Dover man charged with assault is wanted in Mexico for murder

An alleged undocumented immigrant from Mexico who was living in Dover is wanted in his native country for murder, authorities learned after he was charged Wednesday with choking, punching and kicking another person in town.
Jose A. Gonzalez-Gamboa, 28, of First Street was held Friday in the Morris County Jail, and a hearing is set for next Thursday in state Superior Court, Morristown. Gonzalez-Gamboa was arrested and charged Wednesday with a domestic violence-related simple assault in Dover, during which the victim allegedly was choked, punched and kicked around the head and legs.
Under the state's new criminal justice reform mandates, which took effect Jan. 1, a public safety assessment is conducted on defendants to determine whether they should be held in pretrial detention in the Morris County Jail or released under special conditions, pending future court appearances. Information about Gonzalez-Gamboa being wanted in Mexico on a murder charge emerged during the public safety assessment, according to authorities.
The Morris County Prosecutor's Office has filed a motion - scheduled to be heard Thursday by a Superior Court judge - which seeks to keep Gonzalez-Gamboa in the jail. Federal Immigration and Customs Enforcement officials also have filed a detainer against the suspect.
It was not immediately clear Friday what arrangements would have to occur for Mexican authorities to take custody of Gonzalez-Gamboa on the murder charge, and details of the crime in Mexico were not available.
According to records, Gonzalez-Gamboa has lived in Dover for about three years, is not married and currently is not employed.
A certification filed by the Prosecutor's Office in support of keeping Gonzalez-Gamboa in the county jail, at least for now, states: "Defendant is not a U.S. citizen. ICE is filing a detainer. The defendant is a foreign fugitive wanted for the charge of murder out of Mexico. Even if released on maximum conditions, there are no non-monetary conditions or combination of non-monetary conditions that will assure the defendant's presence in court, protect the safety of the victim/community or assure that he will not obstruct the criminal justice process."
Under criminal justice reform, also known as bail reform, the former method of having defendants post money to get out of jail while awaiting resolution of their charges has been scrapped. Defendants who pose a low risk to the community and a low risk of flight are released under certain monitoring conditions, while defendants who present a risk to the community can be detained by judicial order.
