DHS Announcement on Temporary Protected Status for Somalia, 18 Month Extension

Secretary of Homeland Security Kirstjen M. Nielsen Announcement on Temporary Protected Status for Somalia

    Release Date:
    July 19, 2018

Secretary of Homeland Security Kirstjen M. Nielsen has announced her determination that an extension of the Temporary Protected Status (TPS) designation for Somalia is warranted pursuant to the Immigration and Nationality Act.

After carefully reviewing conditions in Somalia with interagency partners, Secretary Nielsen determined the ongoing armed conflict and extraordinary and temporary conditions that support Somalia’s current designation for TPS continue to exist. Therefore, pursuant to the statute, she has extended Somalia’s TPS designation for 18 months.

Individuals from Somalia with TPS will be eligible to re-register for an extension of their status for 18 months, through March 17, 2020. Prior to the conclusion of the 18-month extension, the Secretary will review conditions in Somalia to determine whether its TPS designation should be extended again or terminated.

The decision to extend TPS for Somalia was made after a review of the conditions upon which the country’s designation is based.

Following careful consideration of available information, including recommendations received as part of an inter-agency consultation process, the Secretary determined that the conditions supporting Somalia’s designation for TPS continue to exist. Thus, under the applicable statute, the current TPS designation must be extended.

There are approximately 500 Somali TPS beneficiaries. This 18-month extension of Somalia’s designation for TPS permits current Somali TPS beneficiaries to re-register for TPS and remain in the United States with work authorization through March 17, 2020. To be eligible for TPS under Somalia’s current designation, along with meeting the other eligibility requirements, individuals must have continuously resided in the United States since May 1, 2012, and have been continuously physically present in the United States since September 18, 2012.

Further details about this extension for TPS, including information about the re-registration process and employment authorization documents, will appear in a Federal Register notice.

State leaders call for extension on Temporary Protected Status for Somali refugees

MINNEAPOLIS (KMSP) - State leaders are calling on the federal government to extend Temporary Protected Status for hundreds of Somali refugees in the United States.

The move comes as the Trump administration works to end a special immigration program protecting those refugees.

    Minnesota
is home to the nation's largest concentration of Somali immigrants. The Department of Homeland Security is expected to decide by Thursday whether to extend those temporary legal protections.

Minneapolis Mayor Jacob Frey, Council Member Abdi Warsame and Council Member Alondra Cano wrote a letter to Homeland Security leaders asking for an extension on TPS.

“Ending TPS designation for Somalia would force hundreds of Somali citizens living in the U.S. to either leave families, homes, and jobs they have known for decades to return to a now-unfamiliar and still dangerous country or remain here without documentation and risk legal action against themselves and their families,” wrote the politicians. “No matter the outcome, families and lives would be irreparably damaged.”

Governor Mark Dayton also sent a letter to President Trump asking for an extension.

"Contrary to some published reports, there is no immigration “disaster” taking place in Minnesota. In fact, our immigrant communities – including Somali-Minnesotans – contribute tremendously to our state’s culture, social fabric, and economy,” wrote Governor Dayton in the letter. “The overwhelming majority of Somali refugees are peaceful and productive people, who have been allowed to make their homes in Minnesota.”

The Department of Homeland Security announced Thursday it has extended the temporary protected status for Somalia by 18 months.

In a release, the department said "the ongoing armed conflict and extraordinary and temporary conditions that support Somalia's current designation for TPS continue to exist."

Beneficiaries of Somali's temporary protected status - of whom there are about 500, according to DHS - will be eligible to re-register for an extension of their status through March 17, 2020.

Once the 18-month extension nears its end, DHS will once again review Somalia's temporary protected status.

The special immigration designation for Somalia was initially approved by President George H.W. Bush in 1991 due to a civil war and has been extended 22 times since then.

Sen. Amy Klobuchar released the following statement after the DHS announcement:

"The Somali community in Minnesota—the largest in the country— has contributed so much to the cultural and economic vitality of our state.

Conditions in Somalia remain dire, and the Administration recognized this and extended Temporary Protected Status for Somalia,” Klobuchar said. “I’ve always believed that our country’s strength comes from the diversity of our people. Somali people in Minnesota and across the U.S. deserve to continue living, working, and succeeding here, as they have for decades."
