    Woman who allegedly hit teacher, tried to flee scene is suspected of being in country illegally

    INDIANAPOLIS, Ind. – According to ICE, a woman who allegedly hit a preschool teacher crossing the street and tried to flee the scene is suspect of being in the country illegally.

    Juana Noemi Loa-Nunez, 36, from Mexico, is accused of hitting Jessica Parks, 27, on Monday morning while Parks crossed 38th Street to go to work at Fervent Prayer Church. They say Parks sustained serious injuries to her legs and lower body.

    Immediately after the accident, witnesses say the car, driven by Loa-Nunez, quickly fled.

    Several people chased Loa-Nunez down the street to stop her from leaving the scene.

    Van Williams, a bus driver for Fervent Prayer Church and Parks’ co-worker, was able to veer his bus in front of Loa-Nunez, and another witness, Shayna Pearson, pulled up behind her to prevent her from escaping.

    Responding IMPD Officers arrived and took Loa-Nunez in for questioning and a blood draw at a local hospital. Monday afternoon, police said Loa was arrested on charges of leaving the scene of an accident causing serious bodily injury, and operating a vehicle having never received a license.

    On Tuesday, ICE released the following statement about Loa-Nunez:

    “On May 8, 2018, deportation officers with U.S. Immigration and Customs Enforcement (ICE) placed an immigration detainer and an administrative arrest warrant with the Marion County (Indiana) Jail, following Loa-Nunez’s local arrest on criminal charges.”

    It sounds like the injuries are massive. Another illegal causing chaos and physical damage for which there will be no restitution.

    She needs to make a detour to prison first. The lady she hit suffered serious injury. Deportation is not a punishment for a criminal act upon a citizen of our country. Deport her within 24 hours and she'll probably be back within 3 weeks. Nope, in my opinion, she needs to pay for her crime first.

    ​Woman says she forgives driver who hit her and took off while she was walking to work

    INDIANAPOLIS, Ind. – Just one day after a driver hit 27-year-old Jessica Parks, she is up and talking, showing so much strength and determination to get back to her students. A driver hit her while she was walking to work at Fervent Prayer Church Monday morning.

    "I looked and I didn't see a car. And all I remember was flying up and landing on the sidewalk," Jessica said.

    Jessica says the things that stand out the most are the people who ran to her side.

    "She was a nurse. She was on her way to work and she saw it happen and she stopped. And the paramedic was getting off of work. She saw it and she stopped. I thought it was nothing, but God how he just had angels in place at the right time at the right moment," Jessica said.

    While Jessica was on the ground, witnesses went after the driver who took off from the scene blocking her car in until police got there.

    ICE confirms the suspected driver, 36-year-old Juana Loa-Nunez, is from Mexico and is suspected of being in the country illegally.

    "I do want her to know that I do forgive her and that sometimes fear if you do something when you're scared it can cause you to act a certain way so I don't know if she wasn't thinking or what the case may have been but I do forgive her," Jessica said.

    Jessica suffered a broken leg and will need a blood transfusion. Doctors say she's looking at about six months of recovery. She wants this to be a lesson to drivers.

    "A life is gone or a life has to deal with months of complications in the long run so I just want people to be more aware as they drive," Jessica said.

    Despite her challenges ahead, Jessica says she's not her current circumstance.

    "I'm more grateful to be here than anything because in most cases a lot of people they don't survive trauma the way I survived my trauma yesterday. To come out of it and still be alive today is nothing far more than a blessing and I don't take it lightly at all."

    Jessica’s family has set up a GoFundMe to help with medical bills and rehab she'll need once she's released from the hospital.

    ICE criticizes Marion County for releasing hit-and-run suspect

    INDIANAPOLIS, Ind. – The U.S. Immigration and Customs Enforcement Office (ICE) has released a statement criticizing Marion County officials for letting Juana Noemi Loa-Nunez out of custody, reports Fox59.

    Loa-Nunez is accused of hitting a preschool teacher while being in the country illegally.

    On Monday morning, authorities responded to 38th St. near Fervent Prayer Church on the report of a hit-and-run.

    Jessica Parks, 27, was badly injured when Loa-Nunez allegedly struck her and then attempted to flee. Several citizens chased Loa-Nunez down 38th St.

    A church bus driver said his instincts kicked in and he eventually veered in front of her vehicle. Meanwhile, another citizen pulled behind Loa-Nunez, blocking her in until police arrived.

    “You just have to kind of take charge of every situation that you can,” Van Williams said. “I was able to call the school and tell them to call 911 and inform them that a teacher had been struck while I was en route to chase the car down.”


    Loa-Nunez was arrested on charges of leaving the scene of an accident causing serious bodily injury and operating a vehicle having never received a license.

    She reportedly told police she did not leave her vehicle to offer aid because she was frightened when people began honking at her.

    According to court documents, she posted a $250 cash bond to be released on Thursday.

    On Friday, ICE called out Marion County officials for letting Loa-Nunez out of jail.

    Richardo Wong, the Field Office Director for ICE in Chicago released the following statement:

    “Without any regard for the safety of its citizens, on May 10, Marion County brazenly ignored an immigration detainer and released a Mexican woman from its jail without first notifying U.S. Immigration and Customs Enforcement (ICE). The woman it released is an illegal alien who is accused of hitting and badly injuring a pedestrian, and then fleeing the scene before being pursued and stopped by conscientious citizens. Marion County allowed this woman to go free, and she continues to be a danger to anyone else who happens to be on the same road she drives.

    As law enforcement professionals, ICE and Marion County should both have the same ultimate goal in mind — to protect the public by combating criminals and holding those who break our laws accountable. ICE helps fulfill that role by removing criminal aliens and other immigration violators from the streets, and from the United States. ICE can do its job more effectively when local officials actively work to protect its citizens by honoring ICE immigration detainers.”

    INDIANAPOLIS, Ind. – Marion County has issued a response after ICE scrutinized them in a statement regarding Juana Noemi Loa-Nunez.
    They said ICE failed to act in “accord with the law by failing to pick up this individual in a timely manner.”
    Marion County claims ICE was given four hours notice, in accord with Indiana law and a judge’s ruling, to take Loa-Nunez into custody.
    They said ICE is in charge of enforcing immigration law, not local sheriff’s offices.
    Marion County’s full response is below.
    “United States Immigration and Customs Enforcement (ICE) recently released a statement blaming the Marion County for the release of Juana Noemi Loa-Nunez from the Marion County Jail. In accord with the ruling of Federal Judge Sarah Evans Barker, and Indiana law, ICE was given four hours notice to take custody of Ms. Loa-Nunez. ICE failed to act in accord with the law by failing to pick up this individual in a timely manner.
    Judge Sarah Evans Barker has ruled that ICE must provide a criminal warrant or a criminal probable cause affidavit for the County to detail undocumented individuals. ICE failed to provide such documentation, despite receiving timely notice. Thus, ICE allowed this individual to go free.
    If ICE wished to challenged the ruling of Judge Sarah Evans Barker, it could have done so. It did not.
    United States Immigration and Customs Enforcement, not the Sheriffs of Indiana, is charged with the enforcement of immigration law. However, Marion County acts wholly in accord with the ruling of Judge Sarah Evans Barker and Indiana law.”
