    Alamance Sheriff won’t rejoin 287(g), but could still hold ICE detainees

    GRAHAM — Alamance County Sheriff Terry Johnson will not be entering an agreement with Immigration and Customs Enforcement to rejoin the 287(g) program, but will possibly go back to holding ICE detainees in the county jail.

    “The Sheriff has no intention of entering into an agreement for 287(g),” Kirk Puckett, public information officer for the Alamance County Sheriff’s Office, wrote in an email to the Times-News.

    The sheriff is considering going back to housing ICE detainees in the county jail, which it did from 2007 until a federal lawsuit in 2012.

    “We have recently been in conversation with ICE renegotiating the rate we would be paid to house those individuals in our jail,” Puckett wrote.

    A protest by Downhome N.C. and Siembra is planned for 6 p.m. Monday, Nov. 19, on Court Square in Graham to oppose the plan to “rent space in the Alamance jail to ICE,” according to a post on the Siembra N.C. Facebook page. The county commissioners are holding their regular meeting at 7 p.m. Monday at the Alamance County Historic Courthouse, and Johnson will make a presentation, though not on 287(g).

    The Sheriff’s Office was among the first to join the federal program geared toward identifying undocumented immigrants entering the county jail, often leading to deportation, and housing inmates for ICE. There was also a local deputy trained to work with ICE on local immigration enforcement.

    After a lawsuit brought by the U.S. Department of Justice in 2012 alleging racial profiling by the sheriff’s office, Alamance County’s involvement in the federal program was terminated under the administration of President Barack Obama. A judge later ruled in Johnson’s favor, but only after years in court and, by most estimates, hundreds of thousands of dollars spent.

    The Trump administration invited the ACSO to reapply last year. It was only a matter of working out the memorandum of understanding, though Johnson was well aware of the potential backlash.

    There have been several protests in the past few months against the ACSO rejoining the program from groups including Downhome N.C. Alamance Chapter, the Alamance Chapter of the NAACP, LUPE (Latinos United Promoting Hope), Fairness Alamance, the American Civil Liberties Union of North Carolina, Alamance Peace Action and Siembra at county commissioners meetings and elsewhere.

    That's a shame. Better than the 287 (g) program really is just an Executive Order or Proclamation whichever is most appropriate for a declaration by the President on behalf of all agencies of the United States government that under US law the federal government acknowledges the rights of state and local law enforcement agency to engage in the enforcement of US immigration law and are hereby specifically authorized to do so without fear of retribution imposed by the federal government.
