Presence requirements:
- Present on the same day when submitting the application
- Was in the US on June 15, 2007
- Entered the US before turning 16
- Good moral character
- Under 31 as of June 15, 2012
- Has remained in the US from June 15, 2012 up until the new approval
- Had no lawful immigration status on June 15, 2012
Educational requirements:
- Is enrolled full-time
- Or has a high school diploma or GED
- (Unless the applicant is mentally or physically disabled)
Reasons for inadmissibility:
- Felonies: Any
- Misdemeanors: ANY of domestic violence, child abuse or neglect, assault, violation of protection order, or DUI/DWI
- Misdemeanors: Any two (except minor traffic offenses)
- Any offense under foreign law
- Any juvenile offense relating to murder, manslaughter, homocide, rape, statutory rape, any offense of a sexual nature involving a <18, any violent crime, or any offense punishable under the controlled substances act. All juvenile records also have to be submitted.
- Any sexual assault convictions
- Failure to pay restitution or legal judgments for any other conviction
- Member of a gang
- Failure to comply with a removal order or voluntary removal order
- Any of the deportable reasons spelled out in INA237 (flight from immigration checkpoint, any firearm related conviction, failure to register for selective service, falsely claiming citizenship, etc)
- Previously ordered removed in absentia
- Unable to maintain an income that is 125% above the federal poverty level (~$15,000/year) without a good reason
- Delinquent in any federal, state, or local income or property taxes
- Having any legal status (with the exception of TPS)
Application period:
Within one year of the bill becoming law
Application process:
- Might have to provide tax returns and evidence of tax refunds/returns
- May have to do an in-person interview
- Have to include a passport from country of origin, birth certificate, or state ID
- Need school biometrics
- There will be a background check & biometrics
- $1,000 border security fee
- Additional $XXX? unknown fee, but enough for the program to fund itself
