Bail denied to Omaha man accused of killing 21-year-old near 36th and H Streets

A judge Tuesday denied bail to a 21-year-old man from Mexico who is charged with killing a man in South Omaha.

Benjamin Guevara is charged with first-degree murder and use of a firearm to commit a felony in connection with Saturday’s slaying of Oziel Vazquez-Serrano, 21.

Police said Vazquez-Serrano was shot around 6:30 p.m. inside a car parked near 36th and H Streets. He then was pulled from the car and left in the street to die, police said.

Stephanie Hansen, a Douglas County Court judge, said she denied the bail in light of the serious charges against Guevara. Guevara faces up to life in prison if he’s convicted on the murder charge and up to 50 years on the gun charge.

Eric Fabian of the Douglas County Attorney’s Office said Guevara, who used an interpreter in court, is from Mexico.

“It’s currently unclear whether he’s legally in the United States,” Fabian said.

Fabian said witnesses spotted Guevara pulling a person from a car, and they gave a license plate number to authorities. Police, he said, tracked the number to an address in northeast Omaha near 40th and Browne Streets, where Guevara told officers they could find a .40-caliber handgun hidden in nearby trees and an ammunition clip on a porch.

Fabian also said blood was found on Guevara’s pants and in his car. Shell casings were left in the car, which had holes from bullets fired from inside.

Fabian said Guevara has a misdemeanor conviction from 2014 for having an unregistered handgun.

A public defender said Guevara has lived in Omaha for the past 10 years and has joint custody of a son.

Too many of these murdering criminals in our prison, we need to go back to hanging at sunrise.

I do not want to pay for these people to rot in jail for the next 50 years!
