Border agent killed man climbing wall

PHOENIX - A Mexican man was climbing a ladder when a Border Patrol agent fatally shot him three times, a sheriff's spokeswoman told The Associated Press on Monday.
Cochise County sheriff's investigators have no indication that Carlos La Madrid, 19, assaulted or tried to assault the agent when he was shot March 21, said agency spokeswoman Carol Capas.
La Madrid had fled police in the Arizona border city of Douglas in a truck and drove to the border with Mexico. He was climbing a ladder and trying to cross the border, and another man atop the wall began throwing rocks at the pursuing agent, Capas said.
La Madrid was shot three times and died later that day at a local hospital. The man on the wall got away.
Capas did not immediately know where on La Madrid's body he was shot. The Cochise County Medical Examiner's Office would not release the autopsy results.
Capas said investigators found 48 pounds of marijuana in the back of the truck La Madrid was driving, indicating that he was a drug smuggler. A 17-year-old illegal immigrant who ran from the truck was arrested.
She declined to release the agent's name, citing the ongoing investigation. She said the agent was initially placed on administrative leave, but she did not know if he was still on leave.
Border Patrol spokesman Mario Escalante said that he was unable to comment on the matter, referring questions to the FBI.
"We can't talk about any details whatsoever," Escalante said. "We never provide names of our agents involved."
FBI spokesman Manuel Johnson in Phoenix declined to comment, citing the ongoing investigation.
The FBI's investigation is focused on the alleged assault of the officer, while the sheriff's office is investigating the actual shooting.
When the sheriff's office first reported the shooting, few details were released.
Capas said at the time only that "there were rocks thrown at the agent" and was unable to clarify whether La Madrid was the one throwing them.

Hello, drug smuggling may be profitable, but it's also dangerous, especially when you elect to elude law enforcement once you've been detected. This illegal alien drug smuggler was responsible for his own demise.
The responsibility for this incident rest with the smuggler, not the law enforcement agent who was attempting, in the performance of his sworn duties, to uphold the law.

DOUGLAS, Ariz. (KGUN9-TV) - On a windy Douglas day one week ago, Carlos Lamadrid was shot and killed by Border Patrol. But, in the days following, it was rumors and misinformation that swirled about how and why he was killed. Now, some answers from a Cochise County Sheriff's report
At first, officials said Lamadrid was shot three times. But, it turns out the 19-year-old was hit four times; three in the back and one that grazed his shoulder. And, unlike original reports, Lamadrid was not responsible for shattering a Border Patrol truck's windshield because officials now say he never threw any rocks. The report says Lamadrid was climbing a ladder, something his uncle said he already knew, "Somebody who is on top of the fence, where is he going to pick up rocks? Where's he going to put them? Does he have in a bag or in a box? I mean, where did he place them so he could be throwing the rocks? How could he be throwing rocks?," wondered Javier Teran.
Most recently, authorities also said Lamadrid was alone, but the report shows he was with 17-year-old Jesus Manuel Chino Lino. Lamadrid's family told KGUN9 they visited Chino Lino in jail, but Chino Lino told them he did not know Carlos. And, Lamadrid's family said it does not know how more than 48-pounds of pot got in Carlos' Avalanche; it's another fact Cochise County officials point out.
"Was Carlos trafficking or dealing in drugs?" KGUN9 asked. "No. I mean they were mentioning rocks being thrown and there were no rocks being thrown. And, they said there were no other subjects accompanying my nephew," Teran said, pointing out what he believes were numerous contradictions by law enforcement.
Lamadrid's uncle told us Border Patrol never expected Carlos to have a United States birth certificate, "He thought my nephew was an illegal, not a U.S. citizen or somebody else, like before...(he thought) it was an illegal and I can get away with it," added Teran.
Chino Lino remains in a Cochise County jail, charged with possession of marijuana with the intent to sell. Carlos Lamdrid was laid to rest in Mexico last Friday.
