    Arizona immigration law cases continue

    7 lawsuits against state's immigration law working way through court

    Seven lawsuits were filed in federal court challenging the constitutionality of Senate Bill 1070. Most of them argued that immigration regulation is the jurisdiction of the federal government and not the state, and that SB 1070 could lead to racial profiling and violate individuals' constitutional rights.

    The court has issued various rulings in recent weeks. Here's an update on where the cases are in the legal process:

    - U.S. Department of Justice lawsuit: This case is on two separate tracks. The full case continues to move forward under U.S. District Judge Susan Bolton. She dismissed some of the federal government's arguments but allowed others to stand. Written arguments have been filed, but no hearings have been scheduled.

    Earlier this year, Bolton issued a preliminary injunction in this case that halted the enforcement of four parts of SB 1070, including the portion of the law that requires a police officer to verify a person's status when there is reasonable suspicion that the subject is an undocumented immigrant. Gov. Jan Brewer is appealing the injunction to the U.S. Court of Appeals for the 9th Circuit. The court heard arguments Nov. 1 in San Francisco but has not yet issued a decision.

    - Non-profits and individuals lawsuit: Bolton dismissed some claims and allowed others to stand in the lawsuit filed by the American Civil Liberties Union of Arizona and several other organizations on behalf of a number of individuals and non-profit groups. Written arguments have been filed, but no hearings have been scheduled.

    - Tucson police officer lawsuit: Bolton dismissed the case filed by Officer Martin Escobar and the city of Tucson. Escobar is appealing to the 9th Circuit.

    - Phoenix police officer lawsuit: Bolton dismissed the case filed by Chicanos por la Causa and Officers David Salgado, Corbet Clack and Paul Dobson. No appeal has yet been filed.

    - Washington, D.C., resident lawsuit: Bolton dismissed a lawsuit filed by Washington, D.C., resident Roberto Frisancho alleging that he could face discrimination under the law if he traveled to Arizona. Frisancho is appealing to the 9th Circuit.

    - Clergy lawsuit: Bolton dismissed the lawsuit filed by the National Coalition of Latino Clergy and Christian Leaders. No appeal has yet been filed.

    - LULAC lawsuit: Bolton dismissed the lawsuit filed by the League of United Latin American Citizens Arizona. No appeal has yet been filed.

    We should pass the FairTax and shut down these phony "charities" operating under 501 C 3 status when they are actually polical action orgies, and not charities at all.
