A federal grand jury in Denver returned an indictment yesterday, charging an illegal immigrant from Mexico with transporting other illegal aliens in the United States, resulting in the death of three men and a pregnant woman after his van crashed on Interstate 70.

Jose Francisco Franco-Rodriguez, 23, was charged with transporting unlawfully aliens in the United States resulting in death, and with unlawful reentry of a previously deported alien.

An arrest warrant has been issued, ordering U.S. Marshals to transfer Franco-Rodriguez from state custody to federal custody.

On Nov. 27, Franco-Rodriguez is suspected of driving a van eastbound on I-70 packed with 14 other people in the United States illegally, when he lost control and crashed. The crash resulted in the death of three men and a pregnant woman. Other injured passengers were transported to area hospitals, and are now being held as witnesses.

On Oct. 23, 2005, an immigration judge in Atlanta, ordered Franco-Rodriguez deported from the Unites States.
