AZ, Secretary of State certifies ballot measure
Proposition 202; Stop Illegal Hiring. An initiative designed to crack down on unethical businesses who hire illegal immigrants. This initiative targets employers who hire workers and pay under-the-table in cash, which fuels illegal immigration in Arizona. It revokes the business license of employers who knowingly or intentionally hire illegal immigrants. This initiative increases penalties for identity theft, as illegal immigrants often use stolen identities to conceal their undocumented status. Fines collected as a result of this initiative will be distributed to schools and hospitals to help deal with the financial burden placed on Arizona because of illegal immigration.

Hooray they got enough signatures to get it on the ballot.It will be very telling how it does and how many votes it gets.

At the moment, these employers can simply complain that they weren't document experts and didn't use EVerify to check anything. Stupidity doesn't work well as an excuse with the IRS, but it could work here.

Prop 202 needs to be defeated
Well, let's start with Sproul, a Republican operative who chairs Mesa Deserves Better and is working on Prop. 202, which seeks to weaken the state's employer-sanctions law.
And the people behind Prop. 202? Wake Up Arizona!, a business coalition led by Mac Magruder, who owns a string of McDonald's, and Jason LaVecke, who owns Arizona's Carl's Jr. and Pizza Patrón franchises.
Proposition 202 would undo some of the provisions of the employer sanctions law approved last year by state lawmakers.
The measure, dubbed Stop Illegal Hiring, contains the same penalties as the state law which took effect Jan. 1. It allows a judge to suspend all state licenses of any firm found to have knowingly hired an undocumented worker; a second violation within three years results in license revocation.
But this version would require prosecutors to prove that the owner or an officer of the company have "actual knowledge" that a worker is here illegally.
It also would provide absolute immunity to firms that either use the federal E-Verify system or simply comply with existing federal laws about checking the identity of new workers.
That law requires only that employers attest on the I-9 form that the applicant "is eligible to work in the United States," and, if documents have been presented, that they have been examined and "appear to be genuine and relate to the individual."
