Attorney: Immigration Raid Warrants Invalid

DES MOINES, Iowa -- An attorney for a kosher slaughterhouse said Tuesday that warrants used in an immigration raid are invalid, and evidence gathered from it should be excluded from the trial against the plant.
Jim Clarity, attorney for the Agriprocessors, Inc., filed a motion claiming that the May 2008 raid violated the rights of the 389 workers arrested. Clarity said evidence and testimony gathered during the raid should be excluded from the trial.
Clarity said agents detained all Hispanic workers without reasonable suspicion that they were in the country illegally. He said the warrants didn't properly identify the suspects or provide probable cause.
Since the raid, Agriprocessors has filed for bankruptcy protection. The company and some managers face civil and criminal charges.
