Former DACA Recipient Arrested While Attempting to Enter US Illegally

Former DACA Recipient Arrested While Attempting to Enter US Illegally

    By NBC 7 Staff

A participant in the Deferred Action for Childhood Arrivals program--or DACA--who was previously deported under the Trump Administration, was arrested by Border Patrol agents while attempting to illegally cross the U.S-Mexico border.

    Juan Manuel Montes
, 23, was arrested around 11:50 p.m. Monday near Downtown Calexico, according to the U.S. Customs and Border Protection.

Agents at the Calexico Border Patrol Station were notified by Remote Video Surveillance Systems operators that someone had made an illegal entry across the border.

Montex ran approximately 200 years north of the international boundary fence and laid down on the ground. When agents approached him, he attempted to run away, CBP said.

He was arrested after a short foot chase and transported to the Calexico Station for processing.

Montes had been deported to Mexico on Feb. 18. He was also arrested previously while attempting to enter the U.S. illegally.

"Our agents witnessed and arrested Mr. Bojorquez making an illegal entry into the United States for the second time this year," said Assistant Chief Patrol Agent David S. Kim. "Border Patrol Agents will always stop, detain, and arrest anyone making an illegal entry into the country irrespective of their immigration or citizenship status."

Montes came to the U.S. when he was 9-year-old and pursued a welding degree at a community college after his high school graduation, according to a lawsuit that was filed after his previous arrest.

He qualified for the DACA program in 2014 and renewed his status for two years in 2016. He currently lives in Mexico.

According to the complaint, Montes was stopped by a CBP agents in Calexico after he was on his way home from seeing a friend. He did not have his wallet, California identification and EAD card on him.

Montes was driven to a port of entry near or in Calexico and was allegedly asked the sign documents written in English by CBP agents, the complaint said.

The complaint also alleged that Montes was not provided any documents as to why he was sent back to Mexico.

I'm going to assume this is new news but it seems familiar. I can't find an actual date of the arrest in the article. Hope he gets prosecuted as a felony return.

Deported 'dreamer' arrested again for trying to enter US

    • By THE ASSOCIATED PRESS

    CALEXICO, Calif. — Nov 8, 2017, 9:15 PM ET

An immigrant who had been shielded from deportation but was sent back to Mexico has been arrested for returning to the United States for the second time this year, authorities said Wednesday.

Juan Manuel Montes, 23, was taken into custody near Calexico for illegally re-entering the United States late Monday night, the U.S. Border Patrol said in a statement.

Montes was spotted by agents just north of a border fence, and ran from them for about 200 yards before laying down. He then attempted to get up again and run, but was quickly caught, the Border Patrol said.

According to his lawyers, Montes was the first-known participant in the five-year-old Deferred Action for Childhood Arrivals program to be deported under President Donald Trump.

The program — which Trump announced in September he was ending — gave work permits and deportation protection to nearly 800,000 immigrants in the country illegally who were brought here as children. Its participants are sometimes known as "dreamers."

Montes claimed that he was wrongly expelled in February from the United States, but the administration said he left the country voluntarily, causing him to lose his protected status under the program.

Montes, who came to the United States when he was 9, has a cognitive disability that likely stems from a childhood brain injury, according to his lawyers.

"Border Patrol Agents will always stop, detain, and arrest anyone making an illegal entry into the country irrespective of their immigration or citizenship status," the agency's statement said.

How can you live in USA for 13yrs, graduate high school and complain you didn't know what you were signing because it was in English - oh and now the excuse of a brain injury, yet graduated high school. Guess we paid for all sorts of healthcare and special teachers too.

There are many out-of-work welders (American citizens) here in the Chicago area because illegals come here in droves sucking up all the welding jobs and lowering wages. They take jobs that Americans don't want my ass. That's the biggest lie of supporters of illegals.

Welding used to be a very good paying career here in the Chicago area a long time ago. Now it's a low-paying crap job because all the manufacturing plants around here are full of illegals.
