    Undocumented Worker Wins $100K From Butler Co.

    BUTLER COUNTY, Ohio -- An undocumented worker has won a six-figure settlement against Butler County after a sheriff’s office raid at his work site.

    Luis Rodriguez was hanging drywall at a construction site on Port Union Road in Hamilton when deputies rounded him up with more than 20 Hispanic workers in January 2007. They arrested Rodriguez based on documents he had but lost the criminal case against him.

    While in custody, Rodriguez was deported to Mexico, along with his wife and two children. The family had lived in Southern Ohio for 11 years, working and attending a local church that was very supportive of the family. They now live in poverty in Mexico, according to attorney Al Gerhardstein. He sued Sheriff Richard Jones on behalf of Rodriguez. Sheriff Jones has been outspoken about his opposition to undocumented workers.

    Gerhardstein claimed the sheriff’s office violated the Fourth Amendment when deputies “seizedâ€

    Gutless stupid cowards, Butler County. You stupid stupid stupid people. Your Sheriff did indeed have the legal authority to enforce US immigration law. What is wrong with you morons? You do something right and then screw it up by sending another $100,000 out of our country on the tails of illegal aliens?



    Here is the federal law that authorizes any police officer whose duty it is to enforce criminal law (meter maids excepted) to arrest an illegal alien:

    USC TITLE 8 > CHAPTER 12 > SUBCHAPTER II > Part VIII > § 1324
    § 1324. Bringing in and harboring certain aliens

    (c) Authority to arrest
    No officer or person shall have authority to make any arrests for a violation of any provision of this section except officers and employees of the Service designated by the Attorney General, either individually or as a member of a class, and all other officers whose duty it is to enforce criminal laws.
    Do you see it? "and all other officers whose duty it is to enforce criminal laws." That's you, your sheriffs, your state patrols, your municipal police departments. You just threw away $100,000 out of complete and total ignorance.

    The taxpayers of Butler County should throw you all out of office for being this derelict and irresponsible with their money and making it look like your Sheriff did something wrong, when he in fact was doing it right.

    The citizens of Butler County should put a hold on the transfer of funds for this settlement on the basis that Butler County has absolutely NO AUTHORITY to use taxpayer funds for such a settlement with any illegal alien for any reason. In fact, it can argued that a county has NO AUTHORITY to pay illegal aliens any money even if a Judge orders it. This money doesn't belong to the Judge, it belongs to the citizens of Butler County for Butler County. Period.

    This article bewilders me to the fullest extent. How can an illegal alien that knowingly violated so many laws be rewarded like this. This is unacceptable. Butler Counter needs new government offcials.

    Yes they do, JSealsx. Just absolutely infuriating, and states should immediately pass laws prohibiting the payment of county or municipal funds to illegal aliens for civil litigation. They can have their day in court if they want to pay for it, but they can't get any money to fund a judgment.

    If they win this case and get $100,000 (a FORTUNE) in Mexico, just watch the floodgates open with lawsuits all over the country from deported illegal aliens talking about their violated "rights."

    Wish we could stop this!

    Ditto Judy! And I would like to stress the part about Butler County being Gutless stupid cowards! The fact they would extend tax payer dollars at this illegal invader and his ambulance, chasing scum bag lawyer is criminal. This is nothing more than blackmail through the legal system.

    The floodgates have opened long ago and will continue to be open so long as we have millions of illegal invaders, as well as no shortage of pro-illegal invader organizations, ready,willing and able to provide legal assistance to these criminals.
    Illegal invaders are not bashful about finding their way to the courthouse steps, especially when they are being reminded of their so called "rights" by these same groups.

    Instead of being angry with the Sheriff or Butler Co. be FURIOUS with the attorney who filed this lawsuit or the fact he was allowed to file such a frivolous lawsuit.

    My guess is it was cheaper to pay the money then fight this in court.By settling early I am sure it saved Butler County and taxpayers a ton of money.

    I agree it does set a dangerous precedent and our laws must be changed to stop IA's from filing these type of lawsuits.

    I'm furious with both Butler Co. and the lawyer who filed this case on behalf of an illegal invader. All civil cases are generally cheaper to settle than to take to trial, so this is really not a compellling argument in support of settlement. If that were the benchmark, no case would go to trial.

    However, none of this is lost on the ambulance chaser who filed this case. He knows that Butler Co. would not want to take the time to go to trial in such a case, especially when their docket is loaded with other cases. He knows it will be a quick score, even if the law is not on his side.

    So he files the case, conducts discovery, files motion for summary judgement and accepts the $100,000 grand offered by the county - of which he will likely keep 40% and the invader keeps the remainder.

    This attorney has probably made a very good living being a bottom feeder.
