    CALEXICO, Calif.- A Border Patrol agent shot and killed a man who threatened him with a softball-sized rock at the border, the agency said Tuesday.
    The agent fired an M-4 assault rifle at the man, who had escaped from a scuffle with another agent as he tried to run back into Mexico, said Border Patrol spokesman David Kim.

    The victim, whose name, nationality and immigration status were not released by U.S. authorities, was pronounced dead from one bullet wound at El Centro Regional Medical Center after the incident Monday. Kim said he did not know where the man was struck.

    Pablo Arnaud Carreno, Mexico's consul in Calexico, said the victim was a Mexican man who was apparently in the U.S. illegally. The Mexican government asked U.S. authorities for a thorough investigation.

    "It seems unjust to shoot someone who is unarmed," Arnaud Carreno said Tuesday.

    The shooting, reported Tuesday in the Imperial Valley Press, occurred shortly after 5:30 p.m. in Calexico, about 120 miles east of San Diego.

    Border Patrol agents saw seven people climb a border fence, run to the All-American Canal and attempt to cross the waterway in rafts, Kim said. The victim was in a raft that turned around back toward Mexico.

    Kim said the agent fired after seeing the man's arm cocked back with a rock in his hand.

    Other people continued to throw rocks at the agents, Kim said. A Molotov cocktail that had failed to explode was later found nearby.

    The FBI is investigating and the Imperial County coroner's office was performing an autopsy. The Border Patrol declined to identify the agent.

    I commend the Border Patrol for defending themselves against this criminal!

    Since when is brandishing a SOFTBALL SIZED object being "unarmed"? I think Arnaud Carreno needs to re-think that statement!

    Well, too bad for this BP agent. I'm sure he'll spend the rest of his life in jail. If Boosh / Sutton / Gonzalez / Calderon don't have him executed by a firing squad!

    This agent should thank his lucky stars Benedict Sutton isn't in CA.

    CALEXICO - U.S. Border Patrol officials confirmed Tuesday the man who was shot near the Mexican border on the west side of Calexico died at El Centro Regional Medical Center, where he was transferred after the incident.

    The man, whose identity and legal status in the United States has yet to be determined, was shot once with an M-4 assault rifle, which is a condensed version of an M-16, Border Patrol Agent David Kim said.

    An M-4 is one of three standard-issue service weapons provided to agents by the Border Patrol.

    Kim said agents saw the man, along with a group of people, scale the international fence and use a raft to cross the nearby All-American Canal.

    Kim said, according to initial reports from agents, the man attempted to return into Mexico and was involved in a struggle with a Border Patrol agent.

    After the struggle he grabbed a softball-sized rock and began walking toward the border fence, Kim said, and an agent with an M-4 assault rifle was approached by the man with the rock.

    The man raised the rock as if to throw it, according to reports, and the agent shot him once with the assault rifle.

    It could not be confirmed where the man was shot, but Kim said it was at “pretty close range.”

    Four of the men who climbed the fence began throwing rocks at agents on the north and south side of the All-American Canal and an agent fired a shotgun round in their direction, Kim said.

    He said it was not known if anyone was struck by the shotgun blast.

    The exact location of the agent who fired the shotgun wasn’t available.

    The four men fled back into Mexicali.

    At first, Kim said, agents used weapons that resemble paint ball guns that fire pepper spray rounds but resorted to lethal weapons when they proved ineffective.

    A lighted Molotov cocktail that did not explode was found near the scene after the suspects fled, Kim said.

    Kim said a smuggling organization is believed to operate in the area, but its involvement in the incident could not be confirmed.

    Mexican authorities were contacted and secured the area near the incident on the Mexicali side of the border, Kim said.

    Any one know the AG for CA ? We could write him, asking for the BP agent to receive the professional assistance of all federal agencies and ask for the strongest possible charges be brought against the Mexican invader that tried to murder one of our hard working, dependable BP agents.

    We could send copies to the Mex. officals. We should be sending the letters asking for justice, not the Mex. govt. Let's not wait for another BP agent to be railroded into jail.

    I agree with your passion magyart. I worry for every Border Patrol agent these days. But you'll not find a friend in the AG of California who is by the way Jerry Brown (sound familiar?). In fact, I'd be reluctant to start something up with this unless charges are being brought. It could cause backlash. You can rest assured that if there's any hint that charges are brought against this agent it won't matter who the AG is, and backlash won't be a factor; he'll be getting a lot of input from us I'm sure.     I hope when Brown is referring to "Immigrant's Rights" he's referring to legal immigrants but somehow I doubt it.
