Border agents' use of tear gas against migrant caravan did not violate policy: Audito

Border agents' use of tear gas against migrant caravan did not violate policy: Auditor

U.S. Customs and Border Protection’s use of tear gas against migrants attempting to rush the border between California and Mexico in 2018 and 2019 was within its legal bounds and did not violate human rights, according to a newly released government audit.

The Department of Homeland Security Office of the Inspector General concluded in a report released on Monday that CBP’s Border Patrol agents rightly used tear gas in incidents that took place on Nov. 25, 2018, and Jan. 1, 2019.

“CBP’s use of tear gas and other authorized less-lethal devices may have contributed to the deescalation of the dangerous situations, preventing further injuries to officers and Border Patrol agents, avoiding serious injuries to migrants, and possibly avoiding the use of deadly force,” the inspector general wrote in a report.

In the November incident, approximately 1,000 people who were among thousands who traveled in a human caravan from Central America to the northern Mexico city of Tijuana and jointly stormed the border near the San Ysidro port of entry south of San Diego. Border Patrol San Diego Sector Chief Patrol Agent Rodney Scott said at the time that the use of force was justified.

"What we saw over and over yesterday is that the group, the caravan as we call them, would push women and children to the front and then begin basically rocking our agents,” Scott said in a CNN interview. "The group immediately started throwing rocks and debris at our agents, taunting the agents, and once our agents were assaulted and the numbers started growing, we had two or three agents at a time initially facing hundreds of people at a time. They deployed tear gas to protect themselves and to protect the border."

On New Year's Eve into New Year’s Day, approximately 150 people attempted to climb over and crawl under barriers at the border in the same region. Though many migrants turned back when federal agents arrived, some on the Mexico side began throwing objects at them. In response, agents used smoke, pepper spray, and tear gas upwind of the rock throwers, according to a CPB statement at the time.

Agents also used an “acoustic device” that streamed a sharp noise, which the inspector general determined some agents had not been certified to use, with a tone that could have caused hearing damage to migrants and law enforcement.

“Given the emergency situation on Jan. 1, 2019, use of the devices was not a violation of policy, but uncertified agents carrying the devices before and after the actual incident was an infraction,” the auditor stated.

In 2012, under President Barack Obama, CBP reported using tear gas 26 times, though that number dropped to three total incidents by 2016. During President Trump's first two years in office, the use of tear gas rose to levels seen in 2012 and 2013, with federal agents using the gas 18 times in 2017.

The Pentagon does not allow tear gas to be used in war situations.

The use of tear gas against the public has been a central issue this summer due to its use against protesters and rioters.

    Keep them out.

Let their president give them their "human rights" and stop dumping their people over our border!

Use water canons to stop this invasion of our country.
