrote. The incorrect registration form was then sent to state elections officials, who used it to update California's voter registration database.


    A small number of the mistakes -- officials estimated around 1,600 -- involved people who did not intend to register to vote.

    State officials said no people in the country illegally -- who are eligible to get a special driver's license in California -- were mistakenly registered to vote.

    An unknown number of errors included voters whose political party preferences were changed without their consent. Officials did not provide additional details about the errors they uncovered during a month long investigation.


    State officials said they found the errors by comparing DMV records, which had the correct information, with what was sent to elections officials. Californians also undoubtedly saw mistakes in their mailbox: Anyone who registers to vote is sent a card with their registration information.


    Officials said Wednesday that a fix has been put in place to prevent additional mistakes.


    The mistakes came less than four months after other problems surfaced with the rollout of California's motor voter system, mandated by state law to register any U.S. citizen to vote who applies for or renews a license at the DMV. That error -- potentially thousands of cases in which multiple registration documents were generated for a single voter -- was caught before the June primary. The timing of the new error, officials said, should not cause problems for any Californian who changes registration information before the November election. County elections officers across the state were also briefed Wednesday.


    Padilla, who said he was "extremely disappointed and deeply frustrated" with the mistakes, said he remains confident in the ambitious new voter registration program.


    "I hope this doesn't detract from the otherwise overwhelming success that motor voter has been," he said.


    The mistake also comes at an inauspicious time for California's motor vehicles agency, which is the focus of widespread criticism for long lines that formed at many of its field offices over the summer. Officials have scrambled to bring in several hundred additional workers to shorten the waits, the agency announced Wednesday ahead of the announcement about the voter registration mistakes.


    In the letter sent to affected DMV customers, Shiomoto said she "sincerely apologizes for this inconvenience" and urged voters to check their registration status online.
