Man pleads innocent to sexual assault of girl

DE QUEEN, Ark.—Juan Mosqueva, 36, of De Queen pleaded innocent Thursday in Sevier County Circuit Court to second-degree sexual assault charges in the case of a 15-year-old female.

Ninth Judicial District Court Judge Ted Capeheart scheduled a pretrial hearing for April 12 and a trial date for April 25.

Capeheart appointed De Queen attorney and public defender Norman Cox to represent Mosqueva.

The second-degree sexual assault charge is a Class B felony with a potential sentence of five to 20 years in prison and a maximum fine of $15,000.

Mosqueva remains in the Sevier County jail with a $100,000 bond.

The De Queen police received a telephone call about a possible rape and went to the residence of Mosqueva Jan. 4. Officers asked him to come with them to the police department for an interview. Mosqueva was read a Miranda warning in Spanish and agreed to answer questions.

He was questioned by officer Ernesto Echevarria and Lt. Sean Martin and admitted to having sex with the 15-year-old female. He was then taken to the Sevier County jail.

Mosqueva is a Mexican national, and the Immigration and Naturalization Service has been contacted for further investigation, said De Queen Police Chief Richard McKinley.

Sevier County Circuit Clerk Laurie Green said the INS has asked for a hold on Mosqueva after he has completed the judicial process.
