Previously deported criminal alien charged with illegally re-entering the U.S.

Previously convicted of transporting illegal aliens in 1998

LOUISVILLE, Ky. - A previously deported criminal alien from Mexico was indicted in federal court Wednesday for illegally re-entering the United States. The charge resulted from an investigation conducted by U.S. Immigration and Customs Enforcement (ICE).

A federal grand jury in the Western District of Kentucky returned an indictment June 23 against Perfecto Almazan-Rodriguez, 28, on charges of illegally re-entering the United States after having been previously deported, which is a felony.

The indictment alleges that Almazan-Rodriguez, a Mexican national, was illegally present in the United States after being previously deported. He did not have the consent of the U.S. Attorney General or the Secretary of the Department of Homeland Security to re-enter into the United States.

According to a court affidavit, Almazan-Rodriguez was arrested on May 6 by the Louisville Metro Police Department (LMPD) and charged with giving an officer a false name or address, disregarding a stop sign, operating a vehicle without a license, and failure to maintain automobile insurance. During an interview, ICE agents determined that that Almazan-Rodrigez was previously deported in 2009. His previous criminal history includes numerous arrests and a 1998 conviction for transporting illegal aliens.

If convicted, Almazan-Rodriguez faces up to 20 years imprisonment and a $250,000 fine. After serving any prison sentence imposed, he will be turned over to ICE for deportation.
