    17 year old Illegal Immigrant Accused of Killing Man While High

    ELKHORN - A 17 year old teen from Milwaukee accused of kiling a Delavan man while driving high on marijuana is an illegal immigrant.

    Donovan Espinosa made his first court appearance in Walworth County today accused of killing 41 year old Dean Schumacher Tuesday morning after Espinosa blew through a stop sign.

    Prosecutors say Espinosa was driving through Walworth County at 4am after smoking marijuana.

    They also say he was driving with an invalid license because he's in the states illegally.

    He's also accused of driving with stolent plates and carrying a concealed weapon. Deputies found a knife in his car.

    Schumacher was on his way to work as a truck driver when Espinosa hit the driver's side of his pick up truck.

    Schumacher's family say he's a hard working who would do anything for anyone and for them to learn the person accused of killing their loved one wasn't even suppoosed to be here makes this all even more devestating.

    "All the defendant had to do is not smoke marijuana and he (Shumacher) might be here.

    All he had to do is not be here illegally and he (Schumacher) might be here.

    All he had to do is see the stop sign and my brother would be here, said his sister who wished not to be identified.

    Espinosa is being held on 100-thousand dollars bail and sits in the Walworth County jail.

    WE lose another GOOD, HARD WORKING, American. HE just wanted to make a better life for himself. How many more of us have to be killed before the Politicians sit up and notice?

    It almost seems like they are blaming just marijuana for the murder, but chances are this scumbag would've committed murder regardless.

    .....I think it's time to start sending every single one of these crime reports to the WHITE HOUSE and to OBAMA.....he needs to take action regarding the border and ENFORCEMENT NOW.....instead of conducting witch-hunts against Arpaio and law enforcement departments that are overwhelmed and under-armed compared with the cirminal illegal aliens. In this case, a secure border and serioius interior enforcement could've prevented this illegal from re-entry, and/or at least nabbed him as a fugitive. Unfortunately, OBAMA's staff has dozens of open-borders, pro-illegal alien policy makers on his staff.....even former LA RAZA lobbyists like Cecilia Munoz who was given an ethics waiver (because it was against ethics to hire her in the first place).

    Tyche Hendricks of the San Francisco Chronicle offers "Stanford professor leads Obama immigration team" (link), with the news that Tino Cuellar - law professor at Stanford University - has been named as one of the two co-leaders of Barack Obama's transition team dealing with immigration. In the article, he's praised by John Trasvina of the Mexican American Legal Defense and Educational Fund, which, in case you needed one, isn't a good sign. Cuelar also worked for two years on money-laundering causes at the Treasury Department during the Clinton administration. And, the American Bar Association apparently recently suggested him as one possibility to head the U.S. Citizenship and Immigration Services (USCIS).

    The other co-leader is Alexander Aleinikoff, dean of Georgetown University Law Center, who was Executive Associate Commissioner of Programs at the Immigration and Naturalization Service (INS) during the Clinton years. He's also associated with the Migration Policy Institute.

    How much more are we expected to pay as a nation in order to accommodate those who are only coming here seeking a so called, better life? How many more Americans have to die at the hands of illegals before our leaders acccept the fact that this illegal quest for a better life is having devastating consequences on hard working AMERICANS, who are also being prevented from seeking a better life because they are either dead or have had their family ripped apart at the hands of an illegal invader.

    It's apparent that illegals, in their pursuit of a better life, are in direct conflict to this country and her citizens who have an inalienable right to life, liberty and the pursuit of happiness!

    When is something going to be done that does not include giving law breakers amnesty, a pathway to citizenship, or any other politically correct term you chose to frame the rewarding of those who have entered this country in violation of Federal immigration law with the greatest privilege on this planet. The right to legally call this country your home!

    I wonder what name he has on his license. And where did he get one? In Maryland where they hand them out to everyone if they can show a damn utility receipt?

    I think you're right. We need to start an email campaign and get it posted on other related groups' sites as well. Let's send them all the stories we get each day/week...whatever...about crimes committed against citizens of this nation by people who should not even be here.

    What does everyone else think about this idea? How hard would it be to get it posted on other sites? Our groups have accomplished some things that should have been impossible, just by working together as a team and I think Legalatina has a great idea here.

    Illegal immigrant sentenced following fatal crash

    Elkhorn — A 18-year-old illegal immigrant who while driving stoned blew a stop sign and killed a man will spend the next 10 years in prison.

    When Judge Michael Gibbs announced Donovan N. Espinosa's sentence of 20 years — 10 years of initial confinement and 10 years of extended supervision — the family of his victim, Dean A. Schumacher, applauded and shouted "thank you."

    While on the other side of the packed courtroom members of Espinosa's family cried.

    "The public has the right to be safe from stoned punks driving around in the early hours," Gibbs said. "The public is sick of these kind of things."

    On March 10, police responded to an accident at 3:52 a.m. on Highway 11 and Bowers Road. Espinosa blew a stop sign while driving south on Bowers Road and hit Schumacher's vehicle.

    When police arrived to the scene, Schumacher was pronounced dead.

    Espinosa has no driver's license and has never been trained to drive a vehicle.

    That night he had stolen his mother's car and planned on driving from Milwaukee to California to live with his father.

    He said he took the Bowers Road exit looking for a place to get food or to sleep.

    District Attorney Phillip Koss said during the sentencing hearing that Schumacher was a hard-working man who supported his family and that his life was ended because of Espinosa's irresponsible actions.

    "This could have been anybody. This is playing Russian Roulette out on the roadway," Koss said.

    Koss said the family has further suffered because Espinosa has shown no signs of remorse.

    Espinosa's attorney, Christopher L. Kuehn, argued for a shorter sentence

    Kuehn said that Espinosa has very minimal intelligence.

    "His complete lack of remorse goes to the concept of his lack of mental faculty," he said. "He clearly doesn't understand his actions."

    Kuehn said Espinosa lives in a "fantasy world" and that he "wants to be considered more serious than he is."

    "I'm scared for Donovan, I'm scared for what will happen to him," he said.

    He also said the amount of marijuana that was found in Espinosa's system was minimal. The state crime lab performed a test that showed the amount of marijuana that was in Espinosa's system at the time of the accident. Kuehn cited a study that stated that amount of marijuana would be similar to a blood alcohol level of 0.03.

    After the accident, Walworth County Sheriff's Department Deputies didn't perform field sobriety tests, which Kuehn argued further demonstrated that Espinosa had a minimal amount of drugs in his system.

    After his arrest, Espinosa's behavior didn't help his case. While in the Walworth County Jail, he has been written up 19 times, according to Koss.

    When he was interviewed by pre-sentence investigators he didn't answer questions appropriately and laughed when asked if he had a problem with drugs or alcohol.

    "He apparently believes he is above the law and doesn't believe he has to obey the laws of our society," according to the PSI report. "He is faking bad."

    He also is a self-proclaimed member of the Spanish Cobras. The PSI writer wrote that Espinosa said this with "a great deal of pride."

    However, Kuehn said the Milwaukee Police Gang Unit had never heard of the sect or division of the gang Espinosa claimed to be from. They also had never heard of Espinosa.

    Gibbs didn't buy Kuehn's arguments.

    "Dean Schumacher's family doesn't get to look at him and visit him in prison," Gibbs said. "It wasn't an accident — it was a homicide."

    Gibbs said although Espinosa may have minimal intelligence he believes he knows right from wrong.

    "You know causing someone's death is wrong," Gibbs said. "You are a dope-smoking gang-banger that decided one day you were going to steal your mom's car and go to California."

    Gibbs said Espinosa's demeanor in the court has been strange and that during court proceedings Espinosa would give Gibbs a "hard-eye"

    "There is no question he is an odd man," Gibbs said.

    When Espinosa was given a chance to speak he said he was sorry for the accident.

    He also told the PSI writer that he felt bad for his crime.

    "I'm kind of sad about the accident," Espinosa said. "I want the family to know that I'm sorry and that is it."

    "10 years of initial confinement and 10 years of extended supervision"


    Why is this illegal not getting deported after he serves his 10 years in confinement? Why should he get "extended supervision" instead of getting deported? He will be let out on extended supervision to go and commit another crime on someone else.
