    ICE slams N.J. jail for releasing man despite detainer request

    MOUNT HOLLY TWP. -- The U.S. Immigration and Customs Enforcement released a statement slamming Burlington County officials for releasing an immigrant that federal officers wanted held.

    The release said that ICE Enforcement and Removal Operations were later able to arrest the man in question, Denner Dos Santos, 22, a Brazilian, in Mount Holly on Feb. 22.

    ICE said that the county "failed to honor a detainer lodged by ICE" to hold Dos Santos when he was in custody back in July.

    ICE can make detainer requests to local law enforcement or jails to hold an individual that ICE suspects is "subject to removal from the United States" for 48 hours past the time they would have originally been released.

    It allows time for ICE officers to take that person to a facility where they can be held pending deportation hearings.

    Khaalid H. Walls, a spokesman for ICE, said that the agency filed its detainer request with the county July 11, and yet Dos Santos was released the following day.

    "The point of our issuance of the statement was to bring awareness to the fact that we had to make this arrest outside of a secure jail setting, when had the detainer been honored, he could have been taken into custody in July and not months later," Walls said in an email.

    Calls and emails to county officials, including spokesman Eric Arpert and Jail Warden Mildred Scholtz, were not returned Tuesday. The Burlington County prosecutor's office and the Mount Holly Police Department also did not return calls seeking information about what charges had led to Dos Santos being held in the Burlington County Jail last July.

    Chia-Chia Wang, organizing and advocacy director for the American Friends Service Committee, said that a detainer request is just that - a request.

    "It's not legally-binding," Wang said. They are not the same as warrants or criminal detainers issued by judges. "County jails or local law enforcement do not have to hold them."

    Occasionally, facilities that have held people on immigration detainers have gotten sued for holding them over 48 hours or because the person turned out to be a legal resident, she said.

    "I'm glad Burlington County didn't hold them because it's not their job to help with immigration enforcement," Wang said.

    She wondered if the decision to name Burlington County in the press release was intended as an implicit warning to other departments or agencies: if you ignore detainer requests, you risk public safety and getting called out in public by ICE.

    Walls also said that due to a mistake, the ICE press release incorrectly said that the detainer was filed after Dos Santos was already released.

    Even though the release included that misstatement, most commenters on the ICE Facebook page were highly critical of the county officals and called for their prosecution.

    "ICE shares the county's ultimate objective to protect public safety and national security while simultaneously preserving the critical community-police bond," John Tsoukaris, ERO Newark field office director, said in the release. "As such, county jails that fail to work with ICE put their communities at risk."

    Again, why haven't the localities in which the crime was committed put out a warrant on these people.

    This is why ALL illegals and Visa overstays must be handed over to ICE when captured and out of the hands of the States jails and judges.

    Put them all in a Federal Tent City, under Federal Jurisdiction. They go before a panel of Judges...serve time and/or get deported.
