    Judge: Obama's Aunt Can Stay in U.S. Until 2010

    BOSTON, April 1 -- Barack Obama's Kenyan aunt can remain in the United States until an immigration hearing in February, when a judge will consider her latest argument against deportation back to Kenya.

    Using a cane and wearing a rusty brown wig, Zeituni Onyango said, "Praise God," after she stepped out of a closed hearing before the same immigration judge who twice has ordered her deported.

    Onyango, 56, was then whisked into an elevator by federal law enforcement officers, and she left the premises without speaking to reporters.

    At the 10-minute proceeding, the immigration judge, Leonard Shapiro, scheduled a full hearing with witnesses for Feb. 4, 2010.

    In 2002, Onyango, the half-sister of Obama's late father, first applied for political asylum "due to violence in Kenya," according to a statement released by her attorneys after the hearing.

    Her attorneys won't discuss the new evidence they plan to present in arguing for asylum, saying only that the immigration lawyers hired by Onyango's relatives in Cleveland are "working hard to keep matters in the court system and towards a favorable outcome for Ms. Onyango."

    Onyango was first ordered to appear in court for violating immigration laws in March 2003, said Fatimah A. Mateen, a spokeswoman for the Executive Office for Immigration Review. Shapiro turned down her first bid for asylum and ordered her deported the following month. After a series of requests and appeals ultimately were denied, Onyango again was ordered to leave the country Oct. 16, 2004.

    But the former computer programmer who suffers from a neurological condition has quietly remained in the country living in state-subsidized public housing in South Boston. In October, just weeks before the presidential election, her presence garnered international media attention.

    The Bush administration issued an order Oct. 31 barring government agents from deporting anyone without clearing it with the White House.

    That inflamed activists against illegal immigration, who already were criticizing what they saw as favoritism toward a relative of then-Democratic nominee Obama.

    As William Gheen, head of Americans for Legal Immigration, said, "Obama's Aunt Zeituni has lost in court several times before while continuing to soak up taxpayer benefits."


    Obama has said he did not know that Onyango was living in the country illegally and that relevant laws should be obeyed. The White House has declined comment on the case, saying only that Obama has not intervened on her behalfand will not do so.

    Onyango first visited the United States in 1975 when she was 23 years old, according to her attorneys, and received a Social Security card in 2001. She was a legal resident seeking refuge when she applied to live in a public housing project in South Boston in 2002, according to her attorneys.

    Kenyans do not account for many of the asylum seekers living in the United States -- 343 in fiscal year 2008, of whom 60 were granted asylum. By comparison, there were 9,250 asylum requests from China and 6,424 from El Salvador.

    i can see it now, this will be the reason for letting her stay.

    whatcha wanna bet? they wil say she cant get the same medical care that shes getting at taxpayer expense here in the US

    Does this mean she goes back to her free living pad in Boston?

    And who paid for her "Security detail"?

    I think this is the only law on the books in America where instead of getting a contempt of court citataion ya just get another opportunity to see another judge until ya get one that gives you a ruling that ya like,

    Here this woman was told TWICE to leave the country and years later we are still screwing around with her and supporting her??????

    And, I suspect, that has been the case all along.

    Are we supposed to believe for a second that obama didn't know this woman was here, or that it was mere coincidence that in the Land of Teddy K.....a good pal 'o obama........she was not only living in subsuduzed housing but also EMPLOYED by the Housing Authority?

    Her latest argument! What's this, her third, or forth bite at the citizenship apple? Is she going to be allowed to continue to make arguments until she finally gets it right?

    The only thing which has changed is her nephew is now POTUS! You think that might help bolster her argument to remain in this country!
