This would be great but it will never happen.
If the voters or the state government or the federal government passed this
the FEDERAL COURTS would rule it UNCONSTITUTIONAL in a heart beat.

It doesn't have a number yet. They have to gather enough signatures to get it on the ballot and have the signatures verified to get it approved for the ballot and then it gets a number.

GO GO California! No one can save you but you. The courts that ruled against your proposition back when it was first passed should have to pay for the nightmare they caused our country's beautiful state of California.

If CA. can get this passed it will make it much easier to get similar legislation passed in other states and maybe even at the federal level.

I can't wait to see how this one comes out.

This is not just a revival of Prop 187, of course - it goes after CalWORKS as well, an effort to scale back the safety net couched in an attack on the children of the undocumented. This is an especially sick and unconscionable attack on Californians in a time of crisis, especially the deliberate targeting of children in order to cause them pain and suffering.

It is not an "unconsionable attack on Californians". It is aimed at stopping illlegal aliens from getting benefits that belong to legal citizens. Illegal aliens have caused the state of CA and the entire country to be in the economic situation we are in. No one is targeting children either. If you are in the country illegally, pack up and move back home with your children.

SACRAMENTO -- A conservative group is hoping to bring the issue of illegal immigration back to the front burner of California politics with a ballot measure that would create a new caste of birth certificates for children of the undocumented.

An initial version of the measure was cleared to begin gathering signatures Friday, but proponents said they plan to make minor amendments and refile the measure soon.

The initiative, which proponents tout as the California Taxpayer Protection Act, is aimed for the June 2010 statewide ballot.


For undocumented parents to obtain the new "Certificate of Live Birth with Foreign Parent," they would have to be photographed, fingerprinted and pay an additional $75 fee.

Beyond the birth certificates, the measure also would limit welfare payments for the children of undocumented immigrants, as well as require that any application for public benefits submitted by illegal immigrants be handed over to federal authorities.

The state's current 10.5% unemployment rate makes this "the absolute worst time to continue to spend taxpayer money and resources on foreigners who are in the United States illegally," said Tony Dolz, one of the measure's authors.

Former GOP state Sen. Bill Morrow, of Oceanside, is a co-author.

Should the measure qualify, it could rekindle California's long-simmering electoral wars over race and culture, which last peaked in 1994 with the passage of Proposition 187.

That measure, which stripped illegal immigrants of access to state services, was largely overturned in court.

"It's sad, unfortunate and abhorrent," Democratic Sen. Gil Cedillo of Los Angeles, a prominent immigrant advocate, said of the new initiative. "And it's probably, as they would say, illegal."

The initiative, according to the proponents' Web site, appears to be the first step to try to end citizenship rights for children of illegal immigrants.

That would bump up against the 14th Amendment of the U.S. Constitution, which guarantees that every child born in the United States is a U.S. citizen.

"Our citizen's movement will launch the national debate we need to bring an END to 'birth tourism' and AUTOMATIC CITIZENSHIP in the United States of America," the site reads.

The initiative itself "does not say that," noted Dolz, who said that "personally we might feel one way or another."

Proponents have raised and spent nearly $200,000 so far, and plan to raise more as they gather signatures.

I think it will qualify and if their are no illegals voting it will pass.

If it passes and is upheld the illegals will stop having a half dozen children, they might only have one or two.
