    Illegal immigrant convicted in assault on Ariz. border agent

    A 26-year-old Mexican man who was shot by a Border Patrol in 2009 after throwing rocks at him was found guilty on two counts of assault on a federal agent.

    The assault occurred on May 23, 2009 west of Nogales when Jaime Martinez-Garcia, 26, of Guaymas, Sonora, Mexico, encountered a Border Patrol agent, according to a news release from the U.S. Attorney's Office.

    Martinez-Garcia, who had been deported three days earlier, had crossed illegally again when he met up with a Border Patrol agent in Portero Canyon west of Nogales, according to the news release. He ignored the agent's orders, and kicked the agent in the leg during a fight. He ran away and encountered another agent.

    That agent drew his weapon and ordered Martinez-Garcia to drop the rock. He didn't put it down, instead throwing it at the agent and hitting him in the leg. When he picked up another rock, the agent shot the man, the release said.

    The agent shot him three times, wounding him in the right elbow, left thigh and left knee, according to Arizona Daily Star archives. Martinez-Garcia was flown by helicopter to a Tucson-area hospital in stable condition.

    Martinez-Garcia faces a maximum sentence of up to eight years for each assault charge and a maximum of 10 years for a separate illegal re-entry after deportation charge. The FBI investigated the incident.

    throw the book at him and dont give him a light sentence

    Absolutely, throw the "book" at him and make him serve ALL of his mandated term!!!!!
