Day Laborers Sue Over Oyster Bay Town Ordinance

Day Laborers Sue Over Oyster Bay Town Ordinance

GARDEN CITY, N.Y. (AP/1010 WINS) -- Groups representing Hispanic day laborers have filed a lawsuit challenging a Long Island town's ordinance. They say the 2009 law prohibiting pedestrians from soliciting employment and barring drivers from stopping to hire workers is unconstitutional.

Attorneys for the day laborers had planned to ask a federal judge in Central Islip for a temporary restraining order halting enforcement of the law, but the proceeding was postponed until Wednesday.

Attorney Alan Levine of LatinoJustice PRLDEF said the Town of Oyster Bay has yet to cite anyone for violating the law. But he said day laborers have been intimidated from standing on streets in communities like Locust Valley and Farmingdale since the ordinance was enacted in September.

Town Supervisor John Venditto defended the law. He says it's intended to address safety concerns.
