Govt. mum on why agent suspect wasn't extradited
TUCSON, Ariz. (AP) -- In separate letters, White House and Justice Department officials have failed to tell 39 congressmen why a now-freed suspect in a Border Patrol agent's death was not extradited from Mexico.
Mexico says the United States sought extradition after Jesus Navarro Montes was freed on unrelated charges.
Presidential counsel Fred Fielding wrote that the White House deferred to the Justice Department "to avoid saying anything that might interfere with or undermine" its investigation's effectiveness.
And Deputy Assistant Attorney General Keith Nelson wrote that Justice remains firmly committed to the case but providing more information would "inevitably compromise" that goal.
California Rep. Brian Bilbray says the responses "are bureaucratic and lack transparency" and said Americans seem to be getting more information from the Mexican Embassy.

Murder Suspect In B.P. Agent's Death Still Not Arrested

A Border Patrol Agent is mowed down, trying to stop a smuggler back in January. Agent Luis Aguilar's accused killer, Mexican national Jesus Navarro Montes was arrested in Mexico and has since been released.
A California lawmaker is trying to find out why the United States didn't file an extradition request for the murder suspect, until after he was released.
It's been nearly seven months since the death of Yuma Sector Border Patrol Agent Luis Aguilar. Today, the United States government isn't any closer to bringing his accused killer to justice.
California Congressman Brian Bilbray has teamed up with 38 lawmakers to find out why Jesus Navarro Montes was released from a Mexican prison before the United States could arrest him.
"The Justice Department and the White House basically said that they don't know what went on and that they're promising to get us the information as soon as possible but I'm still waiting."
Congressman Bilbray is demanding to see all correspondance between the United States and Mexico.
He fears the evidence will show that the government dropped the ball.
"We basically have shown we did not respond to a situation as well as the Mexican justice system did. I think it's a real insult to the people of the United States."
The Congressman calls it a case of "beaurocratic game-playing" which caused an accused murderer to slip through the cracks.
A spokesman with the Mexican Embassy says the U.S. did issue papers for an arrest, but it happened more than a week after Montes was released from custody.

Everyone from the jailers to President Calderon knew Jesus Navarro Montes was a suspect in the murder of Border Agent Luis Aguilar. Mexico should have notified the United States of his impending release.
