    Arizona’s new immigration law may have been aimed at deporting as many illegal immigrants as possible, but an ironic side effect will allow more undocumented residents to apply for temporary work visas and permanent U.S. citizenship, according to research by the Arizona Capitol Times.

    The new law will add to a processing backlog that already has caused federal authorities to release an increasing number of illegal immigrants back into the U.S. to await deportation hearings. And if nationwide figures can be applied to Arizona, one in four of those who are released from federal custody fail to appear in court.

    The arrest-and-release policy is a little-known part of federal immigration law that allows illegal immigrants to challenge deportation and obtain legal residency, and a driver’s license, as long as they meet certain conditions. If more illegal immigrants are apprehended and processed through the federal system – which is expected to happen after Arizona’s immigration law takes effect on July 29 – then an even greater number would qualify for legal status.

    I really don't have a big problem with this, given the current circumstances. As it states, they will have to pay a bond. This bond amount isn't much different than what they willingly paid a coyote to get them to the U.S. If they don't want to pay the bond amount in order to go before a judge, than I guess their only option is to accept the deportation.

    Some will choose this path, some won't, but either way, they are no longer an unknown element in the shadows. They'll have to provide addresses and keep their noses clean while waiting for court rather than stay hidden and commit more crimes.

    So this may not be all that bad. Think about it.

    I agree Mapwife.

    Although they did not mention in this article if the IA's refuse to be deported don't they have to sign a statement they will be banned for 10yrs. if they lose in immigration court ?

    IMO, no immigrant in this country illegally should ever be rewarded. The consequences of illegally entering this country range from deportation at a minimum to prison time at a maximum. Criminals should never be rewarded, especially with that of which they were seeking in the first place!

    Illegal immigrants who are released on bond may receive temporary work visas that are valid for one year. In many cases, the one-year visas are extended several times due to the backlog in federal immigration courts, which have been overcrowded for years because there are only five immigration judges in the state – three in Phoenix and two in Tucson.
    I have a huge problem with it. Those are jobs that are supposed to be filled by Americans, not illegal aliens "out on bond" awaiting a deportation hearing for years. That makes an utter joke out of federal law enforcement and federal court procedures.

    Americans pay taxes and have laws to secure our borders, yet the federal government takes our money, ignores our laws and fails to secure our borders.

    Then the federal government says it's not their fault, because the laws are broken. Then, the whole thing can start over again and keep repeating itself in perpetuity until we're the World's Largest Bankrupt Impoverished Banana Republic on the planet.

    Arizona needs to establish state detention facilities that are of the sort associated with Joe Arpaio it has a deterent effect and encourages them to engage in their own self removal.

    I agree MW. With 30 million unemployed Americans you don't give out work permits and citizenship like candy from a pez dispenser. You NEVER reward anyone who violated our laws, borders, sovereignty and used stolen and fraudulent identities to obtain jobs and benefits as this condones even more illegal immigration. We have too many Americans including veterans losing their homes and jobs but spend hundred of billions of dollars on illegal alien border hopping bugs and the cost increases as thousands more illegally scurry across the border every week. I said it before and I will say it again. This government does not give a damn rat's ass about suffering and struggling Americans. It is all about open borders and cheap labor for their union, corporate, multinational, UN, Chamber of Commerce, Soros and other special interest masters and more voters to keep their corrupt asses in power for eternity. The American people have been screwed by the pooches in DC.

    Don't get me wrong. Ideally I would want a round-up and mass deportation, but nobody will do that as we've seen. If they must pay a bond, that isn't a reward. If they can't pay a bond, they don't even get that option of waiting for a court hearing. If they do pay the bond and get the court hearing, nothing says that they will get the ruling in their favor and if they lose, they will be deported then.

    A repeat border crosser was sentence in AZ a day or so ago to 8+ years in prison for violating his previous deportation order. That is what I call justice.

    There are both advantages and disadvantages to this.

    First the advantages:

    A dramatic increase of the Illegal Alien population will be put through the system. They will be fingerprinted and a Rap sheet will be generated for them. So if they commit any other crimes it will be easier to catch them since we will have their fingerprints in the system.

    If they are issued Employment Authorization while they are going through Deportation proceedings, they will be issued a social security number and have Federal and state income tax witheld from their salaries.

    Most of the illegals will not be eligible under current law for Permanent Residency. Only those who can prove they have been in the U.S. for more than ten years, have committed no other crimes, have U.S. Citizen children, and are the sole caretakers for their children will be eligible for Permanent Residency. Most Mexicans will not be eligible for Political Asylum.

    Disadvantages:

    Most illegals without other Criminal Convictions will be eligble to be released from Federal custody either on bond or on their own recognizance. While out on bond or ROR, they can continue to have anchor babies, making it more difficult to have them deported.

    In addition, most of these illegals without a criminal record will be permitted to Voluntarily Depart the U.S., which is different from being Deported or Removed. If they are granted Voluntary Departure by an Immigration Judge, and depart the country, if they illegally reenter the U.S. subsequent to that departure, there will be no reprocussions. They cannot be Federally prosecuted for the illegal reentry under 8 USC 1326 unless they reentered subsequent to being actually deported. So most will probably just accept VD and then just sneak back into the country afterwards.

    Finally, most will abscond and not show up for court, get ordered deported In Absentia, however the good thing about this is that they will never be eligible for any type of amnesty, Permanent Residence, etc. in the future.

    DETENTION CENTERS

    I AGREE RICHARD. ARIZONA NEEDS A DETENTION CENTER TO HOLD THE ILLEGALS UNTIL ICE PICKS THEM UP.
